HomeMy WebLinkAbout09-16-2003 CouncilA regular meeting of the Canton City Council was held on September 16th, 2003 in the Council Chambers at the Historic Depot, 50 North 4th Avenue, Canton, Illinois. PLEDGE OF ALLEGIANCE OPENED THE MEETING FOLLOWED BY THE INVOCATION GIVEN BY NANCY WHITES CITY CLERK. Mayor Bohler asked for roll call at 6:30 p.m. Present -Aldermen Jim Hartford, Bob Molleck Craig West, Larry Sarff, Elny Harn, Les Carl, Mary Fillingham, & Rick Reed. Absent -None. MINUTES OF SEPTEMBER 2ND, 2003 MEETING. Motion and second by Aldermen Molleck/Hartford, the minutes of September 2°d, 2003 be accepted and placed on file. Voice vote, motion carried unanimously. BILLS FOR AUGUST. Motion and second by Aldermen West/Fillingham, all bills properly presented for payment be paid. Roll call. AYES -Aldermen Reed, Fillingham, Carl, Harn, Sarff, West, Molleck, Hartford. NAYS -None. 8 AYES, 0 NAYS, 0 ABSENT. Motion carried. COMMITTEE REPORTS. Finance. Council Action Motion and second by Aldermen Carl,Fillingham, to approve the purchase of a replacement electric pump for the hydraulic extrication tools and using the funds of $1,056.44 ftom the Rescue Funds. (The funds are part of the matching funds needed in the event the grant application is awarded.) Roll call. AYES -Aldermen Hartford, Molleck, West, Sarff, Harn, Carl, Fillingham, Reed. Motion and second by Aldermen CarUMolleck, to award the low bid for the demolition of 4 buildings on the Northeast Corner of IH to Environmental Operations, Inc. in the amount of $98,500 and an additional amount of $2,000 for asbestos removal for Change Order #1. Roll call. AYES -Aldermen Reed, Fillingham, Carl, Harn, Sarff, West, Molleck, Hartford. NAYS -None. 8 AYES, 0 NAYS, 0 ABSENT. Motion carried. Motion and second by Aldermen Carl/Fillingham, to award the low bid for the Asbestos Abatement of the 4 buildings on the Northeast corner of IH to Air Care, Inc. in the amount of $16,268.85. Roll call. AYES -Aldermen Hartford, Molleck, West, Sarff, Harn, Carl, Fillingham, Reed. NAYS -None. 8 AYES, 0 NAYS, 0 ABSENT. Motion carried. Legal & Ordinance. Council Action None. City Council meeting 9-16-03 instead of lifting the resolution. (As we passed this resolution because of finances.) And until we get a better look at what our finances aze. The intent of the Resolution was to have no new hires. Instead of having the city attorney amend the resolution, as the resolution is not intended for replacements, amend the resolution for only new hires not for replacements. Alderman Molleck said he would not vote to lift the hiring freeze at this time. We are only 4 1/Z months into the fiscal year. I'm not satisfied where we are going to stand 6 months later. It has always worked well to have all new hires name brought before the Council to vote on. Motion and second by Alderman Sarff/West, amend the motion to continue the hiring freeze for any new positions, but not for replacement positions. Discussion. City Attorney Ron Weber ask Alderman Sarff, is this the direction, to draft this, or aze you actually implementing exactly this? Alderman Sarff answered, we don't have a resolution before us tonight, will have to draft one, and will have to set aside the resolution for other appointments. Roll call. (The Resolution Title is...A Resolution Imposing a Freeze on Hiring, Promotions, and Purchases of Non-Emergency Capital Equipment for the City of Canton, Illinois. The Resolution is #3647 and was passed by Council on Mazch 4, 2003.) Motion and second by Aldermen Sazff/Reed, to set aside the hiring freeze for the purpose of filling a vacancy in the fire department. Voice vote, motion carried unanimously. Motion and second by Aldermen Sarff/Molleck, the committee recommends hiring the temporazy fire fighter to a full-time position to replace fire fighter who resigned, and the City Council meting temporary position left vacant by this appointment be