AN ORDINANCE GRANTING A SPECIAL USE PERMIT TO ANDREA PULED AND
PARASKEVA, INC. FOR MULTIFAMILY DWELLINGS ON THE SECOND AND THIRD
FLOORS OF THEIR BUSINESS BUILDINGS.
WHEREAS, a Petition for a Special Use Permit signed by Andrea Puleo, by his agent
and attorney-in-fact, Salvatore Puleo, and by Resham M. Singh, President of Paraskeva, Inc., an
Illinois corporation, the owners of the real property hereinafter described, was filed before the
Planning and Zoning Commission of the City of Canton, Illinois, requesting that a special use
permit be granted to them for multifamily dwelling use on the second and third floors of the
business buildings owned by them; and
WHEREAS, the parcels of real property which are the subject of this Petition are located
at 39, 43, 47, 49 and 55 South Main Street, Canton, Illinois and are legally described as follows:
Part of Lot 45 in Jones' Second Addition to Canton, in Fulton County, Illinois,
described as follows: Commencing 18 feet South from the Northwest corner of
said Lot 45, thence running South 18 feet, thence East 82 %Z feet, thence North 18
feet, thence West 82 %z feet to the place of beginning;

A part of Lot Number Forty-five (45) in JONES' SECOND ADDITION to the
Town, now City of Canton, Fulton County, Illinois, described as follows:
Beginning 30 %2 feet North of the Southwest corner of said Lot, running thence
East 78 feet, thence North 18 feet, thence West 78 feet, thence South 18 feet to
the place of beginning;

described as follows: Commencing at a point 11 feet and 6 inches South of the
Northwest corner of said Lot 46, and running thence South 23 feet and 5 inches
along the West line of said Lot 46, thence East 78 feet, more or less, to the West
line of alley, thence North 23 feet and 5 inches to a point 11 feet and 6 inches
South of the North line of said Lot 46, and thence West 78 feet, more or less, to
West line of said Lot 46 to the place of beginning;

WHEREAS, Andrea Puleo is the owner of record of the real property located at 39, 43,
49 and 55 South Main Street, Canton, Illinois 61520 and there are no other owners of record; and
WHEREAS, Paraskeva, Inc. is the owner of record of the real property located at 47
South Main Street, Canton, Illinois 61520 and there are no other owners of record; and
WHEREAS, all of said real property is wholly situated within the corporate limits of the
City of Canton, Illinois and is presently zoned B-3, Central Business District; and
WHEREAS, all petitions, documents and other necessary legal requirements are in full
compliance with the statutes of the State of Illinois and ordinances of the City of Canton, Illinois
and proper notice of the filing of the Petition for Special Use Permit was given as provided by
law; and

WHEREAS, a public hearing was held before the Planning and Zoning Commission of
the City of Canton, Illinois on October 11, 2010, pursuant to proper notice published in The
Daily Ledger, a secular newspaper having a general circulation in the City of Canton, County of
Fulton and State of Illinois; and
WHEREAS, on October 11, 2010, the Planning and Zoning Commission of the City of
Canton, Illinois recommended to the City Council of the City of Canton, Illinois that a special
use permit be granted to Andrea Puleo and Paraskeva, Inc. for multifamily dwelling use on the
second and third floors of the business buildings owned by Andrea Puelo and Paraskeva, Inc.
located at 39, 43, 47, 49 and 55 South Main Street, Canton, Illinois 61520 as follows:
a. Two apartments on the second floor and two apartments on the third floor of the
building located at 39 South Main Street, Canton, Illinois 61520;
b. Two apartments located on the second floor of the building located at 43 South Main
Street, Canton, Illinois 61520;
c. Two apartments located on the second floor of the building located at 47 South Main
Street, Canton, Illinois 61520;
d. Two apartments located on the top floor of the building located at 49 South Main
Street, Canton, Illinois 61520; and
e. Two apartments located on the second floor of the building located at 55 South Main
Street, Canton, Illinois 61520; and
WHEREAS, all of said apartments shall meet minimum code requirements and shall be
subject to inspection by the building inspector from time to time; and
WHEREAS, it is in the best interests of the City of Canton, Illinois that said special use
permit be granted.
NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY
OF CANTON, FULTON COUNTY, ILLINOIS, AS FOLLOWS:
1. That the City Council finds as facts the recitals hereinabove set forth.

2. That a special use permit be, and the same is hereby issued to Andrea Puleo and
Paraskeva, Inc. for multifamily dwelling use on the second and third floors of the business
buildings owned by Andrea Puleo and Paraskeva, Inc. located at 39, 43, 47, 49 and 55 South
Main Street, Canton, Illinois 61520, as follows:
a. Two apartments on the second floor and two apartments on the third floor of the
building located at 39 South Main Street, Canton, Illinois 61520;
b. Two apartments located on the second floor of the building located at 43 South Main
Street, Canton, Illinois 61520;
c. Two apartments located on the second floor of the building located at 47 South Main
Street, Canton, Illinois 61520;
d. Two apartments located on the top floor of the building located at 49 South Main
Street, Canton, Illinois 61520; and
e. Two apartments located on the second floor of the building located at 55 South Main
Street, Canton, Illinois 61520.
3. That all of said apartments shall meet minimum code requirements and shall be
subject to inspection by the building inspector from time to time.
4. That this special use permit shall be personal to Andrea Puleo and Paraskeva, Inc. at
the above stated addresses only. Any cessation of such use by Andrea Puleo and Paraskeva, Inc.
at said addresses shall automatically terminate this special use permit. This special use permit is
not transferable by Andrea Puleo or Paraskeva, Inc. and shall not be valid at any other addresses.
5. That the records of the City of Canton, Illinois, appropriate documents, maps and
related regulations be, and the same are hereby amended to reflect the foregoing special use
permit.
6. That this Ordinance shall be in full force and effect immediately upon its passage by
the City Council of the City of Canton, Illinois and approval by the Mayor thereof.

PASSED by a majority vote of the City Council of the City of Canton, Illinois, and
APPROVED by the Mayor thereof this 2"d day of November, 2010, upon a roll call vote as
follows:
