Edwards Way th 50 North 4 Avenue, Canton, Il 61520 A regular meeting of the Canton City Council was held on November 05, 2024 (6:30pm) at the th Historic Depot located at 50 North 4 Avenue Canton Illinois. STAFF IN ATTENDANCE: Mayor Kent McDowell, City Clerk Andi Smith-Walters, City Treasurer Crystal Wilkinson, Police Chief Mike Eveland, Fire Chief Scott Roos, Public Utilities Director Joe Carruthers. Maple Street, Canton, Illinois 61520 (P.I.N. #09-08-33- 205-022). ADDITIONS OR CORRECTIONS TO THE AGENDA: PUBLIC PARTICIPATION: th Stan Berry, a school bus driver, stated they have been having a lot of trouble with 16 Street and people not stopping at the intersection. Police Chief Mike Eveland suggested taking this matter to the school board. MAYORAL COMMUNICATIONS/REQUESTED ACTION: Mayor McDowell pointed out that four windows were busted out at the Depot, but with quick response from the PD and citizens, 3 juveniles were taken into custody at the ages of 10,11, and 12. Mayor commended Lieutenant Foreman and officers Richards and Twidwell. CITY CLERK COMMUNICATIONS /REQUESTED ACTION: DEPARTMENT HEAD COMMUNICATIONS/REPORTS: Police Chief Mike Eveland wanted to discuss the incident at the Depot as well. Eveland thanked the citizens who called the vandalism in and thanked the public for keeping an eye out. Eveland stated that the Trunk-or-Treat was another huge success. Thanks went out Carol Kohler for providing cones for traffic, Dash Wilson and his crews for the barricades they put into to place and council for approving the use of downtown to make this happen. Eveland announced nd Lieutenant Foreman and Demotts last day was November 2 and they are now retired. Fire Chief Scott Roos explained that each year around this time there is an increase in fires with people burning leaves. This can happen when fires are not watched or properly put out. Roos asked that residents be diligent. Street Superintendent Dash Wilson announced the leaf program is now in full swing. COMMITTEE REPORTS: PUBLIC SAFETY AND LEGAL ALDERPERSON JUSTIN NELSON, CHAIR DISCUSS AND CONSIDER AN ORDINANCE TO ESTABLISH PARAMETERS REGARDING THE OPERATION OF LOW-SPEED ELECTRIC AND GAS-POWERED BICYCLES. Attorney Chris Jump explained that he is working to put an ordinance together to help regulate these bikes. Under Illinois law, you can create an ordinance that regulates the use of these bikes on public roadways, which is the same statute the City operates under the usage of golf carts and UTVs. It is ultimately up to the council on how they would want to regulate these bicycles. Police Chief Mike Eveland stated there have been numerous complaints and the kids riding them aren’t safe on them. There are many approaches that can be taken such as having insurance, a driver’s license, and register them like you would with a UTV. Some of the council members would like to see these bikes have proper lighting and reflectors, as an added safety measure. Eveland believes that riding the bikes should be exclusive to an older group, potentially 13 and up and not worry so much about the licensing, but more so focus on having headlights, brakes, etc. on the bikes. As of right now, this is just a discussion and will not be voted on. REGULATORY AND POLICY ALDERPERSON ANGELA HALE, CHAIR APPROVAL OF A CLASS F SPECIAL EVENT LIQUOR LICENSE FOR OLD DOG, LLC FOR THE RED KETTLE KICKOFF TO BE HELD NOVEMBER 22. There was no discussion. Motion and second were made by Alderpersons Hale/Nelson to approve a Class F Special Event Liquor License for Old Dog, LLC for the Red Kettle Kickoff to be held November 22. COMMUNITY & ECONOMIC DEVELOPMENT ALDERPERSON JOHN LOVELL, CHAIR Alderman John Lovell had a few things he wanted to bring to the councils attentions. First, the TIF/BDD items will be voted on at the next meeting. Lovell has all of the applications if anyone would like to look over the documents and the resolutions are drafted up. Secondly, we are getting to that time of year where we start talking about the budget and he wants