filled with the next name on the availability list. Discussion. Fire Chief John Stanko said there is a clarification. The temporary appointment will be the next one on the list, but he is not currently serving as a temporary appointment. Roll call. The Eastview School was nominated for `No Child Left Behind' in the summer and competed against 16 schools, and now they have won the Blue Ribbon award. Mayor Bohler congratulated the Eastview School and Superintendent Ralph Grimm for receiving this prestige awazd. The 13`" annual John Keets March will be this Saturday September 20th at Lakeland Park beginning at 12 noon. (False Alarms, Animal License, Redemption of Impounded Animal, Camping Fees at Canton Lake.) Second reading, read by title. Motion and second by Aldermen Hartford/Harn, the ordinance be placed on its passage. AYES -Aldermen Hartford, Molleck, Sarff, Harn, Carl, Fillingham, Reed. NAYS -Aldermen West. 7 AYES, 1 NAY, 0 ABSENT. Motion carried. Ordinance being #1768. ORDINANCE -AMENDING LICENSE FEES AND PERMIT FEES FOR THE CITY OF CANTON, ILLINOIS. (Secondhand Dealer, Bartender License, Taxicabs, Garbage Haulers, Fences, Walls Barriers and other Obstructions.) Second reading, read by title. Motion and second by Aldermen Caxl/Molleck, the ordinance be placed on its passage. Roll call. AYES -Aldermen Reed, Fillingham, Carl, Harn, Sarff, West, Molleck, Hartford. NAYS -None. 8 AYES, 0 NAYS, 0 ABSENT. Motion carried. Ordinance being # 1769. ORDINANCE - AMENDING SECTION 3-3-14 AMUSEMENTS - COIN OPERATED AMUSEMENT MACHINES IN THE CITY OF CANTON. Second reading, read by title. Motion and second by Aldermen Molleck/West, the ordinance be placed on its passage. Roll call. AYES -Aldermen Hartford, Molleck, West, Sarff, Harn, Carl, Fillingham, Reed. NAYS -None. 8 AYES, 0 NAYS, 0 ABSENT. Motion carried. Ordinance being #1770. ORDINANCE -AMENDING SECTION 3-8-8 INTOXICATING LIQUORS - LICENSE FEES FOR THE CITY OF CANTON. (License fees for Liquor Licenses.) Second reading, read by title. Mayor Bohler said that at the committee meeting 9-9-03 a 2 to 2 tie vote to increase the License fee by 20%. Mayor Bohler then voted aye to break the tie so the ordinance would go to council with a recommendation. Alderman Sarff had questioned the validity of the mayor voting. Since that meeting Mayor Bohler said he called the Illinois Municipal League and reviewed the City ordinances that allows the mayor to vote on tie votes, and the mayor is a member of the committee. The Liquor License Ordinance presented here has a 3 to 2 vote in favor of a one time 20% increase across the board for Intoxicating Liquor License. Mayor Bohler then gave the following information...in the mayor's absent from committee, the ordinance does not go to council without recommendation, the only time an ordinance without recommendation can be referred to council is when it is sent there by the council. Alderman Sarff said times are not good for small business's, and he said he agreed that it has been sometime since fees were increased, but feels it won't be a great impact on the City's Budget to increase these fees. ORDINANCE -ESTABLISHING FEES FOR THE CITY OF CANTON. (Board City Council meeting 9-16-03 Reed/Fillingham, the ordinance be placed on its passage. Roll call. AYES -Reed, Fillingham, Carl, Harn, Sarff, West, Molleck, Hartford. NAYS -None. 8 AYES, 0 NAYS, 0 ABSENT. Motion carried. Ordinance being #1773. NEW BUSINESS: ORDINANCE -RESCINDING TITLE 3, CHAPTER 2, SECTION 8, AND; TITLE 3, CHAPTER 4, SECTION 4, OF THE CANTON MUNICIPAL CODE. (Auctioneers, and Antique Dealers.) First reading, read by title. ORDINANCE -AMENDING TITLE 1, CHAPTER 8, SECTION 7, OF THE CANTON MUNICIPAL CODE REGARDING BUDGET ADMINISTRATOR. First reading, read by title. Mayor Bohler recognized Alderman Elny Harn's cousin Bill Randolph from Deadwood South Dakota who was in the audience, and welcomed him for attending. ADJOURNMENT.
