CnII . ti '~ '"', AN ORDINANCE AUTHORIZING THE SALE OF REAL PROPERTY OWNED BY THE CITY OF CANTON, ILLINOIS WHICH PROPERTY IS GENERALLY LOCATED AT 156 SOUTH FIRST AVENUE, CANTON, FULTON COUNTY, ILLINOIS. WHEREAS, the City of Canton owns the following described real property: Fifty-five (55) feet off of the North Side of Lot Number Sixty-four (64) in Jones' Second Addition to Canton, excepting therefrom the West Sixty-five (65) feet, and also except, the following described tract of land: Beginning at an iron pin on the North line of said Lot 64 and being East 65.0 feet from the Northwest corner of said Lot 64; thenceoEast a distance of 13.0 feet to an iron pin; thence South 0" 09' East a distance of 54.86 feet to an iron pin; thence West a distance of 13.0 feet to an existing iron pin; thence North 0° 09' West a distance of 54.88 feet to the point of beginning, situated in Fulton County, Illinois and subject to easements. which property is generally located at 156 South First Avenue, Canton, Fulton County, Illinois and is currently vacant; and WHEREAS, the corporate authorities of the City of Canton have determined that it is no longer necessary, appropriate, or in the best interest of the City that it retain title to said real property, and that said real property is not required for the use of, or profitable to the City; and WHEREAS, said real property was acquired for the purpose of constructing a parking lot thereon; and, WHEREAS, said real property has not, since its acquisition, been used by the City of Canton for the intended purpose or any other purpose of said City but now remains vacant, unoccupied, and unused by the City; and, WHEREAS, it has been determined by the corporate authorities of the City of Canton that the original intended purpose of said real property is no longer desirable or practicable and that said real property will not be used therefor; and, WHEREAS, it has been further determined that said real property is not suitable for and will not be used for any corporate purposes of the City of Canton; and, WHEREAS, the corporate authorities of the City of Canton have F ' ' ,r :~ ~ '+t, .... determined that it is necessary, desirable and in the furtherance of public interest that said real property be sold for purposes or usages unrestricted by this City, NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF CANTON, ILLINOIS, AS FOLLOWS: 1. That the real property owned by the City of Canton, Illinois, which property is generally located at 156 South First Avenue, Canton, Fulton County, Illinois, and which is legally described as follows, to-wit: Fifty-five (55) feet off of the North Side of Lot Number Sixty-four (64) in Jones' Second Addition to Canton, excepting therefrom the West Sixty-five (65) feet, and also except, the following described tract of land: Beginning at an iron pin on the North line of said Lot 64 and being East 65.0 feet from the Northwest corner of said Lot 64; thence East a distance of 13.0 feet to an iron pin; thence South 0° 09' East a distance of 54.86 feet to an iron pin; thence West a distance of 13.0 feet to an existing iron pin; thence North Oo 09' West a distance of 54.88 feet to the point of beginning, situated in Fulton County, Illinois and subject to easements. shall be sold for cash to the highest and best bidder whose bid is found to be in the best interests of the City of Canton. 2. That said real property shall be sold for purposes unrestricted by the City of Canton, Illinois, but subject to any applicable zoning laws now or hereafter existing. 3. That said real property shall be sold for cash, to be fully paid on or before 30 days following the opening, acceptance and notifi- cation of successful bid. All interest of the City of Canton, Illinois in and to said real property shall be conveyed to the successful bidder by customary quitclaim deed and an abstract of title thereto shall be furnished at the expense of the City. Each bid shall be sealed and accompanied by a certified check (or equivalent thereto) of not less than 20% of the submitted bid (refundable to unsuccessful bidders). The corporate authorities reserve the right to reject any and all bids and to waive any informalities or irregularities in the bidding. The cor- porate authorities further reserve the right to review and study any and all bids and to make a contract award within thirty days after the bids have been opened and publicly read. That all bids for the purchase of said real property shall be opened and considered by the corporate authorities of the City at the regular meeting of the City Council to be held in the City Council Room in the Canton City Building at 210 East Chestnut Street in the City of Canton, Illinois, commencing at 6:30 P.M. December 20, 1977; and, that all such bids must be filed with the City Clerk at the City Building not later than 6:30 P.M. on that day. 5. That, prior to the sale of said real property, notice of this Ordinance and the proposal or determination herein contained to sell said real property shall be published by the Clerk of this City once each week for three successive weeks in a newspaper published in the City of Canton, Illinois, the first such publication to be printed not less than thirty days before the day hereinabove provided for the opening of bids for the purchase of said property. The notice shall contain an accurate descrip- tion of the property, state the purpose or purposes for which it is presently used, state the purpose for which it may be used and state at what regular meeting of the Canton City Council when the bids will be considered and opened. The notice shall solicit or advertise for bids for the purpose of selling said property. The notice shall be in the following form: NOTICE OF SALE INVITATION FOR BIDS TO PURCHASE REAL PROPERTY OWNED BY THE CITY OF CANTON, ILLINOIS. Notice is hereby given by the City of Canton, Illinois as follows: Pursuant to Ordinance passed by the City Council of the City of Canton, Illinois on November 1, 1977, bids are solicited and invited for the purchase of real property owned by the City of Canton, Illinois which is generally located at 156 South First Avenue, Canton, Fulton County, Illinois and which is legally described as follows, to-wit: Fifty-five (55) feet off of the North Side of Lot Number Sixty-four (64) in Jones' Second Addition to Canton, excepting therefrom the West Sixty-five (65) feet, and also except, the following described tract of land: Beginning at an iron pin on the North line of said Lot 64 and being East 65.0 feet from the Northwest corner of said Lot 64; thence East a distance of 13.0 feet to an iron pin; thence South 0° 09' East a distance of 54.86 feet to an iron pin; thence West a distance of 13.0 feet to an existing iron pin; thence North 0° 09' West a distance of 54.88 feet to the point of beginning, situated in Fulton County, Illinois and subject to easements. 1' x ~ ~~ .~ V The property is currently vacant and not used for any corporate purpose of the City of Canton, Illinois. The property is subject to the zoning laws of the City of Canton, Illinois as the same now or may hereafter exist, and may be used by the purchaser for usages consistent therewith. Bids for the purchase of this real property must be sealed and filed with the City Clerk of the City of Canton, Illinois at the Canton City Building at 210 East Chestnut Street, Canton, Illinois not later than 6:30 o'clock P.M. on December 20, 1977 and shall be opened and considered by the Canton City Council at the hour of 6:30 o'clock P.M. in the Council Room of said City Building.
