AN ORDINANCE Cr /~
Re-zoning certain property of Lendel W.
Payne and Doris M. Payne on Linn Street
in the City of Canton, Illinois
WHEREAS, it appearing to the City Council of the City of Canton,
Illinois that the territory hereinafter described is located within the corporate
limits of said City of Canton, Illinois and is currently zoned in an R-2
zoning configuration, and
IT FURTHER A PPEA RING to said City Council that a Petitiion for
R.e-zoning has been filed by the Petitioners, LENDEL W. PAYNE and
DORIS M. PAYNE, to re-zone the property hereinafter described to a B-2
zoning configuration, and
IT FURTHER APPEARING to said City Council that a public hearing
was conducted for the ~'lanning and Zoning Commission of the City of Canton,
Illinois in accordance with the law and that on the 10th day of October, 1977
said Planning and Zoning Commission unanimously recommended that the
property hereinafter described be re-zoned from an R-2 zoning configuration
to a B-2 zoning configuration.
THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE
CITY OF CANTON, ILLINOIS:
Section 1. That the territory described as follows:
Lots 1, 2, 3, 4, 5 and 6 of Block 1, A . J. Whitnah
Addition to the City of Canton, County of Fulton
and State of Illinois,
be and the same is hereby zoned as a B-2 zoning configuration according to
the City Code of the City of Canton, Illinois.
Section 2. That the City's zoning administrator be and he is hereby
ordered to make the necessary amendments on the zoning map of the City of
Canton, Illinois to reflect the changes required herein by this Ordinance.

Section 3. That this Ordinance shall be in full force and effect from
and after a majority vote of the City Council of the City of Canton, Illinois
and approval thereof by the Mayor.
PASSED by a majority vote of the City Council of the City of Canton,

1, Petitioners state that the real estate described in Exhibit A is
rectangular in portion lying directly .South of Linn Street and directly East of
South Seventh Avenue in the City of Canton having a distance of 150 feet more
or less, Eastwest and 300 feet, more or less, Northsouth.
2. That your petitioners further represent that there is located upon
said parcel of real estate a steel frame building suitable for use as a retail
sales shop and repair shop for motorcycles and motorcycle parts.
3. That your Petitioners further represent to this Council that the
real estate described in Exhibit A is currently within the corporate Limits of
the City of Canton, Illinois.
4. That your Petitioners further represent that they are the owners of
said real estate and intend to use same as a retail sales shop for motorclycles
lawn and garden tractors and other similar items and that the premises herei
fronts upon a state highway and is well sufted for general commercial purposE
and a B~2 zoning configuration.

NOTICE OF PUBLIC HEARING
PLEASE TAKE NOTICE that a Petition for Rezoning has been filed by
LENDEL W. PAYNE and DORIS N. PAYNE of certain real estate which can
generally be described as being located at the Southeast Corner of Linn Street
and South Seventh Avenue in the City of Canton, Illinois. Said premises is
more particularly described as follows:
Lots 1, 2, 3, 4, 5 and 6 of Block 1,
A. J. Whitnah Addition to the City
of Canton, County of Fulton and
State of Illinois.
The Petition filed herein requests that the above property be rezoned from an
R-2 zoning configuration to a B»2 zoning configuration so that the property may
be utilized as a retail sales establishment for the sales and repair of lawn and
garden tractors, motorcycles and similar items. This Petition for Rezoning
will be considered at the regular meeting of the Planning and Zoning Cornmissio
of the City of Canton and a public hearing will'~be held thereon on the /0'~ ~ day
