A regular meeting of the Canton City Council was held
on June 20, 1989 in council chambers.
PLEDGE OF ALLEGIANCE OPENED THE MEETING, FOLLOWED BY
THE INVOCATION GIVEN BY CITY CLERK NANCY WHITES.
Mayor Edwards asked for roll call at 6:30 p.m. Present
- Alderman Kovachevich, Zilly, Steck, Sarff, Meade,
May, Chapman. Absent - Aldermen Bohler.
MINUTES OF JUNE 6, 1989 MEETING. The city clerk noted
~ a correction on page 25. Under the Planning & Zoning
Commission report. The second motion...add in the
words for the painting of fire hydrants.
Motion by Alderman Sarff, second by Alderman Steck,
the minutes of June 6, 1989 as corrected be accepted
and placed on file. Voice vote, motion carried.
Unanimous.
BILLS FOR MAY. Motion by Alderman Kovachevich, second
by Alderman Zilly, the bills properly approved be paid.
Roll call. AYES - Aldermen Chapman, May, Meade, Sarff,
Steck, Zilly, Kovachevich. NAYS - None. 7 AYES 0
NAYS 1 ASBENT. Motion carried.
COMMITTEE REPORTS:
Finance.
Council Action
Motion by Alderman Kovachevich, second by Alderman
Sarff, to authorize the payment to Wehling Well Works
for pay estimate #3 in the amount of $46,607.40.
Discussion. Cliff Sagaser, city engineer, reported
that the original total was $227,881.00 with a retainer
of 10~ for a total of $22,788.00. Roll call. AYES
- Aldermen Kovachevich, Zilly, Steck, Sarff, Meade,
May, Chapman. NAYS - None. 7 AYES 0~AYS 1 ABSENT.

Motion by Alderman Kovachevich, second by Alderman
May, the 10~ retainer of Slack's Excavating be paid
in the amount of $3,938.50 for the prison sewer line.
Discussion. Cliff Sagaser, city engineer, commented
that one man-hole has to be replaced. Roll call. AYES
- Aldermen Chapman, May, Meade, Sarff, Steck, Zilly,
Kovachevich. NAYS - None. 7 AYES 0 NAYS 1 ABSENT.

Motion by Alderman Kovachevich, second by Alderman
May, to approve the expenditure of $1,280.24 to Wheeler's
for the repair of a garbage truck. Roll call. AYES
- Aldermen Kovachevich, Zilly, Steck, Sarff, Meade,
May, Chapman. NAYS - None. 7 AYES 0 NAYS 1 ABSENT.
Motion carried.
Motion by Alderman Kovachevich, second by Alderman
Steck, to approve the expenditure to purchase pipe
from the well to the lake at a cost of $3,275 and the
plant at a cost of $3,454 from Illinois Meter. Roll
call. AYES - Aldermen Chapman, May, Meade, Sarff,
Steck, Zilly, Kovachevich. NAYS - None. 7 AYES 0
NAYS 1 ABSENT. Motion carried.

Zilly, to approve the purchase of pipe for the campground
at $.99 per foot. Roll call. AYES - Aldermen
Kovachevich, Zilly, Steck, Sarff, Meade, May, Chapman.
NAYS - None. 7 AYES 0 NAYS 1 ABSENT. Motion carried.
Motion by Alderman Kovachevich, second by Alderman
Steck to accept the bid of R.L.T. Tree Service for
6 trees at a cost of $375. Roll call. AYES - Aldermen
Chapman, May, Meade, Sarff, Steck, Zilly, Kovachevich.
NAYS - None. 7 AYES 0 NAYS 1 ASBENT. Motion carried.
Motion by Alderman Kovachevich, second by Alderman
Sarff, to accept the low bid of Topline for a 478 engine
at a cost of $3,140. Discussion. Alderman Steck
requested that all items bid on be received, and from
now on printed bid sheets to be made available for
this type of bidding. Roll call. AYES - Aldermen
Kovachevich, Zilly, Steck, Sarff, Meade, May, Chapman.
NAYS - None. 7 AYES 0 NAYS 1 ABSENT. Motion carried.

Zilly, to approve the expenditure of $10,000 for the
City Audit to Hocker & Carter. Roll call. AYES -
Aldermen Chapman, May, Meade, Sarff, Steck, Zilly,
Kovachevich. NAYS - None. 7 AYES 0 NAYS 1 ABSENT.

