ORDINANCE NO. 1820
AN ORDINANCE ANNEXING AND RE-ZONING CERTAIN TERRITORY TO
THE CITY OF CANTON, FULTON COUNTY, ILLINOIS BELONGING TO
KENNETH & DIXIE WALDROP AND LOCATED AT 18 MARLEE DRIVE,
CANTON, ILLINOIS.
WHEREAS, a Petition for Annexation and Re-Zoning, signed by the owner of
record of the territory hereinafter described, was filed before the Planning and Zoning
Commission of the City of Canton, Illinois, requesting said territory be annexed to the
City of Canton and re-zoned to an R-2 (Single Family Residential District) zoning
classification; and
WHEREAS, the territory which is the subject of this Petition is described below:
A part of the North %i Section 15, Township 7 North, Range 4 East of the 4th Principal
Meridian in Baz Mac Subdivision, situated in the County of Fulton, and in the State of
Illinois. (a Map showing the property is attached as Exhibit A).
WHEREAS, Kenneth & Dixie Waldrop is the owners of record of the territory to
be annexed and re-zoned and there are no other owners of record and there aze no electors
residing within the said territory to be annexed and re-zoned other than, Kenneth & Dixie
Waldrop; and
WHEREAS, the territory to be annexed and re-rezoned is part of the Copperas
Creek Community Fire Protection District; and
WHEREAS, proper notice of the Petition for Annexation and Re-Zoning has
been given to the trustees of the Copperas Creek Community Fire Protection District as
provided by law and an affidavit that service of notice has been made as provided by law
has been filed with the Fulton County Recorder of Deeds; and
WHEREAS, all petitions, documents and other necessary legal requirements are
in full compliance with the Statues of the State of Illinois and the ordinances of the City
of Canton, Illinois and proper notice of the filing of the Petition for Annexation and Re-
Zoning was given as provided by law; and
WHEREAS, a public heazing was held before the Planning and Zoning
Commission of the City of Canton, Illinois, on October 11, 2004, pursuant to proper
notice published in the Canton Daily Ledger, a seculaz newspaper having a general
circulation in the City of Canton, County of Fulton and State of Illinois; and
WHEREAS, on October 11, 2004, the Planning and Zoning Commission of the
City of Canton, Illinois, recommended to the City Council of the City of Canton, Illinois
that the territory described above be annexed to the City of Canton, Illinois in a zoning
classification of R-2 (Single Family Residential District), pursuant to the provisions of 65
ILCS 5/7-1-8 of the Illinois Municipal Code; and
WHEREAS, the highest and best use of the territory to be annexed and re-zoned
is its use as a single family residential purposes; and
WHEREAS, it is in the best interest of the City of Canton, Illinois that said
territory be annexed to the City of Canton, Illinois, in an R-2 (Single Family Residential
District), zoning classification.
NOW THEREFORE, BE IT ORDAINED by the City Council of the City of
Canton, Illinois, as follows:
1. That the City Council fords as facts the recitals hereinabove set forth.
2. That the territory described as above be and it is hereby annexed to the City of
Canton, Illinois.
3. That the described real property be and it is hereby zoned R-2, single family
residential.
4. That the Zoning Administrator is directed to make the appropriate changes to
the zoning maps of the City of Canton to show this annexation and zoning.
5. That Kenneth & Dixie Waldrop is hereby granted to record with the Recorder
of Deeds of Fulton County, Illinois, and to file with the County Clerk of
Fulton County, Illinois, a certified coy of this Ordinance together with an
accurate map of the territory annexed.
6. That this Ordinance shall be in full force and effect upon its passage by the
City Council of the City of Canton, Illinois, and approved by its Mayor
thereof.
PASSED by a majority vote of the City Council of the City of Canton, Illinois, and
APPROVED by the Mayor thereof this 2nd ~,y of November , 2004, upon a
roll call vote as follows:
AYES: Al dennen West, Reed, Hartford, Carl, Molleck, Filling-
ham, Sarff.
NAYS: None.
ABSENT: Alderman Ha rn .
