A regular meeting of the Canton City Council was held on December 5, 2000 in council
chambers at the Historic Depot 362 East Chestnut Street, Canton, Illinois.

INVOCATION GIVEN BY CITY CLERK NANCY WHITES.
Mayor Edwards asked for roll call at 6:30 P.M. Present -Aldermen Molleck, Hartford,
Sarff, Phillips, Nidiffer, Meade, Shores, May. Absent -None.
MINUTES OF NOVEMBER 21, 2000 MEETING. Motion by Alderman Molleck,
second by Alderman Hartford, the minutes of November 21, 2000 be accepted and
placed on file. Voice vote, motion carried unanimously.

Public Safety & Traffic.
Council Action
Motion by Alderman Shores, second by Alderman Molleck, the city to post a sign
designating handicapped parking space at Kountry Kitchen Restaurant on East
Elm Street. Discussion. Police Chief J. Michael Elam mentioned that the ADA said the
post and sign would be around $100.00. Mayor Edwards recommended doing this and
also said the City will have to pass an ordinance allowing a handicapped parking space.
Roll call. AYES -Aldermen May, Shores, Meade, Nidiffer, Phillips, Sarff, Hartford,

COMMUNICATIONS FROM MAYOR EDWARDS. Jim Elson, city attorney spoke
about the recent developments in the case of Jim Bourke vs City of Canton. A judgement
summary in favor of the City of Canton was reached. Those representing the City of
Canton appreciated all the assistance they had received.

Motion by Alderman Phillips, second by Alderman May, a Class B Supper Club
license to Don & Peggy Chapman at 154 East Elm Street be granted. Discussion.
Mayor Edwards mentioned that they were told to submit to the City Clerk quarterly
reports that 50% of their sales has to come from food sales. Roll call. AYES -Aldermen

OLD BUSINESS:
ORDINANCE - LEVYING AND ASSESSING TAXES FOR CORPORATE
PURPOSES OF THE CITY OF CANTON FOR THE FISCAL YEAR BEGINNING
MAY 1, 2000, AND ENDING APRIL 30, 2001. First reading, read by title. Motion by
Alderman Sarff, second by Alderman Phillips, the ordinance be placed upon its
passage. Discussion. Administrative Assistant Jim Snider reviewed again the City of
Canton's Assesed Valuations from the year 1989 to 1999, which explains the 14%
reduction. Roll call. AYES -Aldermen Molleck, Hartford, Sarff, Phllips, Nidiffer,
Meade, Shores, May. NAYS -None. 8 AYES, 0 NAYS, 0 ABSENT. Motion carried.

ORDINANCE -AUTHORIZING THE CITY OF CANTON TO BORROW FUNDS
FROM THE PUBLIC WATER SUPPLY LOAN PROGRAM. First reading, read by
title. Motion by Alderman Molleck, second by Alderman Shores, the ordinance be
placed upon its passage. Roll call. AYES -Aldermen May, Shores, Meade, Nidiffer,
Phillips, Sarff, Hartford, Molleck. NAYS -None. 8 AYES, 0 NAYS, 0 ABSENT.

ORDINANCE -ANNEXING AND RE-ZONING CERTAIN TERRITORY TO
THE CITY OF CANTON, LOCATED AT 2076 NORTH MAIN STREET, TO AN
R-4. First reading, read by title. Motion by Alderman Phillips, second by Alderman
Nidiffer, to suspend the rules for the purpose of placing the ordinance upon its
passage. Roll call. AYES -Aldermen Molleck, Hartford, Sarff, Phillips, Nidiffer, Meade,
Shores, May. NAYS -None. 8 AYES, 0 NAYS, 0 ABSENT. Motion carried.

ORDINANCE - GRANTING A R-4 SPECIAL USE PERMIT FOR THE
METHODIST MEDICAL CENTER OF ILLINOIS FOR PROPERTY LOCATED
AT 2076 NORTH MAIN STREET, CANTON, ILLINOIS. First reading, read by title.
Motion by Alderman Phillips, second by Alderman May, to suspend the rules for the

USE PERMIT FOR PROPERTY AT 28 EAST WALNUT STREET, CANTON,
ILLINOIS. First reading, read by title.
RESOLUTION - INAUGURATING THE 175TH ANNIVERSARY
CELEBRATION OF THE FOUNDING OF CANTON. First reading, read in its
entirety by Jason Parkinson SAR winner at Canton High School where he attends. Nancy
Elson chairman of the Heritage Commitee introduced Jason. Lou Betzer mentioned that
celebrations will be held starting December 19 at the High School winter concert, and is
asking for the City Councils approval of all functions planned for celebrating the 175th
anniversary. Motion by Alderman Sarff, second by Alderman Molleck, to offer their
support to the efforts of the celebration of 175th celebration for the founding of
Canton. Voice vote, motion carried unanimously.

ENGINEERING SERVICES AND SEEKING BIDS FOR A PROPOSED WATER
TRANSMISSION MAIN FROM CANTON LAKE TO THE CITY OF CANTON.

second by Alderman Hartford, the minutes of December 5, 2000 be accepted and

BILLS FOR NOVEMBER. Motion by Alderman Sarff, second by Alderman
Nidiffer, to approve all bills authorized and the additional bills from Police
Benevolent & Protective Association for annual dues Police Chief J. Michael Elam
and Deputy Chief Donald F. Edwards in the amount of $142 each; Henry Pratt $550
for Spoon River College Water Meter; Card Services $468.94; and to approve
Wastewater Treatment Plant to order a piece of equipment. Roll call. AYES -
Aldermen May, Shores, Meade, Nidiffer, Phillips, Sarff, Hartford. NAYS -None. 7

EXECUTIVE SESSION - FOR PURPOSE OF RANDOLPH BUILDING
LITIGATION. Motion by Alderman Sarff, second by Alderman Nidiffer, to go into
executive session for the purpose of discussing Randolph Building Litigation. Roll
call. AYES -Aldermen Hartford, Sarff, Phillips, Nidiffer, Meade, Shores, May. NAYS -
None. 7 AYES, 0 NAYS, 1 ABSENT. Motion carried.
The regular scheduled council meeting convened at 6:35 P.M. for executive session.
The minutes of the executive session are on file in the office of the City Clerk for review.
The regular scheduled council meeting reconvened in open session at 6:48 P.M.
Jim Elson city attorney, reported from the executive session...The City Council gave
authority to the city attorney to bring action for demolition of the East 1/2 of the
Randolph Building that is located on East Side Square. The city had filed a suit against
the owner Rick Lillie over some thirty days ago. The position now is Rick Lillie will deed
over to the City of Canton at no expense this Randolph Building. Rick Lillie will take care
of all mortgages and tax liens on the property. There are defects in the front of the
building that faces the square, and Rick Lillie has promised to take care of them so the
building can pass inspection.
Mayor Edwards mentioned that there could be a possible change, as the building could
come under new ownership. Mayor Edwards recommended to accept this agreement, and
in future meetings to accept bids for demolition.
Motion by Alderman Sarf'f, second by Alderman May, the City of Canton to enter
into an agreement with Rick Lillie for acceptance of the Randolph Building as
outlined by city attorney Jim Olson. Roll call. AYES -Aldermen May, Shores,
Meade, Nidiffer, Phillips, Sarff, Hartford. NAYS -None. 7 AYES, 0 NAYS, 1
ABSENT. Motion carried unanimously.
