(SEAL) r v ..�.�117:T�,�•.TW^ •�E.RS 1Y11111 CIT 1 ORDINANCE NO. 4345 AN ORDINANCE REZONING PROPERTY AT OLD BEACH ROAD AND DAL BAR ROAD, CANTON,ILLINOIS 61520 FROM AG CONSERVATION TO A R-1 ZONING CLASSIFICATION WHEREAS, John W. and Gloria Davis Land Trust Number 1, filed a petition with the Joint Planning & Zoning Commission for the re-zoning of the real property described below, said property being within the corporate limits of the City of Canton, Illinois; and WHEREAS, John W. and Gloria Davis Land Trust Number 1, purchased the real property described below from the City of Canton, Illinois, on or about December, 2022; and WHEREAS, the current zoning classification of the property is AG Conservation and it is the petitioner's intent for the property to change to a R-1 zoning classification; and WHEREAS, after proper notice, a public hearing on said Petition was conducted by the Planning and Zoning Commission of the City of Canton on May 22, 2023. WHEREAS, on May 22, 2023, the Planning and Zoning Commission recommended to the City Council that the real property described below be rezoned pursuant to 65 ILCS 5/11-13-1 et.seq. and WHEREAS, it is in the best interest of the City of Canton, Illinois that said property be rezoned within the City of Canton, to meet future residential growth and fit within the City's comprehensive plan. NOW, THEREFORE, BE IT ORDAINED by the City Council of the City of Canton, Illinois as follows: 1. That the Canton City Council hereby finds as facts the assertions set forth above. 2. That the described real property be and is hereby rezoned from AG Conservation to R-I as follows: Part of the Northeast Quarter of Section 30, Township 7 North, Range 5 East of the Fourth Principal Meridian,more particularly described as follows: Beginning at an iron rod at the southeast corner of Lot 20 in Old Beach Addition, as shown on Plat of Survey recorded November 7, 2017 as Document No. 1778527 in Slide 539, thence South 05 degrees 36 minutes 57 seconds West (bearings based on Illinois State Plane Coordinate System, NAD83 (2011), West Zone) 166. 29 feet to a fence post; thence North 88 degrees 10 minutes 25 seconds West 132. 72 feet to an iron rod; thence North 01 degrees 09 minutes 00 seconds East 128. 37 feet to an iron rod at the southwest corner of said Lot 20; thence North 77 degrees 19 minutes 27 seconds East along the southerly line of said Lot 20 a distance of 150. 00 feet to the Point of Beginning. The above-described tract contains 20,359 square feet,more or less,or 0.467 acres, more or less. 3. That John W. and Gloria Davis Land Trust Number 1, will pay to the City of Canton the fees required to file a certified copy of this Ordinance with the Fulton County Clerk and Recorder of Deeds,no later than ninety(90) days from the date of this Ordinance. 4. Upon proof of filing of a certified copy of this Ordinance, the Zoning Administrator is directed to make the appropriate map amendments to the City of Canton to reflect said re-zoning. 5. That this Ordinance shall be in full force and effect upon its passage by the City Council of the City of Canton and approval by its Mayor.
