ORDINANCE NO. 4346
AN ORDINANCE REZONING PROPERTY AT 1808 EAST CHESTNUT STREET,
CANTON, ILLINOIS 61520 FROM AN R-2 TO A B-2 ZONING CLASSIFICATION
WHEREAS, Davis Chestnut Venture, LLC -John Davis, Manager, filed a petition with the Joint
Planning & Zoning Commission for the re-zoning of the real property described below, said
property being within the corporate limits of the City of Canton, Illinois; and
WHEREAS, Davis Chestnut Venture, LLC, purchased the real property described below from
Tinker's Toy Shop, Inc., on or about February 9, 2023; and
WHEREAS, the current zoning classification of the property is R-2 and it is the petitioner's
intent for the property to change to a B-2 zoning classification; and
WHEREAS, after proper notice, a public hearing on said Petition was conducted by the
Planning and Zoning Commission of the City of Canton on May 22, 2023.
WHEREAS, on May 22, 2023, the Planning and Zoning Commission recommended to the City
Council that the real property described below be rezoned pursuant to 65 ILCS 5/11-13-1 et.seq.
and
WHEREAS, it is in the best interest of the City of Canton, Illinois that said property be rezoned
within the City of Canton, to meet future business growth and fit within the City's
comprehensive plan.
NOW,THEREFORE, BE IT ORDAINED by the City Council ofthe City of Canton, Illinois
as follows:
1. That the Canton City Council hereby finds as facts the assertions set forth above.
2. That the described real property be and is hereby rezoned from R-2 to B-2 as follows:
A part of the Southwest Quarter of Section 25,Township 7 North, Range 4 East of
the Fourth Principal Meridian, situated in the County of Fulton and State of
Illinois, described as follows:
Commencing at the Northwest comer of the Southeast Quarter of said Southwest
Quarter of Section 25; thence along the West line of said Southeast Quarter
bearing South O degrees 33 minutes 55 seconds West, a distance of 86.75 feet to
the South line of East Chestnut Street, thence along said South line bearing South
88 degrees 01 minutes 06 seconds East, a distance of 27.27 feet, to the ACTUAL
POINT OF BEGINNING; thence continuing along said South line bearing South
88 degrees 01 minutes 06 seconds East, a distance of 72.73 feet, thence parallel
with said West line bearing South O degrees 33 minutes 55 seconds West, a
distance of 1,292.58 feet to an existing fence; thence along said existing fence
bearing South 89 degrees 04 minutes 49 seconds West, a distance of 100 feet to
said West line;thence along said West line bearing North O degrees 33 minutes 55
seconds East, a distance of 2,137.67 feet; thence bearing South 89 degrees 29
minutes 06 seconds East, a distance of 27.27 feet; thence bearing North O degrees
33 minutes 55 seconds East, a distance of 159.27 feet to the Point of Beginning;

3. That Davis Chestnut Venture, LLC - John Davis, Manager, will pay to the City of Canton
the fees required to file a certified copy of this Ordinance with the Fulton County Clerk and
Recorder of Deeds, no later than ninety(90)days from the date of this Ordinance.
4. Upon proof of filing of a certified copy of this Ordinance, the Zoning Administrator is
directed to make the appropriate map amendments to the City of Canton to reflect said re-zoning.
5. That this Ordinance shall be in full force and effect upon its passage by the City Council of
the City of Canton and approval by its Mayor.
PASSED by the City Council of the City of Canton,Illinois and approved by the Mayor thereof
this day of TUA/C 2023 upon a roll call vote as follows:
