AN ORDINANCE GRANTING A SPECIAL USE PERMIT TO ALLOW
MULTI-FAMILY DWELLINGS ON 2nd FLOOR of the COMMERCIAL
BUILDING LOCATED AT 15 and 1.51/2 White Court
WHEREAS, it appears to the City Council of the City of Canton, Fulton
County, Illinois, that the territory hereinafter described is located within the
corporate limits of the City of Canton; and,
WHEREAS, a petition was filed by Jane Lewis and Cinda Rosenberger,
prospective purchasers of the property, to the Planning & Zoning Commission of
said City requesting a special use; and,
WHEREAS, no objectors appeared at said hearing and said commission did
thereupon make favorable findings of fact and did recommend to the Canton City
Council that said special use to allow multi-family dwellings on 2nd floor of the
commercial building located at 15 and 1 S '/2 White Court, Canton, Illinois.
NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL
OF THE CITY OF CANTON, FULTON COUNTY, ILLINOIS AS
FOLLOWS:
1. That the City Council of the City of Canton, Fulton County,
Illinois, hereby finds the foregoing recitals to be fact.
2. That special use to allow multi-family dwellings on 2nd floor of
the commercial building located at 15 and 15 '/2 White Court, Canton,
Illinois, affecting real property being legally described as
follows:
A part of Lot Number Forty (40) in J'ones' Second Addition to the Town, nnw
City of Canton, Fulton County, Illinois, bounded and described as follows, to-wit:
Commencing at the Northwest corner cat sand Lot Nuruber Forty (4~) and running
thence S~u#h an the West line of said lot ~ l feet, thence due East 7~% feet, #hence
due North to the North line 21 feet, thence West slang the North line of said lot
'70'x2 feet to the place of beginning;

3. That the special use is expressly contingent upon petitioner's purchase of
property and will not become effective until petitioner submits proof of
ownership.
4. That the record of the City of Canton, appropriated documents,
maps and related regulations be and the same hereby are, amended to reflect
the foregoing special use permit granted herein.

regular meeting this l s thday of May , 2010 upon a roll call vote as
