ORDINANCE N0. ~ ~ '"I
AN ORDINANCE AMENDING CERTAIN SECTIONS OF TITLE 8, CHAPTER 11 OF THE
CANTON MUNICIPAL CODE CONCERNING LAKE CANTON.
WHEREAS, the Public Works and Buildings Committee and the Legal
and Ordinance Committee of the City of Canton, Illinois have determined
that it is necessary, desirable and to the best interests of the City
of Canton to modify and amend certain sections of Title 8, Chapter 11
of the Canton Municipal Code concerning Lake Canton; and
WHEREAS, the City Council of the City of Canton, Illinois has
made a similar determination.
NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY
OF CANTON, ILLINOIS, AS FOLLOWS:
1. That Title 8, Chapter 11, Section 2 of the Canton Municipal
Code be, and the same is hereby amended to read as follows:
"8-11-2: BOATING LICENSE REQUIRED:
All persons operating boats or watercraft on Lake Canton shall
first pay fees and obtain licenses as follows:
(A) Canton Residents: Canton residents and lease lot holders
of Lake Canton shall pay the following annual license fees:
1. Four Dollars ($4.00) for each boat or craft which is
not propelled by any motor or engine.
2. Ten Dollars ($10.00) for each boat or craft either
temporarily or permanently equipped with any motor or engine
not in excess of twelve (12) horsepower.
3. Thirty Dollars ($30.00) for each boat or craft either
temporarily or permanently equipped with any motor or engine in
excess of twelve (12) horsepower.
(B) Fulton County Residents: Bona fide residents of the County
of Fulton in the State of Illinois who reside outside the cor-
porate limits of the City shall pay the following annual license
fees:
1. Eight Dollars ($8.00) for each boat or craft which is
not propelled by a motor or engine.
2. Twenty Dollars ($20.00) for each boat or craft either
temporarily or permanently equipped with any motor or engine not
in excess of twelve (12) horsepower.
3. Sixty Dollars ($60.00) for each boat or craft either
temporarily or permanently equipped with any motor or engine
in excess of twelve (12) horsepower.
(C) Other Residents: Persons not residents of either the
City of Canton, Illinois or the County of Fulton in the State
of Illinois and who are not lease lot holders of Lake Canton
shall pay the following annual license fees:
1. Twenty Five Dollars ($25.00) for each boat or craft
which is not propelled by a motor or engine.
2. Forty Dollars ($40.00) for each boat or craft either
temporarily or permanently equipped with any motor or engine not
in excess of twelve (12) horsepower.
3. Ninety Dollars ($90.00) for each boat or craft either
temporarily or permanently equipped with any motor or engine in
excess of twelve (12) horsepower.
(D) Daily Licenses: Any person may operate a boat or craft on
Lake Canton for not more than one day (consisting of twenty four
(24) consecutive hours) upon payment of a daily license fee
therefor of Twenty Dollars ($20.00).
(E) Limitations on Licenses: Notwithstanding anything here-
inabove contained to the contrary, the following limitations
are imposed on the issuance of licenses:
1. No license shall be issued for any boat or craft
temporarily or permanently equipped with any motor or engine
in excess of eighty five (85) horsepower.
2. No license shall be issued for any boat or craft
equipped with sleeping facilities.
3. All licenses shall be obtained by making application
with the Cashier of the Water and Sewer Department of the City,
at the City Building, Canton, Illinois, and each person applying
for a license, as aforesaid, shall present evidence to show that
the boat is properly registered and that he carries property
and liability insurance on and in connection with the boat he
desires to operate on said Lake.
4. All owners of boats with motors or engines to be
operated on Lake Canton shall carry liability and property
insurance covering any boat on said Lake. The liability shall
be not less than ten thousand dollars ($10,000.00); and the
insurance covering property damage shall not be less than
five thousand dollars ($5,000.00).
5. No motor boat shall be permitted to operate on said
Lake later than one hour after sundown."
2. That Title 8, Chapter 11, Section 3 of the Canton Municipal
Code be, and the same is hereby amended to read as follows:
"8-11-3: COMMITTEE ON PUBLIC WORKS AND BUILDINGS; JURISDICTION:
Jurisdiction of all recreational and development activities on
Lake Canton and the land owned by the City surrounding said Lake
shall be under the jurisdiction of the Committee on Public Works
and. Buildings. Said Committee shall have the right to make
reasonable rules and regulations regarding such activities which
shall have the same effect as ordinances duly enacted by the
City Council."
