Other Aldermen Present: Jim Hartford, Bob Molleck, Elny Harn & Rick Reed. Others Present: Mayor Jerry Bohler, City Clerk Nancy Whites, City Attorney Ron Weber, Fire Chief John Stanko, Police Chief Don Edwazds, Public Works Director Cli O'Brien, Wastewater Supt. Joe Carruthers, Water Plant Supt. Greg Pollitt, Zoning Officer Clark Wilson, Street Superintendent George Spahn. Video Services Joe Ginger. News Media - Daily Ledger -John Froehlmg & Journal Star rep Mike Noye. Others in attendance - Business owners. Finance Committee Les Carl, Chairman Bills. Motion and second by Aldermen West/Fillingham, all bills properly approved be referred to council for payment. Discussion. Mayor Bohler mentioned that Mutual Wheel from System Maintenance in the amount of $382.41 to hold off paying at this time. Voice vote, motion cazried unanimously. Treasurer's Report. Patty Beaird Franzoni gave out her report on Friday. She is ill tonight. Motion and second by Aldermen Sarff/Fillingham, to place the report on file. Voice vote, motion carried unanimously. Request to Commit Use of Rescue Funds. Fire Chief John Stanko mentioned he is in the process of applying for a grant to purchase a replacement electric pump for the hydraulic extrication tools. The grant requires a 50% matching component. This would be a total match of $2,769.75. The Rescue Fund has a balance of $1,056.44. John wants to use these funds as part of the matching funds needed in the event the grant application is approved. Motion and second by Aldermen Sarff/Fillingham, to approve of the use of the Rescue Funds for the replacement of electric pump, and send to council for their approval. Voice vote, motion carried unanimously. Notice of Award IH Northeast Corner Demolition. Colin Edwazds of Maurer Stutz Inc. reviewed the bids on the demolition of 4 buildings on the Northeast Corner of IH and also the bids for the removal of asbestos in those four buildings. Colin recommended accepting the low bid of Environmental Operations, Inc., Peoria, Illinois for the demolition in the amount of $98,500 and an additional $2,000 cost since some confusion appazently existed as to whether this "asbestos removal" item was covered by the demolition project. Colin Edwards from Maurer Stutz Inc. is recommending the additional $2000 cost be handled as Change Order #1. The asbestos abatement low bid was from Air Care, Inc., Bartonville, in the amount of $16,268.85. Colin Edwards commented that both bids are contingent upon the review and comment of the bid by the Clerical Committee meeting 9-9-03 City Attorney Ron Weber. Both bids look like a good bid. There was no engineer's estimate, as Colin said he was not qualified and no one in the firm felt they were qualified, when asked by Alderman Sazff if there was an engineer's estimate. Motion and second by Aldermen Sazff/West, to send to council for their approval the low bid for demolition of the 4 buildings at IH Northeast corner in the amount of $98,500 and an additional Change Order # 1 from Environmental Operations, Inc. pf $2,000; and low bid of Air Caze, Inc in the amount of $16,268.85 for the removal of asbestos, contingent upon review by City Attorney Ron Weber. Voice vote, motion carried unanimously. (Five bids were received for demolition and 5 bids received for asbestos removal.) Legal & Ordinance Committee Mary Fillingham, Chairman Ordinances Amending Fees and Permit increases. Mayor Bohler allowed for those business people calling in to make their comments. Mayor Bohler ask each of them to be brief and professional. At the end of the public speaking the committee will be ask to discuss each of the ordinances relating to Fees and Permits. The only members voting will be the committee members of Aldermen West, Sarff, Cazl, Fillingham. Speaking on the Amendment of Fees and Permit Increasese - Lloyd Klindworth, retired. He feels when the City raises fees it hurts the senior citizens. And your secondhand dealer license should apply to yazd sales. They should have to pay $10 to $15 per week. Make your chazge of fees on the amusement machines, not the businesses. Jerry Padowan, owns Linn Lanes Bowling Alley at 635 East Linn. After looking over your suggestions, you are only going after the little of the littlest. I don't see Wal-Mart, K-Mart & Hy Vee being charged. All should pay to help the city's financial problems, not just us. When I think I'm getting burned I don't like it. Billy Jump, owns Official Time Out at 68 East Elm. If I have to raise my prices, I will hurt the elderly person who comes into my establishment. I pay sales tax, and a state liquor license, that's my decision to be in business. I spend $10,000 on liability and dram shop insurance. The State liquor license just went to $500. I have to spend $13,000 just to turn the power on. I don't mind a small fee increase. If you want your deficient erased, we need to look at the whole picture. Dale Brooks, owns D & D Drive Thru at 750 S. 5th. Thanks for allowing us to speak tonight. I don't believe the increase should be 18%. We will force those who use our establishments to drive out of town. Hope you will look at this and come up with another solution. Lloyd Henderson. Lloyd said he was not here to represent any organization nor any vendors. My dealing is with the gaming machines. For the pass 13 years I have been 2 Clerical Committee 9-9-03 working to get a state license. He said he commends Canton for taxing the machines not