Parcel ~~2 Commencing at the Southwest corner of said Section 19; thence South 89° 51' 18" East, 2384.34 feet along the south line of said Section 19; thence North 72° 50' 02" East, 168.04 feet; thence North 0° 38' 42" East, 380.00 feet; thence North 89° 51' 19" West, 224.82 feet; thence North 60° 57' 38" West, 41.38 feet to the ACTUAL POINT OF BEGINNING; thence North 89° 51' 18" West, 262.97 feet; thence North 3° 48' 42" East, 288.70 feet; thence South 89° 21' 18" East, 150.00 feet to an iron pin; thence South 23° 08' 42" West, 140.00 feet to an iron pin; thence South 9° 51' 18" East, 85.00 feet to an iron pin; thence South 60° 57' 38" East, 153.58 feet to the Point of Beginning containing 0.925 acres. which property is generally located in Section Nineteen (19) of Orion Township, Fulton County, Illinois and is currently vacant; and WHEREAS, the corporate authorities of the City of Canton have determined that it is no longer necessary, appropriate, or in the best interest of the City that it retain title to said real property, and that said real property is not required for the use of, or profitable to the City; and WHEREAS, pursuant to Section 11-76-2 of the Illinois Municipal Code, Illinois Revised Statutes, Chapter 24, Section 11-76-2, notice has been given of the proposal to sell such real property and bids have been invited for the purchase of such real property, said notice having first been published on October 17, 1978, and having been published for three successive weeks in the Canton Daily Ledger, a newspaper published in the City of Canton; and WHEREAS, pursuant to said notice, bids were opened at the regular meeting of the corporate authorities held on November 21, 1978; and WHEREAS, the following bids for the purchase of such property have been received: BIDDER AMOUNT George E. Sebree Bid is attached hereto as Exhibit A. and WHEREAS, the corporate authorities find and determine that the best interests of the City and its residents will be served by the acceptance of the bid submitted by George E. Sebree and the sale of the aforesaid real property to such bidder; NOW, THEREFORE, BE IT ORDAINED BY THE CORPORATE AUTHORITIES OF THE CITY OF CANTON, ILLINOIS, AS FOLLOWS: 1. The corporate authorities find as facts the recitals hereinabove set forth. 2. The bid of George E. The Mayor of the City of Canton is hereby authorized and directed to sign and the City Clerk is hereby authorized and directed to attest a contract for the sale and purchase of the aforesaid real property, which contract shall be in the form attached hereto as Exhibit B. 4. Upon satisfaction of the terms of the aforesaid contract and upon the payment or securing of the aforesaid bid in the manner provided by said contract, the Mayor of the City of Canton is hereby authorized and directed to convey and transfer the aforesaid real property to George E. Sebree by a proper deed of conveyance, and the City Clerk is hereby authorized to acknowledge and attest such deed and to affix thereto the seal of the City of Canton. 5. The Mayor and the Clerk of the City of Canton are hereby authorized, respectively, to execute and attest such other documents as may be necessary to the conveyance herein authorized. 6. Sebree hereby releases and dis- charges City of and from any claim, cause of action, demand or right to damages which he might otherwise have by reason of past occupancy by City of parcels 3, 4, and 5 and the said half acre of campground. 3. The Canton Lake Road extends along the West, North and Easterly sides of the Sebree farm. In the event, hereafter, Sebree, his successors in title or assigns, files any subdivision plat and seeks the approval of appropriate county authorities for subdivision development, then Sebree will contribute substantially to the improvement of the Canton Lake Road extending from the point of beginning of parcel 3 on the West to the point of beginning of parcel 5 on the East, a distance of about 3900 feet. Sebree will make such repairs and improvements to this portion of the said Canton Lake Road as may be required by appropriate county author- ity, but in no event less than improvement of that section of road by appropriate application of two inches of asphalt. 4. About one-half acre of the City of Canton campground area is part of the Sebree farm and is in the general vicinity of the Canton Lake Road but is not part of any of these parcels of land. Sebree has heretofore permitted the City of Canton and permittees of said City to use this space. Sebree agrees that this existing per- mission will continue at least through the year 1981.
