ORDINANCE NO. 1755
AN ORDINANCE FOR THE SALE & LEASE BACK AND ACCESS EASEMENT
BETWEEN THE CITY OF CANTON AND CENTRAL ILLINOIS PUBLIC
SERVICE COMPANY dba/AMEREN CIPS FOR A PORTION OF CITY
STORAGE AREA AT THE CITY GARAGE
WHEREAS, the City of Canton owns real estate located 520 W. Locust Street.
WHEREAS, located on that site was a Coal Carbonization gas production; and,
WHEREAS, Central Illinois Public Service Company dba/Ameren CIPS intends
to remediate the environmental conditions created by those facilities said remediation
shall be conducted under the over site of the Illinois Environmental Protection Agency
(IEPA); and,
WHEREAS, the City of Canton and Central Illinois Public Service Company
dba/Ameren CIPS agree that the cost of remediation of the property exceeds the value of
the property by ten (10) times; and,
WHEREAS, buyer to conduct such remediation desires to take ownership of
property; and,
WHEREAS, the City of Canton could potentially be responsible for the cost of
remediation; and,
NOW, THEREFORE, BE IT ORDAINED, by the City Council and the City of
Canton, Fulton County, Illinois:
1. The City of Canton agrees to sell to Central Illinois Public Service Company
dba/Ameren CIPS the property legally described on the attached exhibit for the
sum of ten dollars ($10.00).
2. The City of Canton is authorized to enter into an agreement to lease the property
to for a period of 20 years with the option for five (5) additional five (5) year
terms for the sum of ten dollars ($10.00).
3. That the Mayor of the City of Canton is hereby authorized to enter into a contract
for the sale of property, lease agreement and access easement. Copies of sale,
lease and access easement are attached.
4. That this Ordinance shall be in full force and effect immediately upon its passage
by the City Council of the City of Canton, Fulton County, Illinois, and approval
by the Mayor thereof.
PASSED by the City Council of the City of Canton, Fulton County, Illinois at a regular
meeting this 3rd day of June , 2003, upon a roll call vote as follows:
AYES: Aldermen Hartford, Molleck, West, Sarff, Hain, Carl, Fillin~.iar!i,
& Reed.