thru the phone lines. There are still 67,000 of them out there. The State has been taxing the machine and owners for years. I will still try to get the State to legalize them. George Fulton, owns amusement machine business. I'm now paying $1,489.00 to the City for my machines. I'm sure the State will raise their fees to $200.00. I can't live with the increases you are presenting by these ordinances. I can't sleep nights worrying about this. Jane Williams, owns Antiques & More at 250 North 16`". I am not against the $15 fee going to $50.00. Why should I pay for my business and others do not? If I pay, they should pay. Pastor Greg Ogle, he did not show. Mayor Bohler asked if anyone else wanted to speak. Elm Street Cafe owner, Bruce Nell not in favor of the fees, should look at a sales tax increase, as everyone pays. Mayor Bohler then closed the session to the public at 7:00 p.m. Alderman Fillingham asked if any Council member wanted to make comments. Alderman Sarff stated that we have several ordinances that make up a package, should we review each one, or take as a package? City Attorney Ron Weber commented to take each ordinance, otherwise gets mixed up. Alderman Fillingham and Carl served on the Committee for the License fee and permits. They reviewed what was presently on the books. Alderman Carl mentioned that each department head handles different fees and permits and the committee asked them for their input of what their cost are, with the exception of the Liquor License and Amusement Tax. Alderman Sarff said this has been brought out for the purpose of increases to make more money for the city. I'm not opposed to making some increases, but not 50%! Alderman Carl had asked Don Edwards, Police Chief to do some research on alcohol usesage. Don Edwards said we don't track how many are alcohol related. In 2002 9% of traffic citations were alcohol related. At the State level, 40% of those killed, were alcohol related. Most of our calls are domestic services. Alderman Molleck said we are not going after prohibition here. This information told us nothing. The tavern owners are responsible people. Alderman Molleck said he was pleased that none of them got out of line. Mayor Bohler said the committee did a very good job. This is not a poplar job. The committee met with the department heads to bring the fees up to break even for our work. Clerical Committee meeting 9-9-03 It's a tough decision. Property tax is the only thing left, and this is an unfair tax. Our def cit is not $700,000 as someone had said. Alderman Carl mentioned that the increase was 20%. Alderman West asked if the increase was for each year? Alderman Carl said the committee would review each year. City Attorney Ron Weber mentioned that the council can leave in place the increase each year, and they have a right to review each year, but you don't bind a new council. The purpose of the increases was because it was indicated the license were substantial low, and the committee was sympathy to the businessman. Alderman Hartford said he wanted the wording left in the ordinance `to be reviewed each year', because he feels won't be reviewed otherwise. Alderman Reed stated this is a great place to live, work and play. I think we are doing this wrong. We should look at each of them individually. Mayor Bohler said we reviewed our fees with the City of Macomb. Ordinances being reviewed... Amending Section 3-8-8 Intoxicating Liquors -License Fee for the City of Canton. In this ordinance is just the Intoxicating Liquors. Alderman Sarff recommended changes to the Class A Tavern, Class B Supper Club and Class C Restaurant, Beer & Wine be increased to $50.00 per year, and Class D Club License increased to $40.00 per year, with a $25 per year increase. The Special Event license would remain the same of what has been presented for increase of $100 plus $10 for each day used. Then we would not have to look at them for 3 or 4 years. Alderman West said this is close to what he recommended of 10% increase with annual review. Motion and second by Aldermen Sarff, the proposal as he presented be amended. Dies for lack of second. Motion and second by Alderman CarUFillingham, to accept the recommendation of 20% increase and review annually. Discussion. Alderman Carl felt this was not a great increase. Voice vote. 2 ayes, 2 nays. Mayor Bohler then voted aye so this could go to council with recommendations. Alderman 5ari~ questioned the vote by the mayor, since he was not a member of the committee. Mayor Bohler apologized and said that Alderman Sarffwas correct. Motion defeated. Ordinance Creating Section 3-3-14.1 Amusements -Video Gaming Machines in the City of Canton. In this ordinance is just Video Gaming. 