Council Chambers located at the Historic Depot, 50 North 4t" Avenue, Canton,
Illinois.
Mayor Kevin R. Meade called the meeting to order at 6:30 p.m.

Alderman Hartford made the motion the Consent Agenda approved as presented,
and was duly seconded by Alderman Reed. The motion carried by unanimous
voice vote.

Purchase of Bite Suite for K-9 Units.
Alderman Hartford made the motion to purchase one Series II Bite Suit from
Harddog's Requisites K-9 Equipment Specialists for $1,495.00 and paid from the
Asset Forfeiture Account, and was duly seconded by Alderman Ellis. Roll call.
AYES - Aldermen -Pickel, Hartford, Ellis, Sarff, West, Schenck, Reed. NAYS -
None. 7 AYES, 0 NAYS, 1 ABSENT. Motion carried.
Purchase of Stalker Radar Unit.
Alderman Hartford made the motion to allow the purchase of one Stalker Radar
Unit for one In Car Video Recorder in the amount of $1,810.00 from Applied
concepts, and was duly seconded by Alderman West. Discussion - Alderman
Hartford mentioned this was a grant from the Illinois Criminal Justice System.
Roll call. AYES -Aldermen Reed, Schenck, West, Sarff, Ellis, Hartford, Pickel.

Annual Ladder Testine.
Alderman Hartford made the motion to allow the annually ground and aerial
ladders tested by American Test Center in the amount of $800.00 per Aerial
Apparatus and thirteen ground ladders at $40.00 each for total of $2,010.00, and
duly seconded by Alderman Ellis. Roll call. AYES -Aldermen Pickel, Hartford,
Ellis, Sarff, West, Schenck, Reed. NAYS -None. 7 AYES, 0 NAYS, 1 ABSENT.

Cost Share Match Reaues# from County on Bike Trail Grant.
Fulton County Engineer Bill Kuhn spoke and said in about 2002 we began
preparing Greenways Trail & Plan. We applied and received $500,000 and went
for the Canton Park District to do a trail, which they are currently into Phase 1 and
Phase 2. When they are finished with Phase 1 will be ready to go for
construction. Last year the Park District and the County Board applied for
another $400,000 grant. The County would receive it if they met certain
conditions. We were able to put a coalition together. We believe and know
that we can connect Spoon River College with Eastview School, Lincoln School,
and the Canton High School and various parks of Canton. And, we're also striving
to come up with an appropriate way to connect the downtown. We want to
make the City of Canton - "A city of trails." And the second grant that we

received is a giant step forward because it's not just for design and preliminary
work, but actually for Phase 1 & Phase 2 construction.
Will help the Park District finish up Phase 1 and Phase 2 of their project and help
them get some construction money to start building things. We will be working
with the Canton Township on how to assume Maple Street. This evening we are
requesting the City to put $25,000 into next year's budget. That will allow us to
get the other part of the $100,000 we need to lock this $400,000 were getting
from IDOT.
I see your going to have strategic planning meeting this Saturday and if you want
us to collaborate with you, I would be glad to do so.
Alderman Sarff asked for Bill Kuhn to go over one more time where this portion of
the trail will be placed. Bill answered -this design and construction will be from
Spoon River College Arboretum, across hwy 2, up to county hwy S, which is
Hickory Street, cross over to hwy 22 on the north side by the railroad tracks and
then will parallel the tracks in between the roadway and railroad tracks, up to
Maple Street and will stop there. And then Canton Park District trail picks up
there and goes to Wallace Park, goes to Big Creek, then Lakeland Park, the high
school and Cypress Street. And will come back to you once we get everything
from the Federal government of what you think is right for your City.
Alderman Sarff asked -what is the Canton Park District schedule? Bill answered,
they are in the midst of Phase 1 and Phase 2, and should be wrapping up soon.
Then you'll design the trail and if they have the position to do that, they'll go out
for bids and will try to get additional outside dollars to accelerate that
construction. We appreciate the city's partnership in this.
Alderman Sarff asked what will the surface of the track be? Bill answered,
maintenance is a very important issue, and we've been working with the Canton
Park District. We believe they are the best tutors to stand behind and maintain
these trails.
Alderman Schenck said he appreciated the leadership and initiative shown. The
Illinois River Road By-Way has a lot of support for this through tourism. Two
other parts that are on the By-Way is Big Creek Park and Lakeland Park. And east
of town is the Canton Lake and is a diamond in the rough as an asset to the
Community and is on the By-Way. What sort of question would it be to develop

strategic asset? How can we bring this together and what sort of suggestions do
you have on how to proceed? Bill Kuhn said they will form a working collation
amongst the county and the township to look at. We can work together on
Cypress Street going out to the Lake area. There are multi things to look at.
Alderman Schenck said the Comprehensive Plan talks about the need of more
trails.
Alderman Hartford made the motion to agree under the Illinois Transportation
Enhancement Program for a bike trail from Maple Street in Canton to the Spoon
River College Arboretum in the amount of $25,000 for the City's commitment,
and add to the City's budget for 2010-2011, and was duly seconded by Alderman
Pickel. Discussion -Alderman Reed asked -who can we call when we have
people wanting to volunteer? Bill said he will set up something to address this.
Mayor Kevin R. Meade asked what is the plan on the railroad tracks? Bill said
with the Canton Park District Phase 1 and Phase 2, we have already had
discussion and it appears to be doable. Mayor Kevin R. Meade said does this
mean hard cash of $25,000 or can it be in-kind service of help? Bill answered we
need to capture the $400,000 so we need to have cash of $100,000. Roll call.

Laverdiere Construction Inc. Chanee Order #1. in the amount of 51,053.60 for
EDP Third Avenue Main Work.
Alderman Ellis made the motion to accept change order #1 from Laverdiere
Construction Inc. in the amount of $1,053.60 for EDP Third Avenue Main Work,
and paid from TIF account, and was duly seconded by Alderman Hartford.
Discussion -Keith Plavec mentioned it is Laverdiere Construction Inc. tying into
the proposed water main existing meter vault on the TIF project and paid out of
TIF funds, and would be part of the development agreement. Rall call. AYES -
Aldermen -Picket, Hartford, Ellis, Sarff, West, Schenck, Reed. NAYS -None. 7
AYES, 0 NAYS, 1 ABSENT. Motion carried.
Laverdiere Construction Inc. Chanee Order #1. in the amount of $3,900.00 for
EDP Third Avenue Sanitary Sewer Work.
Alderman Ellis made the motion to accept the change order #1, in the amount of
$3,900.00 for EDP Third Avenue Sanitary Sewer Work and paid from the TIF
account, and was duly seconded by Alderman West. Discussion -Keith Plavec
mentioned when the sanitary sewer was reconstructed it was removed and
replaced. Walnut Street was worked all the way. And at Walnut Street we set a
new manhole, and when we did, we observed the pipe is going off to the east
towards 4th Avenue and it was in rough shape. The contractor, Cliff O'Brien and I
looked at it and decided it was in our best interest to remove this section of
sanitary sewer to that extent of the right-of-way. So the proposed road would
not back into it, and later on not ripping up new roadway. The change order is
$3,900.00 to remove and replace an 18 inch sanitary sewer to the east and paid
out of the TIF Account. Roll call. AYES -Aldermen Reed, Schenck, West, Sarff,
Ellis, Hartford, Picket. NAYS -None. 7 AYES, 0 NAYS, 1 ABSENT. Motion
carried.
Revnolds Inc. Application for Pavment #13. in the amount of $258,270.00 for the
aroposed Radial Collector Well.
Alderman Ellis made the motion to accept the Application for Payment #13, in the
amount of $258,270.00 for the proposed Radial Collector Well from Reynolds, Inc.
and paid from Bond funds, and was duly seconded by Alderman Hartford.
Discussion -Keith Plavec mentioned that the project is 78% complete and they
are developing lateral, and their hoping at the end of the month to be completed.
As !did mention last week in committee they are working on a time extension to

March 31, 2010, and hopefully they will be presenting this next week. Roll call.

