ORDINANCE N0. ~.~
AN ORDINANCE AUTHORIZING THE SALE OF REAL PROPERTY OWNED BY THE CITY OF
CANTON, ILLINOIS WHICH PROPERTY IS GENERALLY LOCATED AT 156 SOUTH FIRST
AVENUE, CANTON, FULTON COUNTY, ILLINOIS.
WHEREAS, the City of Canton owns the following described real
property:
Fifty-five (55) feet off of the North Side of
Lot Number Sixty-four (64) in Jones' Second Addition
to Canton, excepting therefrom the West Sixty-five
(65) feet, and also except, the following described
tract of land:
Beginning at an iron pin on the North line of said Lot
64 and being East 65.0 feet from the Northwest corner of
said Lot 64; thence East a distance of 13.0 feet to an
iron pin; thence South 0° 09' East a distance of 54.86
feet to an iron pin; thence West a distance of 13.0 feet
to an existing iron pin; thence North 0° 09' West a
distance of 54.88 feet to the point of beginning,
situated in Fulton County, Illinois and subject to
easements.
which property is generally located at 156 South First Avenue, Canton,
Fulton County, Illinois and is currently vacant; and
WHEREAS, the corporate authorities of the City of Canton have
determined that it is no longer necessary, appropriate or in the best
interests of the City that it retain title to said real property, and
that said real property is not required for the use of, or profitable to
the City; and
WHEREAS, pursuant to Section 11-76-2 of the Illinois Municipal Code,
Illinois Revised Statutes, Chapter 24, Section 11-76-2, notice has been
given of the proposal to sell such real property and bids have been invited
for the purchase of such real property, said notice having first been
published on March 28, 1978, and having been published for three successive
weeks in the Canton Daily Ledger, a newspaper published in the City of Canton;
and
WHEREAS, pursuant to said notice, bids were opened at the regular
meeting of the corporate authorities held on May 2, 1978; and
WHEREAS, the following bids for the purchase of such property have
been received:

and
WHEREAS, the corporate authorities find and determine that the best
interests of the City and its residents will be served by the acceptance
of the bid submitted by The Salvation Army and the sale of the aforesaid
real property to such bidder for the amount bid of five thousand two
hundred and fifty dollars ($5,250.00), which amount, although it does not
represent the high bid, is found to be in the best interests of the City
of Canton;
NOW, THEREFORE, BE IT ORDAINED BY THE CORPORATE AUTHORITIES OF THE
CITY OF CANTON, ILLINOIS, AS FOLLOWS:
1. The corporate authorities find as facts the recitals hereinabove
set forth.
2. The bid of The Salvation Army in the amount of five thousand two
hundred and fifty dollars ($5,250.00) is hereby accepted by the corporate
authorities of the City of Canton for the sale of the following described
real property:
Fifty-five (55) feet off of the North Side of
Lot Number Sixty-four (64) in Jones' Second Addition
to Canton, excepting therefrom the West Sixty-five
(65) feet, and also except, the following described
tract of land:
Beginning at an iron pin on the North line of said Lot
64 and being East 65.0 feet from the Northwest corner of
said Lot 64; thence East a distance of 13.0 feet to an
iron pin; thence South 0° 09' East a distance of 54.86
feet to an iron pin; thence West a distance of 13.0 feet
to an existing iron pin; thence North 0° 09' West a
distance of 54.88 feet to the point of beginning,
situated in Fulton County, Illinois and subject to
easements.
3. The Mayor of the City of Canton is hereby authorized and directed
to sign and the City Clerk is hereby authorized and directed to attest a
contract for the sale and purchase of the aforesaid real property, which
contract shall be in the form attached hereto as Exhibit A.
4. Upon satisfaction of the terms of the aforesaid contract and upon
the payment or securing of the aforesaid bid price in the manner provided
in said contract, the Mayor of the City of Canton is hereby authorized and
directed to convey and transfer the aforesaid real property to The Salvation
Army, an Illinois corporation, by a proper deed of conveyance, stating therein
the aforesaid consideration, and the City Clerk is hereby authorized to
acknowledge and attest such deed and to affix thereto the seal of the
City of Canton.
5. The Mayor and the Clerk of the City of Canton are hereby authorized,
respectively, to execute and attest such other documents as may be necessary
to the conveyance herein authorized.
6. This Ordinance shall be in full force and effect from and after
its passage by a vote of at least three-fourths of the corporate authorities
now holding office, and approval in the manner provided by law.

of the City of Canton, Illinois now holding office, and APPROVED by the

BETWEEN the CITY OF CANTON, Illinois, a municipal corporation, duly organized
and existing under and by virtue of the laws of the State of Illinois, and
party of the first part and THE SALVATION ARMY, an Illinois Corporation,
party of the second part
WITATESSETH, That if the party of the second part shall first make the payments and perform the covenants hereinafter
mentioned on itg part to be wade and performed, the said party of the first part hereby covenants and
agrees to convey and assure to the said party of the second part, in fee simple, clear of atl incumbrances whatever, by a good

Fulton and State of IllinOls known and described as follows, to-wit:

of the Mayor, City of Canton, 210 East Chestnut Street, Canton, Illinois
the sum of Five thousand two hundred fifty ($5,250.00) Dollars, itt the manner following:
the sum of One thousand fifty ($1 , 050.00) Dollars, cash on or before the date of delivery hereof,
receipt whereof is hereby acknowledged, and the balance of Four thousand two hundred ($4,200.00)
Dollars on or before December 1, 1978.

either of the payments, or any part thereof, or perform any of the covenants on itS part hereby made
and entered into, this contract shall, at the option of the party of the first part, be forfeited and determined, and the party of
the second part shall forfeit all payments made by It on this contract and such payments shall be retained
by the said party of the first part in full satisfaction and in liquidation of all damages by it
sustained and it shall have the right to re-enter and take possession of the premises aforesaid.
Possession to be given on or before December 1 , 19 78
Abstract showing a merchantable title in owner of record at date of conveyance shall be furnished by first party for
examination by second party not less than fifteen (15) days before final payment.
The party of the second part further covenants and agrees that it wilt at once have such
building, if •any, as may be now or hereafter upon said real estate, insured against loss by fire, lightning attd tornado, to their
insurable value, policies to be issued in the name of and deposited with the party of the first part, but loss to be made payable
to both parties hereto according to their respective interests at the time of loss. Existing insurance s~ be assigned to
second party upon payment to first party pro rata for the unexpired term. may

' The Seller hereby warrants that if the real estate above described is a dwelling structure that no notice from any city,
village or other governmental authority of a dwelling code violation which existed in the dwelling structure before this con-
tract•was executed has been issued and received by the owner or his agent.
IT IS MUTUALLY AGREED, By and between the parties hereto, that time of payment shall be the essence ~f this
contract and that all the covenants and agreements herein contained shall extend to and be obligatory upon the heirs,
executors, administrators and assigns of the respective parties.
