Re-zoning certain property of Elmer
Hossler and Lilla Hossler on North '
Main Street in the City of Canton
WHEREAS, it appears to the City Council of the City of
Canton, that a Petition for re-zoning of the real estate hereinafter
described was filed by Elmer Hossler and Lilla Hossler, owners, and
that said property is currently in an R-4 zoning configuration, and
IT FURTHER APPEARING to said City Council that a Public
Hearing was held before the Planning and Zoning Commission of the
(City of Canton on the 10th day of April, 1978 A.D. pursuant to
regular and proper published notice of said hearing; and
IT FURTHER APPEARING to said City Council that on the
15th day of May, 1978 the Planning and Zoning Commission of said
City further considered the application for re-zoning herein and
that said Planning and Zoning Commission has recommended a re-zoninc
of the premises hereinafter described from the existing R-4 Zoning
Configuration to a B-2 Zoning Configuration.
THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE
CITY OF CANTON, ILLINOIS:
Section 1. That the territory hereinafter described be
and the same is hereby re-zoned from an R-4 Zoning Configuration
to a B-2 Zoning Configuration, said real estate being generally
located in the 700 Block of North Main Street, Canton, Illinois,
and being legally described as follows:
Lot 71, 72 and the North 70 feet of Lot 73, all
in Old Town Addition to the City of Canton,
County of Fulton and State of Illinois.
Section 2. That the Zoning Administrator of the City of
Canton, Illinois, be and he is hereby instructed to make the
appropriate changes on the Zoning map of the City of Canton to
reflect the amendment of the Zoning map in conformity with this
Ordinance.

PETITION FOR RE-ZONING'

COMES NOW your Petitioners, ELMER HOSSLER and LILLA HOSSLER,
and petition the City Council of the City of Canton, Illinois to
re-zone the following described real estate from an R-2 Zoning
Configuration to a B-2 Zoning Configuration and in support therec
states as follows:
1. That the real estate which is the subject matter of this
petition is legally described as follows:
Lot 71, 72 and the North 70 feet of Lot 73, all
in Old Town Addition to the City of Canton,
County of Fulton and State of Illinois.
2. That your Petitioners, EL~^~IER HOSSLER and LILLA HOSS~LER,
are the owners of the above-described real estate.
3. That your Petitioners have entered into an agreement
for the sale of said real estate, contingent upon re-zoning to
Murray Enterprises, Inc., a corporation.
4. That your Petitioners desire to construct at said
location a building and parking lot thereon for use as a family
restaurant, said restaurant building to be approximately 8,000
sq. ft. of which 1,500 sq. ft. would be "building support"
facilities with a useable remaining square footage of 6,500.
5. That your Petitioners intend to construct thereon
sufficient parking facilities to meet the parking requirements
of the City Code of the City of Canton.
6. That the highest and best use of said premises is for
the use contemplated which requires a B-2 Zoning.
WHEREFORE, your Petitioners pray that upon hearing, the
Planning Commission of the City of Canton will recommend to the

City Council of the City of Canton that the premises hereinabove
described be re-zoned from an R-2 Zoning Configuration to a B-2
Zoning Configuration and that the zoning maps of the City of
Canton be appropriately changed to reflect said amendment.