Leander Construction Inc. Application for Pavment #4, in the amount of
$35.355.60 for 61 East Side Square.
Alderman Ellis made the motion to accept the Application for Payment #4, in the
amount of $35,355.60 for 61 East Side Square from Leander Construction Inc.,
and paid from the downtown TIF account, and was duly seconded by Alderman
Sarff. Discussion -Keith Plavec mentioned the project is roughly 30% completed.
Leander Construction has sent in a notice that weather has not been 33 degrees
to lay the brick. And they will be presenting time and extension next week. Roll
call. AYES -Aldermen Reed, Schenck, West, Sarff, Ellis, Hartford, Pickel. NAYS -
None. 7 AYES, 0 NAYS, 1 ABSENT. Motion carried.
Leander Construction Inc. Application for Pavment #1, in the amount of
$34.098.40 for Lime Slaker & Accelerator Rehab.
Alderman Ellis made the motion to approve the request from Leander
Construction Inc. for Application of Payment #1, for Lime Slaker & Accelator
Rehab in the amount of $34,098.40, and paid from Bond account, and was duly
seconded by Alderman Sarff. Discussion -Keith Plavec mentioned the project is
75% complete. Roll call. AYES -Aldermen Pickel, Hartford, Ellis, Sarff, West,
Schenck, Reed. NAYS -None. 7 AYES, 0 NAYS 1 ABSENT. Motion carried.
Third Avenue Sanitary Sewer Improvements -Walnut Street to Maple Street.
Keith Plavec said I discussed this last week and I had an error. When I looked at
the estimate I used the 8 inch type quantity, actually should be 24 inch. So we
have an 18 inch coming east into Walnut Street. The sewer is in bad shape and
will be under our brand new roadway. We've looked at this with System
Maintenance Supt. Bill Terry, and the TV crew, and recommend replacing this
sewer and would get us out of the roadway completely and this would be South
of the roadway. I mentioned last week the cost would be $37,500 which was a
rough estimate. I did talk to the contractor and he said the cost would be
between $44,000 and $47,500.00, and to waive the bids. I am suggesting we
should go up to $47,000. The contractor already has been obtained for this
project through the bidding process.

Alderman Ellis made the motion to waive the bids for the new roadway, and was
duly seconded by Alderman Hartford. The motion carried unanimously by voice
vote.
Alderman Ellis made the motion to extend Laverdiere Construction contract for
additional sewer work up to $47,000, and was duly seconded by Alderman Picket.
Roll call. AYES -Aldermen Reed, Schenck, West, Sarff, Ellis, Hartford, Pickel.

Canton Water Storage Tank Project -Dave Lohrenz. Leander Construction Inc.
Dave Lohrenz thanked the council for allowing him to address them. He said he
had mentioned last week at the committee meeting of the completion of the
Canton Water Storage Facility. This is a project that was hard for completion in
December 08. The project was completed in January 09. The final payment
Leander Construction received on this project was reduced by an assessment of
$6,200.00 in liquidated damages. It is true that liquidated damages, is put in a
contract so an owner does not have to itemize damages that are incurred during a
delayed period. Especially in light of the nature of this project it is conjuncture of
a well system to be brought on line. And there was not a way of making a
reasonable forecast of even projected expenses at that point. In full realization
of the fact of actual expenses, common law expenses are incurred as result of
delays. This initiative meeting with Leander Construction, Alderman terry Ellis
and Keith Plavec to discuss the actual expenses that incurred by the City, so they
would be reimbursed and placed back into position they deserved to be. And
that is without incurring more expenses in result of additional time spent by
Maurer Stutz Inc. I believe we determined from that meeting that fees from
Maurer Stutz Inc. were $900.00. Last week and again this evening the reason for
my presence here is to respectfully request that the difference of $5,300 be paid
to Leander Construction. This was a good project, this was a quality project.
Alderman Schenck said he does not see taken any further action as we have
already done that.

COMMUNICATIONS FROM MAYOR KEVIN R. MEADE -
Auxiliary Police Force Appointment -Samantha Smith.
Alderman Sarff made the motion the appointment of Samantha Smith as Auxiliary
Police Force be confirmed, and was duly seconded by Alderman Reed. The
motion carried by unanimous voice vote.
Police Aaaointment.
Mayor Kevin R. Meade asked for Police Chief W. Dan Taylor to speak about his
new appointment. Dan mentioned that he has been accepted at the FBI
National Academy in Quantico, VA for 10 weeks of leadership, law enforcement,
academy, and physical fitness training. This will be so much knowledge that I can
bring back. Dan thanked the Council for being supportive of him.
Mayor Kevin R. Meade said the City should be very proud of this. The FBI has
done a strict background check. And we invest in our people.
Police Testine Uadate.
Police Chief Dan Taylor mentioned that 31 applications were received. Last
Saturday the Fire/Police Commission held testing for physical, agility and
orientation.
Fire Chief Bonnie Cremer mentioned that Fire Department applications are
available also starting February 5th. Have to be turned in by March 5 and March
13 the physical testing and agility will be done by the Fire/Police Commission.
Mayor Kevin R. Meade said we don't have an opening, but we have to have a list
on file.
Pro's Consultine Uadate.
Mayor Kevin R. Meade mentioned the company will be here next week at the
Clerical Committee with their findings on the Golf Course in Canton.
Cook Medical Hirine Update.
Mayor Kevin R. Meade stated that a total of 30 new hires left yesterday for 8
weeks of training. They wilt be trained for 4 days a week. Cook Medical is looking
for April opening. Some 1,000 applications have been received and are not
accepting anymore as they have to clear up the backlog.
