AN ORDINANCE PROVIDING FOR ONE HANDICAP PARKING SPACE IN THE ALLEY
RUNNING EAST-WEST FROM MAIN STREET TO WHITE COURT, SOUTH OF 2 EAST
ELM STREET (LEGACY CHRISTIAN BOOK STORE) AND NORTH OF 23 SOUTH MAIN
STREET (COUNTRY FINANCIAL), IN THE CITY OF CANTON, FULTON COUNTY,
ILLINOIS
WHEREAS, at the request of the Public Safety committee, the Canton Police Department
examined the necessity for adding a handicap park space in the 00 block of South Main Street; and
WHEREAS, after investigation, the Canton Police Department recommended that the best
location for an additional handicap parking stall would be in the alley running east-west from Main
Street to White Court, north of the 2 East Elm Street (Legacy Christian Bookstore) and North of 23
South Main Street (Country Financial); and
WHEREAS, the Legal and Ordinance Committee has determined that it is necessary and in the
best interest of the citizens of Canton, Illinois to place one handicap parking sign in the first parking
spot in the alley referenced above as it would allow for the full 96" width handicap parking stall
required by the ADA and remove the 2-hour time limit parking restriction that applies the downtown
area; and
WHEREAS, the City Council has made a similar determination.
NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF
CANTON, Fulton County, Illinois, as follows:
1. That one (1) Handicap Parking sign shall be placed in the spot nearest Main Street in the alley
running east-west from Main Street to White Court, south of 2 East Elm Street (Legacy
Christian Bookstore) and North of 23 South Main Street (Country Financial); and that every
driver of a motor vehicle will refrain from parking any vehicle under his or her control in said
area unless it displays the proper registration plates or decals issued to a personal with
disabilities, as defined by Sections 1-159.1, pursuant to Sections 3-616, 11-1301.0 or 11-1301.2
or to a disabled veteran pursuant to Section 3-609 of the Illinois Vehicle Code (625 ILCS 5/11
et. seq. ).
2. Any Person who violates this Ordinance shall, upon conviction or plea, be subject to a
fine of not less than two hundred fifty dollars ($250.00) nor more than three hundred
fifty dollars ($350.00) for each offense pursuant to 625 ILCS 5/11-1301.3(c).
3. That this Ordinance shall be in full force and effect ten (10) days after its passage by the City
Council of the City of Canton, Fulton County, Illinois, approval by .the Mayor thereof, and
publication in pamphlet form as provided by law.
