AN ORDINANCE REZONING PROPERTY ON CHESTNUT STREET FROM AN R-4
ZONING CLASSIFICATION TO A B-2 ZONING CLASSIFICATION, CONTINGENT UPON
THE PROPERTY BEING PURCHASED BY TED J. RUMLER
WHEREAS, Ted J. Rumler filed a petition with the City Clerk for the re-zoning of the real
property described below, said property being within the corporate limits of the City of Canton,
Illinois; and
WHEREAS, Ted J. Rumler intends to purchase the real property described below from Grace
Lutheran Church; and
WHEREAS, the current zoning classification of the property is R-4 and it is the purchaser's
intent for the property to change to a B-2 zoning classification; and
WHEREAS, after proper notice, a public hearing on said Petition was conducted by the
Planning and Zoning Commission of the City of Canton on August 9, 2010; and
WHEREAS, on August 9, 2010, the Planning and Zoning Commission recommended to the
City Council that the real property described below be rezoned pursuant to 65 ILCS 5/11-13-1 et. seq.
WHEREAS, it is in the best interest of the City of Canton, Illinois that said property be
rezoned within the City of Canton, to meet future business growth and fit within the City's
comprehensive plan.
NOW THEREFORE, BE IT ORDAINED by the City Council of the City of Canton, Illinois, as
follows:
1. That the Canton City Council hereby finds as facts the assertions set forth above.
2. That the described real property be and is hereby rezoned from R-4 to B-2 as follows:
TRACT 1: Lots numbered 1, 2, 3 and 4, all in Sebree Subdivision, a subdivision of a part
of the Southeast Quarter of Section 25, in Township 25, in Township 7 North,
Range 4 East of the Fourth Principal Meridian, Fulton County, Illinois, as per
the plat of subdivision filed March 12, 1968 in Plat Book 5, Page 19, as
Document No. 68-8923 of the land Records of Fulton County, Illinois; all
situation in the City of Canton, Fulton County, Illinois.
TRACT 2: A part of the Southeast Quarter of Section 25, Township 7 North, Range 4 East
of the Fourth Principal Meridian, Fulton County, Illinois, more particularly
described as follow:
Beginning at the Northwest corner of Lot 1 of Sebree Subdivision, a subdivision
of a part of the Southeast Quarter of Section 25, Town and Range aforesaid, and
running thence Easterly along the North line of said subdivision a distance of
418.5 feet to the Northeast corner of Lot 4 of said subdivision, thence North
474.5 feet, thence West 418.5 feet, thence South 474.5 feet to the place of
beginning; all situation in the City of Canton, Fulton County, Illinois.

3. That Ted J. Rumler will produce a deed and/or closing documents confirming that he purchased
the property within ninety (90) days of the date of this Ordinance.
4. That Ted J. Rumler, will pay to the City of Canton, the fees required to file a certified copy of
this Ordinance with the Fulton County Clerk and Recorder of Deeds, no later than ninety (90)
days from the date of this Ordinance.
5. Upon proof of ownership and the filing of a certified copy of this Ordinance, the Zoning
Administrator is directed to make the appropriate map amendments to the City of Canton to
reflect said re-zoning.
6. That this Ordinance shall be in full force and effect upon its passage by the City Council of the
City of Canton and approval by its Mayor.
PASSED by the City Council of the City of Canton, Illinois and approved by the Mayor thereof this