Negotiations, Grievance & Personnel.
Council Action
Motion by Alderman Sarff, second by Alderman Meade,
David Kitchen be allowed to participate in IMRF. Roll
call. AYES - Aldermen Kovachevich, Zilly, Steck, Sarff,
Meade, May, Chapman. NAYS - None. 7 AYES 0 NAYS 1
ABSENT. Motion carried.
Community & Industrial Development.
Council Action
Motion by Alderman Zilly, second by Alderman Kovachevich,
to approve the lease agreement between CIC and the
Department of Corrections for office space and warehouse
use for 4 months. Voice vote, motion carried. Unanimous.
Motion by Alderman Zilly, second by Alderman May, an
option that has been asked for until March l, 1990
by Bart and Mary Brown to purchase a lot in the
industrial park not be offered. Voice vote, motion
carried. Unanimous.
Informational: Orville Brinson signed a purchase
agreement to purchase a lot in the industrial park.
Informational: The CDAP application for Radon Home
Products will be delievered this Thursday in Springfield.

Council Action
Motion by Alderman Sarff, second by Alderman Meade,
those requesting garbage pickup from being forced into
the city be billed a fee of $18 on an annual basis.
Voice vote, motion carried. Unanimous.

approval for a grant application process be started
for the Bar-Mac addition for sewer services. Voice
vote, motion carried. Unanimous.
Motion by Alderman Sarff, second by Alderman Steck,
to accept the petition and be placed on file as signed
by 90 residents of Edmar Drive and North Main Street,
the request for the removal of a portion of fence for
the safety of pedesterians, and a letter from the
Superintendent of Schools Paul Vonderhaar of the same
request and concerns. Voice vote, motion carried. Voice
vote, motion carried. Unanimous. Petition being #590.
COMMUNICATIONS FROM MAYOR EDWARDS. A Community
Development Director will not be named tonight. The
top 2 candidates withdrew their names for consideration.
Ray McKinney, Supt. of the Water Treatment Plant reported
the lake is below the 10 foot level.
Cliff Sagaser, city engineer, reported that the 2 power
companies resolved their territorial jurisdiction at
the well site. Spoon River Electric Co-op agreed to
start work the beginning of this week for the 3-phase
wiring at the well. The contractor for the well is
in hopes of getting the pump installeci and the discharge
pipe by this Thursday. We had scheduled the city
personnel to start construction of our discharge line
from the well to the lake in the morning. But now
it will be delayed a few days to stay out of their
way.
Mayor Edwards asked when would you guess we will have
water?
Cliff Sagaser, city engineer, replied by the lst of
July.
Mayor Edwards stated, I like to ask the community to
voluntarily conserve water until the 5th of July. If
by July 5th we do not see improvements, and the well
is not pumping we will have to enforce the ordinance.
I'm asking that business's and residents do a voluntary
conservation. (Known as stage l, Voluntary Conservation
under the ordinance)
Motion by Alderman Sarff, second by Alderman Meade,
to delay enforcement of the ordinance until July 5th.
Voice vote, motion carried. Unanimous.
Cliff Sagaser, city engineer, reported that the Soil
Conservation Service Project Agreement has been mailed
to the City. Cliff is asking permission for approval
of the contract. Mayor Edwards said this is for in-kind
services and equipment at a total cost of $10,000,
with the city's cost at approximately $3,OOO.This is
to help.

eliminate erosion at the lake. Work to be done is
the installation of approximately 1,320 feet of critical
area treatment including excavation, leveling, shapinq,
seeding, and mulching along the Canton Lake Shoreline,
at Canton Lake. The City is called the contracting
Local Organization.
Motion by Alderman Sarff, second by Alderman May, to
authorize the mayor to sign the agreement when received.
Voice vote, motion carried. Unanimous.
Mayor Edwards asked Willis Taggart to explain information
received from National Association for the Exchange
of Industrial Resources. Will said they have an
intiation fee for $125. New furniture is given away
almost free. Mayor Edwards recommended the information
be referred to the Mechanical Committee.
Michael Houston from the Public Finance Division of
the Municipal Bond Department, LaSalle National Bank
of Chicago, Illinois gave a presentation to council
for the purpose of assisting the city in the sale of
up to $300,000 General Obligation Bonds. General
Obligation Bonds generally sale at a~ percent lower.
The two primary types of sales you have with a bond
issue are what are referred to as a Public Sale, and
a Negotiated Sale.
In a Public Sale you hire a firm that is known as your
financial advisor. And that firm, for a set fee will
work to structuring your issue so that you sell it
at the lowest possible interest rate. The financial
advisor in a Public Sale does not participate in the
purchase of the bonds but will work to solicit bidders.
One of the major functions of the financial advisor
in a Public Sale is to garner information for the
official statement used in the issue. And this is
sent out to the prospective bidders so that they have
information about the community, finance of the
community, and the project. So they can make a
determination as to whether or not they want to bid.
The second method of sale is what is referred to as
Negotiated Sale. In the Negotiated Sale process, the
city council would give the right to the firm, and
this firm would go out and find the buyers of your
bonds. In the Negotiated Sale process the firm also
acts as your financial advisor. The firm that you
work with in a Negotiated Sale actually buys the bonds
from you and then turns around and sells those bonds
to other people. When we do a Negotiated Sale, what
we do is take your bonds in from the City of Canton.
And we look at the market, and we would make a
determination on a given day just what the market is
and what those bonds should be selling for. We would
then supply that information to our bond salesman,
who would contact our client and say the City of Canton
is going to be doing a bond issue with these securities
and these interest rates. When these become available