everyone to keep in mind that we could potentially start looking into an economic developer. Lastly, Lovell believes that bringing a national act event to the downtown could bring in a lot of people and revenue that would be good for the City. An example of an event would be something similar to an Octoberfest. TIF/BDD APPLICATIONS AND/OR AGREEEMENTS REGARDING ROBERT C. BOBELL FOR PROGRESSIVE VISION CENTER (42 N. MAIN STREET) This is for roof repairs. The total project cost is around $40,000 with a 25% reimbursement not to exceed $10,000. TIF/BDD APPLICATION AND/OR AGREEMENTS REGARDING TIM WELLS AND CARRIE WELLS FOR WORLD HUNTING GROUP (60 AND 64 E. ELM STREET) The total project cost is about $88,500 with a 25% reimbursement not to exceed $22,500. TIF/BDD APPLICATION AND/OR AGREEMENTS REGARDING ALLESSANDRA PULEO FOR PROPOSED LAUNDROMAT (39 S. MAIN STREET) This is for exterior and interior work. The total project cost is $22,500 with a 25% reimbursement not to exceed $6,000. TIF/BDD APPLICATION AND/OR AGREEMENTS REGARDING MARK ANDERSON AND TERRI ANDERSON FOR BREW N CUE (113 E. ELM STREET) Renovations are being made to the second floor. They are creating an event space, adding golfing simulators as well as an elevator. The total project cost is $280,802 with a 25% reimbursement not to exceed $70,000. PUBLIC WORKS ALDERPERSON ANGIE LINGENFELTER, CHAIR RESOLUTION APPROVING A PRE-ANNEXATION AGREEMENT BETWEEN THE CITY OF CANTON AND JESSICA AND KODY GRAVITT Common address is 695 West Maple Street with a P.I.N. of #09-08-33-205-022. This agreement is pertaining to a watermain. This was discussed during the Public Hearing. Motion and second were made by Alderpersons Lingenfelter/Nelson to approve a resolution approving a pre-annexation agreement between the City of Canton, and Jessica and Kody Gravitt. FINANCE ALDERPERSON ANDRA CHAMBERLIN, CHAIR DISCUSS AND CONSIDER THE USE OF ARPA FUNDS. City Attorney Chris Jump explained we are quickly approaching the end of the year. These funds need to be obligated by the end of the year. The funds don’t need to be budgeted, and an ordinance doesn’t need to be made stating how the money is going to be spent. There is a contractual obligation to spend these funds. The amount of ARPA funds is around $1.9 million after interest. Funds were supposed to go towards the new Public Works building, but project cost and estimates have gone up. Jump wants to know what the councils stance is and if they want to continue with this project. The initial cost estimate for this project was $2.5 million and it has now gone up to $4.2 million. These funds don’t necessarily have to go towards infrastructure but can also be used towards public safety. Mayor McDowell ultimately wants to know if the council wants move forward with the building or not. RESOLUTION OF SUPPORT FOR APPLYING TO THE STATE OF ILLINOIS FOR COMMUNITY DEVELOPMENT BLOCK GRANT – CORONAVIRUS GRANT. This is standard. Motion and second were made by Alderpersons Chamberlin/Grimm to approve a resolution of support for applying to the State of Illinois for Community Development Block Grant – Coronavirus Grant. ORDINANCE APPROVING THE MASTER SERVICES AND PURCHASING AGREEMENT AND QUOTE FROM AXON FOR CANTON POLICE DEPARTMENT TASERS IN THE AMOUNT OF $89,300.40 AND WAIVING COMPETIVE BIDDING IN RELATION TO SAME. This was included in the packet. Police Chief Mike Eveland explained the PD has always used tasers through Axon, and that this is not two separate things. The waiving of competitive bidding has to do with the integration of tasers that fit into the evidence.com. If an officer uses a taser, it activates the body worn camera which is helpful in the event the officer forgets to turn the camera on. The tasers are integrated with the cameras, which gives the officers more protection. The $89,300.40 is broken down into 6 payments through May of 2029. The first payment will be $14,882.40 and the rest will be $14,883.60. Motion and second were made by Alderpersons Chamberlin/Nelson to approve