HomeMy WebLinkAboutResolution #5414 - memorandum of understanding with illinois fraternal order of police labor council, unit #840; regarding part time dispatchersRESOLUTION NO. 5414 A RESOLUTION APPROVING A MEMORANDUM OF UNDERSTANDING BETWEEN THE CITY OF CANTON AND ILLINOIS FRATERNAL ORDER OF POLICE LABOR COUNCIL, UNIT #840 REGARDING PART-TIME DISPATCHERS WIREAS, the City of Canton (the "City") arfd the Illinois Fraternal Order of Police Labor Council, Unit #840 ("Umori"j ar_e parties to a Collective Bargaining Agreement effective May 1; 2Q21. _ Apri 13,0, -2624; , WHEREAS, the City and Union have negotiated a Memorandum of Understanding ("MOU") relative to the effects of using part-time dispatchers; and WHEREAS, the City Council of the City of Canton, Illinois has determined that it is necessary and in the best interests of the City to approve the MOU. NOW THEREFORE, BE IT RESOLVED by the City Council of the City of Canton, Fulton County, Illinois. as follows: 1. That the MOU between the City and the. -Union, substantially in the form as attached hereto as "Exhibit A;" is hereby approved, and said'MOU=is to be subject to and effective, pursuant to the terms and conditions set forth therein. 2. That the Mayor and City Clerk of Canton, Illinois are hereby authorized and directed to execute and deliver,the MOU on behalf of the City of Canton. 3. Prior to the Mayor and City Clerk executing, the City Attorney is hereby authorized to negotiate and make_ any make any revisions necessary to the MOU to substantially accomplish the foregoing and the purpose of the attached MOU, subject to approval by_the.IViayor. 4. This Resolution shall be in full force and effect immediately upon the passage and approval of this Resolution and upomexecution of the MOU by the Union. PASSED THIS 23rd day of March, 2023. The City and Uniori are parties to a certain'Collective Bargaining Agreement, executed February 20, 2022, and effective May 1, 2021 through April 30, 2024 (the'"Contract! The City intends to hire part-time dispatchers due to the shortage of current full-time dispatchers ("FT Dispatchers') employed by the City. Although part-time dispatchers "PT Dispatchers") are not covered- under the Contract and the City's management rights.,perMit the luring of. said.PT Dispatchers, the City and. Union have. bargained over. the impacts of the City. .hiring PT Di'spatohers., As of the execution of thus_M0U,;the City'l as three (3) FT Dispatchers that have:previously bid .theirpreferred shifts. All .three (3)shifts are currently covered by the FT Dispatchers employed by the City: In the --,event the City wishes to provideffor additional shift coverage, which would result in overtime to =the FT Dispatchers, the.°CCity. agrees "to first ..offer the proposed shifts to the current FT Dispatchers by least hours worked (e.g. the FT.Dispatcher =with the least amount of hours :worked during -that pay Period would be offered the.shift first). If noFT.Dispatchers volunteer for the offered shift(s),, then the'Cluef of Police_may assign PT Dispatchers to cover the proposed shifts. If the proposed shifts are then not covered by PT Dispatchers, the Chief of Police reserves the.right to.;force in FT Dispatchers or otherwise -assign those shifts: as set -forth in the .Contract: _ This-MOU shall not modify or restrict the:rights -ofthe City under the.