4 Clerical Committee meeting 9-9-03 Motion and second by Aldermen CarUWest, to amend the ordinance of the fee of $100 license to $50.00, and to remove the requirement of owner of the amusement machines to pay a fee. Voice vote, motion carried unanimously. Ordinance Amending License Fees and Permit Fees for the City of Canton. In this ordinance is Secondhand Dealer; Antique Dealers; Auctioneers; Bartenders License; Taxicabs; Garbage Haulers; Fences, Walls, Barriers and othe Obstructions. Alderman Sarff asked the Police Chief Don Edwards for comment on Secondhand Dealer and Bartenders. Don Edwards commented that we have the right to inspect the merchandise in a secondhand store. The Bartender license gives the mechanism to do a back ground check to safe guard the public. The back ground check due to the way the State regulates us internally cost the city $38.00. Fingerprints are taking for secondhand dealer and also bartenders and taxi cab drivers. Motion and second by Aldermen Sarff/West, to remove from this ordinance Antique Dealers and Auctioneers. Voice vote, motion carried unanimously. Ordinance Amending Fees For The City of Canton, Illinois. In this ordinance is listed Fire Department -False Alarms; Animal License; Redemption of Impounded Animal; Camping Fees at Canton Lake. Discussion. Alderman Reed wants the fees stricken from the Camping Fees at the Canton Lake as they were raised last year, and we are just now getting the camper coming back, and would like to see reviewed next year. Motion and second by Alderman West/ to take out the increase in fees for Camping Fees at the Canton Lake. Dies for lack of second. Alderman Carl stated that the recommendation to increase the fees came from Greg Pollitt Superintendent of Water Treatment Plant. Fire Chief John Stanko commented that in the current ordinance of False Alarms it allows the police department to charge for false alarms. Seems to be deleted from this revised ordinance. We want to encourage keeping fire and burglary alarms in the ordinance, as I'm afraid the owners will not keep in good working order if you exempt. City Attorney Ron Weber to check on the number of false alarms for fire and burglary. Ordinance Establishing Fees for the City of Canton. In this ordinance is listed as Board of Fire and Police Commissioners; Streets, Sidewalks and Public Grounds. Zoning Officer Clark Wilson said we have under this section garage permits, curb cuts, etc. You will have people going to three different places to get their permits. Section 8-4-32 Private Driveway Permit will be reviewed by City Attorney Ron Weber. Motion and second by Aldermen CarUWest, to send the Ordinance Amending Section 3- 3-14 Amusements -Coin-Operated Amusement Machines in the City of Canton to the city council as presented. Voice vote, motion carried unanimously. Hotel/Motel Taz. Mayor Bohler asked the committee members and also the other 4 aldermen who were present if they wanted to discuss the ordinance, or, if they had any questions about it? At the council meeting on September 2 the ordinance was referred to 5 Clerical Committee meeting 9-9-03 this committee for discussion. There was no discussion of the Ordinance by the Aldermen. Motion and second by Aldermen CarUWest, to send the ordinance to the City Council meeting of September 16. Voice vote, motion carried unanimously. Ordinance Amending Budget Administrator Position. Mayor Bohler said this ordinance does not allow the hiring of a Budget Administrator, the ordinance allows for the hiring of a full-time employee. Motion and second by Aldermen CarUWest, to send the ordinance to the September 16th meeting of Council for approval. Voice vote, motion carried unanimously. Community & Industrial Development Committee Craig West, Chairman Update of Activities. Alderman West commented that the Fulton County Tourism have place mats. If want to sponsor a calendaz for 2004 for upcoming events, will be going to the publisher real soon. The Heritage Committee is displaying antique P & O Band items from the collection of Anita Heaton at the Mid America National Bank's main branch and at City Hall. Also the Heritage Committee along with Spoon River College aze sponsoring a free concert at SRC's Drama Theater at Noon on October 16th. They aze bringing back to Canton famous song writer, singer and guitarist, Cat Catalani who appeazed last year at the Historic Depot. The John Keets Mazch will be held September 20th beginning at Noon at Lakeland Pazk. Congratulations to a new business just opening at 25 White Court. It's called the Mind and Body Shop and will offer beverages, books and several specialty items. Memorial ceremonies will be held at the Army Reserve Center in Canton at 8:30 a.m. September 11th, in remembrance of the attack on the Pentagon that occurred two yeazs ago. The public is invited to attend. Maurer Stutz Inc. will have a public open house of their new facility which they built in Canton. It will be held on Wednesday, September 17th from 4 to 7 p.m. It is located at 1670 East Ash Street. The new TIF project is still on schedule. Mayor Bohler invited the Aldermen to ride on the 40&8 train this Saturday during the Friendship Festival Pazade. Meet at the Elks Club pazking lot. 6 Clerical Committee meeting 9-9-03 Negotiations, Grievance & Personnel Larry Sarff, Chairman Request to fill Vacancy in Fire Department. Fire Chief John Stanko reported that effective September 6, 2003 Fire Fighter Randy Williams resigned from the Canton Fire Department to pursue other interests. John is currently asking the Fire and Police Commission to fill this vacancy. And in addition, asking for permission for the next candidate on the eligibility list to serve as a temporary appointment while he is going through the hiring process. The temporazy appointment would begin on October 7, 2003. This would minimize any potential overtime. Motion and second by Aldermen Sazff/Fillingham, to lift the Hiring Freeze that was implemented on Mazch 3, 2003 by Resolution #3647, and to approve of the temporary appointment of a replacement for Randall Williams who resigned, and send to council for their approval. Voice vote, motion carried unanimously.
