AN ORDINANCE REZONING PROPERTY AT 1760 EAST CHESTNUT STREET,
CANTON, ILLINOIS 61520 FROM AN R-2 TO A B-2 ZONING CLASSIFICATION
WHEREAS, Howard Zimmermann & Joseph Riley filed a petition with the Joint Planning &
Zoning Commission for the re -zoning of the real property described below, said property being
within the corporate limits of the City of Canton, Illinois; and
WHEREAS, Howard Zimmermann & Jose -ph Riley purchased the real property described below
from Michael Shockency on or about arch 2023; and
WHEREAS, the current zoning classification of the property is R-2 and it is the petitioner's
intent for the property to change to a B-2 zoning classification; and
WHEREAS, after proper notice, a public hearing on said Petition was conducted by the
Planning and Zoning Commission of the City of Canton on February 13, 2023.
WHEREAS, on February 13, 2023, the Planning and Zoning Commission recommended to the
City Council that the real property described below be rezoned pursuant to 65 ILCS 5/11-13-1
et.seq. and
WHEREAS, it is in the best interest of the City of Canton, Illinois that said property be rezoned
within the City of Canton, to meet future business growth and fit within the City's
comprehensive plan.
NOW, THEREFORE, BE IT ORDAINED by the City Council of the City of Canton, Illinois
as follows:
1. That the Canton City Council hereby finds as facts the assertions set forth above.
2. That the described real property be and is hereby rezoned from R-2 to B-2 as follows:
A part of the Southwest Quarter(1/4) of Section Twenty -Five (25), Township Seven (7) North,
Range Four (4) East of the Fourth Principal Meridian, Fulton County, Illinois described as
follows: Beginning Eleven and Ninety -One hundredths (11.91) chains East of the Southwest
corner of the Southwest Quarter (1/4) of the Southwest Quarter (1/4) of said Section Twenty -
Five (25), running thence East Four and Three Hundredths (4.03) chains; thence North Nineteen
and Fifteen Hundredths (19.15) chains to the center of the Public Road; thence West along the
center of the Public Road, Four and Six Hundredths (4.06) chains; thence South Nineteen and
Thirty (19.30) chains to the place of beginning; thence East Six (6) feet; thence South Three
Hundred Twenty (320) feet; thence West One Hundred Forty (140) feet; thence North Ninety
(90) feet; thence East Ninety (90) feet; thence North Two Hundred Thirty (230) feet; thence East
Fifty (50) feet to the point of beginning.
3. That Howard Zimmerman & Joseph Riley will pay to the City of Canton the fees required to
file a certified copy of this Ordinance with the Fulton County Clerk and Recorder of Deeds, no
later than ninety (90) days from the date of this Ordinance.
4. Upon proof of filing of a certified copy of this Ordinance, the Zoning Administrator is
directed to make the appropriate map amendments to the City of Canton to reflect said re -zoning.
5. That this Ordinance shall be in full force and effect upon its passage by the City Council of
the City of Canton and approval by its Mayor.

PASSED by the City Council of the City of Canton, Illinois and approved by the Mayor thereof
this 21st day of February, 2023 upon a roll call vote as follows:
AYES: ALDERPERSONS GOSSETT, LINGENFELTER, FRITZ, HALE, GRIMM, LOVELL,
NELSON, CHAMBERLIN.