an ordinance approving the master services and purchasing agreement and quote from Axon for Canton Police Department tasers in the amount of up to $89,300.40 and waiving competitive bidding in relation to same. APPROVAL OF THE AMOUNTS OF MONEY, EXCLUSIVE OF ANY PORTION OF THE LEVY ATTRIBUTABLE TO THE COST OF CONDUCTING AN ELECTION REQUIRED BY THE GENERAL ELECTION LAW, ESTIMATED TO BE NECESSARY TO BE RAISED BY TAXATION UPON THE TAXABLE PROPERTY IN THE CITY OF CANTON’S TAXING DISTRICT. This is done yearly. Comptroller Beka Shultz sent out three different scenarios for the council to look over. Attorney Jump explained this is a statutory requirement that needs to be voted on and has to be done 20 days before the tax levy ordinance is adopted. This is a procedural step that is required to estimate the amount of taxes necessary. In December, the City will adopt the formal ordinance approving the tax levy. Motion and second were made by Alderpersons Chamberlin/Nelson for approval of the amounts of money, exclusive of any portion of the levy attributable to the cost of conducting an election required by the general election law, estimated to be necessary to be raised by taxation upon the taxable property in the City of Canton’s taxing district at the amount of $3,548,445 which is a 4% increase for $136,633. APPROVAL OF THE CANTON OPERA HOUSE PLAZA BID AWARD TO LEANDER IN THE AMOUNT OF $1,199,000.00. City Engineer Keith Plavec explained this was in the council packet. Andy from Farnsworth Group put together a bid analysis letter. Leander Construction bid $1,199,000 and Aupperle Construction had a bid of $1,258,678 with a $59,000 difference. Motion and second were made by Alderpersons Chamberlin/Grimm for approval of the Canton Opera House Plaza bid award to Leander in the amount of $1,199,000. ORDINANCE APPROVING PROPOSAL FROM AUPPERLE CONSTRUCTION IN THE AMOUNT OF $242,610.00 FOR CONCRETE COLUMNS AND SEATWALLS FOR THE CANTON OPERA HOUSE PLAZA AND WAIVING COMPETITIVE BIDDING REQUIREMENTS RELATED TO SAME. Plavec stated that is was recommended to obtain Aupperle Construction in the amount of $242,610. Motion and second were made by Alderpersons Chamberlin/Nelson to approve an ordinance approving proposal from Aupperle Construction in the amount of $242,610 for concrete columns and seatwalls for the Canton Opera House Plaza and waiving competitive bidding requirements related to same. This is for the iron arches that have been previously discussed. Motion and second were made by Alderpersons Chamberlin/Grimm to approve an ordinance approving proposal from Kelley Ironworks in the amount of $84,920 for ornamental arches and fencing for the Canton Opera House Plaza and waiving competitive bidding requirements related to same. Plavec stated this one should waive competitive bidding, which Attorney Jump concurred that was put in the original ordinance. This item is a little more critical as it has a longer wait time explained Plavec. This is the shelter itself that will get shipped here and installed. Motion and second were made by Alderpersons Chamberlin/Nelson to approve an ordinance approving proposal from RCP Shelters/Play Illinois in the amount of $204,928.83 and waiving any competitive bidding related to same. ORDINANCE APPROVING THE PURCHASE OF A 2025 FORD EXPLORER FOR THE FIRE DEPARTMENT AND WAIVING COMPETITIVE BIDDING REQUIREMENTS RELATED TO SAME. Fire Chief Scott Roos stated this would replace his current vehicle (Car 1) at the fire department. The current vehicle that Roos drives is a 2012 that was passed down from the police department and has about 165,000 miles on it. The new vehicle being looked at is a 2025 ford explorer which is similar to what the police department has. Roos expects to get 15 years out of the new vehicle. Motion and second were made by Alderpersons Chamberlin/Hale to approve an ordinance approving the purchase of a 2025 Ford Explorer for the fire department and waiving competitive bidding requirements related to same in the amount of $50,997.
