ORDINANCE NO. rcY
WHEREAS, it appears to the City Council of the City of Canton, Illi-
nois, that the territory hereinafter described is within the corporate limits
of said municipality, having been annexed by ordinance 46525 approved by the
City Council and Mayor of said City of Canton on January 13, 1976, and zoned
R-l, single-family residential, which is now designated as R-2 by the zoning
ordinance adopted in November, 1976; and
WHEREAS, Scruggs & Hammond of Peoria, Illinois, have formulated a
land use plan for said real estate in conformity with the comprehensive plan
for land use development heretofore prepared and approved by the City of Can-
ton, Illinois, which envisages the development of said real estate for resi-
dential purposes, over a five- to ten-year period, as a Planned Unit Develop-
ment, so that multiple-family and single-family development areas may be
established which would be compatible;
NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF
CANTON, ILLINOIS:
SECTION 1. That the real estate described as follows:
The Northeast Quarter of Section 28, Township 7 North,
Range 4 East of the Fourth Principal Meridian, EXCEPT
21.75 acres lying North of the road in the Northeast
corner of said quarter section; ALSO EXCEPT beginning
at a point 1046 feet South of the Northeast corner of
said Section 28, running thence South 170 feet, thence
West 175 feet, thence North about 360 feet to public
highway, thence along public highway in a Southeasterly
direction to the East line of said Section 28, thence
South about 128 feet to the place of beginning; ALSO
EXCEPT beginning at the Southwest corner of said North-
east Quarter, running thence East along the South line
of said Northeast Quarter 600 feet, thence North 435.6
feet, thence West 336.7 feet, thence North 331 feet,
thence West 263.3 feet to the West line of said North-
east Quarter, thence South 766.6 feet to the place of
beginning; and also EXCEPT beginning at a drill hole
at the center of Section 28, thence North 0 degrees
53 minutes 44 seconds East along the West line of said
Northeast Quarter 1369.14 feet; thence East 849.08 feet
to the actual point of beginning marked by a concrete
marker; thence North 1104.61 feet to the Southerly
right-of-way line of County Highway 21 marked by a
concrete marker; thence South 67 degrees 17 minutes
35 seconds East along said Southerly right-of-way line
542.00 feet to a concrete marker; thence South 895.39
feet to a concrete marker; thence West 500.00 feet to
the actual point of beginning, said last exception con-
taining 11.478 acres, ALL in the City of Canton, County
of Fulton, State of Illinois,

BE AND THE SAME IS HEREBY RE-ZONED FROM R-2 to R-2, R-3,
R-4, and CO-1, as delineated on the Exhibit for Re-zoning
dated March 25, 1977, which said exhibit is incorporated
herein by reference.
SECTION 2. That the preliminary plat of WESTWOOD ESTATES, Section One,
which is a part of the real estate hereinabove described,
and the zoning configuration as shown by said preliminary
plat are hereby approved, and Lots 1, 2, 3, 4, 5, 6, and
28 are zoned R-3; Lots 29, 30, and 31 are zoned R-4; and
Lots 7 through 27 inclusive and 32 through 44 inclusive
are zoned R-2.
SECTION 3. That this ordinance shall be in effect from and after a two-
thirds "aye" and "no" vote of the City Council of the City of
Canton, Illinois, and approval by the Mayor.
PASSED by a two-thirds "aye" and "no" vote of the City Council and approved
by the Mayor this 7th day of ~, 1977.

PERFORMANCE BOND
The undersigned, MARIAN R. LOCK, J. HOBART LOCK, Jr.,
HOWARD R. TAYLOR, SHIRLEY I. TAYLOR, C. EUGENE TAYLOR and MARILYN
TAYLOR, holders of 100 Per Cent of the beneficial interest in The
National Bank of Canton Land Trust No. 450, hereby bind ourselves,
our heirs, executors, administrators, successors and assigns to
the City of Canton, Illinois, in the penal amount of $300,000.00,
conditioned upon the performance by the undersigned of the in-
stallation of all capital improvements in Westwood Estates, Sec-
tion 1, a subdivision of the City of Canton, Illinois, said im-
provements to be in conformity with the plans and specifications
prepared and submitted to the City of Canton, Illinois, by the
undersigned, as prepared by Associated Engineers of Peoria, Illi-
nois.
Should the undersigned fail to perform all of the im-
provements hereinabove specified within 24 months of the date
hereof (additional time may be allowed for installation of side-
walks), then this bond shall be in full force and effect and im-
mediately enforceable by the City of Canton, Illinois.
Upon approval by the City Engineer of the City of Can-
ton, Illinois, of the capital improvements in Westwood Estates as
called for in the plans and specifications, and made and performed
by the undersigned, then this bond shall be null and void.
The undersigned, as an additional inducement to the
City of Canton for the acceptance of this bond, do hereby declare:
a. That a contract for the installation of all the im-
provements called for in the plans and specifications has been
signed with George Hoffman & Sons, Inc., a corporation of Peoria,
Illinois, for an amount less than the engineers' estimate of
$266,000.00.

b. That a loan commitment has been received by the un-
dersigned from The National Bank of Canton, Canton, Illinois, in
an amount sufficient to cover the cost of all of said improvements.
c. That the combined net worth of the undersigned prin-
cipals which is not hypothecated exceeds two times the amount of
this bond.
d. That the undersigned hereby jointly and severally bind
themselves to the faithful performance of the terms and conditions
of this bond.
This bond is given to the City of Canton, Illinois, for
the purpose of complying with Title 11 entitled "Subdivisions,
11-1-7" of the revised ordinances of the City of Canton, Illinois,
in effect on the date of this bond.