3. That Title 8, Chapter 11, Section 6 of the Canton Municipal
Code be, and the same is hereby amended to read as follows:
"8-11-6: RULES AND REGULATIONS, BOATING:
The following rules and regulations governing boating on Lake
Canton be, and the same are hereby adopted by the City Council
of the City of Canton, and said rules and regulations shall
have the same force and effect as ordinances validly enacted:
Rules and Regulations Governing Boating on Lake Canton
1. All boats or watercraft shall be licensed as required
by the provisions of this Code now in force or hereafter enacted.
2. Except for persons leasing lots on Lake Canton all boats
or watercraft shall be loaded and unloaded from the ramp or dock
provided by the City at the entrance of the Lake. Loading and
unloading at other places around the Lake are prohibited.
3. No boat or watercraft shall operate at a speed in excess
of thirty (30) miles an hour.
4. No boat or watercraft shall operate in an unsafe or
careless manner.
5. Boats and watercraft shall operate around the Lake in a
counterclockwise direction.
6. No boat or watercraft shall operate within fifty feet
(50') of any person who is fishing.
7. Boats or watercraft pulling skiers must travel in a
counterclockwise direction and shall not criss cross or circle
the lane of traffic and shall keep clear of the docks, starting
points and beaches at all times.
8. No boats or watercraft shall be parked on or near the dock
or ramp except for the loading or unloading or exchanging of
passengers.
9. No boats or watercraft shall be operated within that
area near the intake, spillway or beaches, and which is so marked
with markers.
10. No vehicles shall be parked on the point of the boat
loading area or in any other area where there are "no parking"
signs.
11. All boats or watercraft shall be equipped with such safety
devices as required by the provisions of this Code or the Statutes
of the State.
12. All boats or watercraft operated between sunset and
sunrise shall be equipped with a light that can be clearly ob-
served from any quarter by an approaching boat.
13. Skiers must wear a life saving device. Ski starts shall
be from a designated area. Boats pulling skiers shall have two
(2) occupants, one to drive and the other to watch the skier and
ski rope. Ski ropes shall be pulled into the boat after a skier
has fallen. Skiers shall not be dropped off within two hundred
feet (.200') of a ramp or gas dock. Operators of boats pulling
skiers shall be responsible for occupants and safety equipment.
No skier shall swim to shore from the drop off point except
where necessary to save his life.
14. No boats with motors exceeding twelve (12) horsepower
shall be permitted to operate on Lake Canton at any time on Mondays
of each week, except when a holiday falls on a Monday, and on no
mornings of each day of the week before eleven o'clock (11:00)
A.M.; but boats with motors exceeding twelve (12) horsepower
shall be permitted to operate on said Lake from eleven o'clock
(11:00) A.M. until one hour after sundown on all days of the week
except Mondays.
15. All sail boats over twelve feet (12') in length shall
be registered in compliance with the Statutes of the State of
Illinois.
16. All watercraft shall carry approved Coast Guard life
saving devices for each person on said craft, and an approved
life saving device shall be on board of each watercraft for each
water skier being towed by said watercraft.
17. All motorboats which use fuel having a flashpoint of one
hundred ten degrees (110°) Fahrenheit or less shall have at least
two (2) ventilator ducts, fitted with cowls or their equivalent
for the efficient removal of explosive or inflammable gases from
the bilges of every engine and fuel tank compartment. There shall
be at least one exhaust duct installed so as to extend from the
open atmosphere to the lower portion of the bilge and at least one
intake duct installed, so as to extend to a point at least midway
to the bilge or at least below the level of the carburetor air
intake. The cowl shall be located and trimmed for maximum
effectiveness and in such a manner as to prevent displaced fumes
from being recirculated.
18. No person under twelve (12) years of age shall operate
any vessel propelled by a motor of twelve (12) horsepower or
more, unless such person is under the direct supervision of a
person sixteen (16) years or older who is qualified and capable
of operating the vessel. "
4. That Title 8, Chapter 11, Section 9 of the Canton Municipal Code
be, and the same is hereby amended to read as follows:
"8-11-9: CLOSE ROADS NEAR LAKE:
The Public Works and Buildings Committee of the City Council
shall provide a lock chain for use across the road ajoining the
Lake which is known as the "inlet" road, and this chain shall be
locked across the road one hour after sundown of each and every
day; and they shall provide a lock chain across the road adjoining
the Lake which is known as the "outlet" road, and this chain shall
be locked across said road at eleven o'clock (11:00) P.M. of
each and every day."
5. That the remainder of Title 8, Chapter 11, Lake Canton, of the
Canton Municipal Code remain in full force and effect.

6. That this Ordinance shall be in full force and effect upon its
passage by the City Council of the City of Canton, Illinois and approval by the
Mayor thereof.
PASSED by the City Council of the City of Canton, Illinois and
