DATED AT CANTON, ILLINOIS, THIS 15th DAY OF April, 2025 Seal /ndiiith-Walters, City Clerk City of Canton, Illinois ORDINANCE NO. 4467 AN ORDINANCE AMENDING TITLE 6, CHAPTER 1 OF THE CANTON MUNICIPAL CODE AND ESTABLISHING THE POSITION OF DEPUTY CHIEF OF THE POLICE DEPARTMENT WHEREAS, the City of Canton, Fulton County, Illinois (the "City") is an Illinois non- home rule municipal corporation, established in accordance with the constitution of the State of Illinois of 1970; WHEREAS, Title 6 of the Canton Municipal Code (the "Code") sets for regulations pertaining to the City's Police Department; WHEREAS,the City desires to appoint a Deputy Chief of the Police Department to assist with managerial and supervisory duties of the Police Department; WHEREAS,the corporate authorities of the City have determined that it is necessary and in the best interest of the City to amend Title 6, Chapter 1 of the Canton Municipal Code and to establish the position of Deputy Chief of the Police Department. NOW,THEREFORE,BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF CANTON,FULTON COUNTY,ILLINOIS AS FOLLOWS: Section 1. The City hereby finds as fact the recitals set forth above and incorporates said recitals herein as though fully set forth. Section 2. Section 6-1-1 of the Canton Municipal Code is hereby amended in its entirety to state as follows: 6-1-1: DEPARTMENT ESTABLISHED: There is hereby established an executive department of the municipal government of the city which shall be known as the police department, and may consist of up to the police chief, a deputy chief, four (4) lieutenants, four (4) police sergeants, and fifteen (15) patrolmen, up to seven (7) telecommunicators, one noncommissioned code enforcement officer, one executive secretary, and one department secretary. When any officer of the police department, who occupies the position of lieutenant, sergeant, or patrolman, becomes inactive such that it appears that a full time appointment will be necessary so as to fill an ongoing vacancy and/or an anticipated requirement, then the police and fire commission may, at its discretion, appoint an officer in a full time capacity to fill such vacancy. The telecommunicators, executive secretary, department secretary, and the noncommissioned code enforcement officer based upon the recommendation of the police chief, shall be appointed by the mayor with the approval of the city council. Part time noncommissioned personnel may be used on an "as needed" basis to work as radio operators, but only to the extent that the full time commissioned officers are inadequate to meet such needs. Section 3. Section 6-1-4 of the Canton Municipal Code is hereby added to state as follows: 1 6-1-4: DEPUTY CHIEF (A)The deputy chief may be referred to in the Canton Municipal Code as "Deputy Chief," "Deputy Police Chief,"or"Deputy Chief of Police." (B)Term: The Deputy Chief shall hold his or her office until his or her successor shall be appointed and qualified, unless removed from office by the Mayor. The Deputy Chief may removed from office with or without cause.by the Mayor without the approval or consent of the City Council. (C)Appointment, Oath: The Deputy Chief shall be appointed by the Mayor with the approval of the city council. The Deputy Chief shall take the oath prescribed for other city officers and shall execute a bond in accordance with applicable law. Notwithstanding the foregoing, a Deputy Chief is not required to be appointed by the Mayor, and the Mayor may choose not to appoint a Deputy Chief, as he or she determines is in the best interests of the City. (D)Devote Entire Time, Offenders: The Deputy Chief of Police, when on duty, shall devote his entire time and energy to the discharge of the duties of his office, and shall see that the laws and provisions of this code are enforced as far as possible, and that all offenders are reported to some proper tribunal for punishment. (E)Police Powers: The Deputy Chief shall be considered an officer of the City and part of the police force with all powers granted to police officers of the City by ordinance or other applicable law. (F) Reporting; Managerial and Supervisory Authority: The Deputy Chief shall report to the Chief of Police. The Deputy Chief shall otherwise be a commanding officer of the entire police force of the City, subject only to the Chief of Police, the Mayor, and the rules and regulations prescribed by the City Council. The Deputy Chief shall assist the Chief of Police with his or her duties at the direction of the Police Chief. The Deputy Chief shall be engaged predominantly in executive and management functions of the Police Department and is charged with the responsibility of directing the effectuation of management policies and practices with the Chief of Police. The Deputy Chief shall have the authority to direct, reward, and/or discipline the police force in his or her independent judgment and subject to applicable laws, policies, ordinances, and/or collective bargaining agreements. (G)Additional Job Duties: Additional job duties and/or job descriptions of the Deputy Chief of Police may be established by the Chief of Police. (H)Acting Chief. Unless the Chief of Police makes an assignment of Acting Chief of Police, on a temporary basis, of a commissioned officer of the Police Department, the Deputy Chief of Police shall serve as Acting Chief of Police in the event the Chief of 2 Police is unable to perform his or her duties as Chief or in the event the Chief of Police otherwise assigns the Deputy Chief as Acting Chief of Police. (I) Compensation: The compensation of the Deputy Chief shall be established by the City Council. Section 4. That all ordinances or parts thereof in conflict with this Ordinance are hereby expressly repealed. Section 5. If any part or parts of this Ordinance shall be held to be unconstitutional or otherwise invalid, such unconstitutionality or invalidity shall not affect the validity of the remaining provisions of this Ordinance. Section 6. That this Ordinance shall be in full force and effect from and after its passage and approval as provided by law. PASSED THIS 29th day of April, 2025.