available are you going to purchase them? At certain
times the saleman brings in the orders they have, and
we then compare the orders against the number of bonds.
If we have more orders then bonds, we reduce the interest
rate and the saleman goes back and files the same
process.
~ The major advantages of using a Negotiated Sale process
is that it provides for a possible time table and it
allows the bonds to be sold in a shorter period of
time.
The fees for services, including all expenses shall
be $2,550 for a Public Sale. Fees for a Negotiated
Sale are subsumed within the issue.
Aldeman Sarff asked Mr. Houston if he had checked on
the current rate process?
Mr. Houston replied, he had not had the opportunity,
but interest rates are very good right now.
OLD BUSINESS:
Alderman Steck asked Cliff Sagaser, city engineer,
if he had contacted all violators of the sign ordinance,
or, just the one violator? Cliff answered, just the
one violator is all he has contacted. Alderman Steck
said, he did not like for the violators being contacted
and his name being used.
Motion by Alderman Steck, second by Alderman Sarff,
a list of all the sign violators be drawn up and brought
to the committee meeting. Voice vote, motion carried.

NEW BUSINESS:
ORDINANCE - GRANTING A SPECIAL USE PERMIT TO CANTON
ENTERPRISES, LTD., A PARTNERSHIP CONSISTING OF HARLAN
E. CROUCH AND BOB L. REIME, AND DONALD A. KUMER. First
reading, read by title. Alderman May asked Mr. Kumer
who pays for the activities in the park? Don Kumer
replied that when he puts on a christian concert he
pays for them.
Alderman Zilly stated, that the Planning & Zoning
Commission did consider the finding of facts were true.
But I would like a further investigation to make sure
that the present zoning is not being violated by church
services being held there.
Cliff replied they have stated they are not holding
church services there. I can't do anymore than I have
already done. I can't give you any more answers then
I have already given you. The church services does
not have any bearing on what there asking for.
Alderman Meade commented that what this ordinance is
` for is a multi-family dwelling? Mayor Edwards said
it is an exception to B-3 zoning. There is a lady
who wants to have a nursing home in a R-4 zoning, she
will need a special use permit exception and go before
Planning & Zoning.

Jim Mamlgren, city attorney, said that on page 4 of
the ordinance, the special use permit be issued for
a multi-family dwelling pursuant to the provisions
of Section 10-10-3 of the Zoning Ordinance.
Alderman Meade replied that there request has nothing
to do with church services.
RESOLUTION - MFT FOR 1989 IN THE AMOUNT OF $180,000.
First reading, read by title. Motion by Alderman Steck,
second by Alderman Zilly, the resolution be adopted.
Discussion. Alderman Meade said he does not want to
hold up the resolution but wants the resolution to
come before the street committee before going to other
committee's and then council. Cliff Sagaser, city
engineer, replied there was no intention of by passing
the street committee. Tracie was just finished with
the MFT and I decided to bring the request to the
committee of Mechanical and then council to see what
would happen.
Mayor Edwards said he was concerned about another batch
of seal coat like last year, particularly in the north
end of town, where the seal coat came off. Also, did
not want any half streets being done, I'd just as soon
not do them.
Cliff said we have to submit this to the state then
the state will contact the city when the date will
be set for bids. Roll call. AYES - Aldermen Chapman,

reading, read by title Motion by Alderman Zilly, second
by Alderman Sarff, the resolution be adopted. Roll
call. AYES - Aldermen Kovachevich, Zilly, Steck, Sarff,
Meade, May, Chapman. NAYS - None. 7 AYES 0 NAYS 1
ABSENT. Motion carried. Resolution being #2068.
EXECUTIVE SESSION - IMMINENT, THREATENED/PENDING
LITIGATION. PERSONNEL. Motion by Alderman May, second
by Alderman Kovachevich to go into executive session.
Voice vote, motion carried. Unanimous.
Council recessed t 7:32 p.m. The executive minutes
are on file in the office of the city clerk.
ADJOURNMENT: Motion by Alderman Meade, second by
Alderman May, to adjourn. Voice vote, motion carried.
