A regular meeting of the Canton City Council was held November 19, 2002, in the
council chambers at the Historic Depot, 50 North 4th Avenue, Canton, Illinois.
PLEDGE OF ALLEGIANCE OPENED THE MEETING FOLLOWED BY THE
INVOCATION GIVEN BY NANCY WHITES.
Mayor Bohler asked for roll call at 6:30 p.m. Present -Aldermen Bob Molleck, Jim
Hartford, Larry Sarff, Craig West, Les Carl. JoAnne Shores, and Mary Fillingham.
Absent: None.
MINUTES OF NOVEMBER 5th, 2002 MEETING. Motion and second by Aldermen
Molleck/Hartford, the minutes of November 5th, 2002 be accepted and placed on file.
Voice vote, motion carried unanimously.
BILLS FOR OCTOBER. Motion and second by Aldermen Hartford/West, all bills
properly presented be paid. Roll call. AYES -Aldermen Fillingham, Shores, Meade,
Carl, West, Sarff, Hartford, Molleck. NAYS -None. 8 AYES, 0 NAYS, 0 ABSENT.
Motion carried.
COMMITTEE REPORTS:
Finance.
Council Action
Motion and second by Aldermen HartfordlFillingham, to accept the low quote to buy a
truck for Wastewater Treatment Plant from Green Chevrolet in the amount of
$21,951.27, and with atrade-in of $2500. Roll call. AYES -Aldermen Molleck,
Hartford, Sarff, West, Carl, Meade, Shores, Fillingham. NAYS -None. 8 AYES, 0
NAYS, 0 ABSENT. Motion carried.
Motion and second by Aldermen Hartford/West, to accept the #12 pay request from
Leander Construction in the amount of $37,901.09 for the Water Transmission Line
Project. Roll call. AYES -Aldermen Fillingham, Shores, Meade, Carl, West, Sarff,
Hartford, Molleck. NAYS -None. 8 AYES, 0 NAYS, 0 ABSENT. Motion carried.
Motion and second by Aldermen Hartford/Carl, to accept the fmal pay request #6 from
Thomas Industrial in the amount of $10,706.30 for the Standpipe Rehabilitation Project.
Roll call. AYES -Aldermen Molleck, Hartford, Sarff, West, Carl, Meade, Shores,
Fillingham. NAYS -None. 8 AYES, 0 NAYS, 0 ABSENT. Motion carried.

currently under discussion. Paul mentioned the oral presentation to the Council, is given
for two reasons. First, to update you on the significant accomplishments of this volunteer
group; and second, to point out that a number of the activities currently under discussion
are partially or completely responsibilities of City government. After you have had an
opportunity to study this material, we hope an activity can be arranged at which the
volunteer community and the City government representatives can discuss both the needs
and opportunities presently before us with the aim of setting priorities, goals and
timelines for future action.
Paul also highlighted the Canton Community Resources Committee Initiatives. The 336
Coalition, Central Illinois Ag Coalition, Canton Area Development Corporation,
Rebuilding Together with Christmas in April, and the Canton Community Leadership
Academy.
Motion and second by Aldermen Molleck/West, to approve of the appointment of David
Byerly as Economic Development Director for the City of Canton, and to accept the
Employment Contract and Memorandum of Understanding. Discussion. Dave White
who is the chairman of the Downtown Revitalization committee pointed out that the
group of men have met for 2 '/2 years to approve the economy in Canton. And thus the
Canton Area Development Corporation was formed, and their task was to promote
development and commerce in Canton. A total of 55 businesses contributed to this
committee. The City Council made commitments as well. And by doing the City gave
the CADC committee the task to secure that person. We are extremely pleased that we
found that person, who is an energetic young man. He has a wife and 8 year old son and
11 year old daughter and they will move to Canton after Christmas. David will begin
December 2, 2002. Our original thought was to employ him for three years, but Illinois
State Statute says, the appointment runs concurrent with the Mayor's term left in office,
which would be 2 years and 5 months.
Alderman Carl mentioned that the contract still sounds like a 3 year contract. City
Attorney Ron Weber explained that the contract says David Byerly would be paid for 36
months, but he will not be paid beyond what the State Statute says.
Mayor Bohler said, if he performs, we should keep this person beyond the term of the
mayor. Alderman Meade thanked Dave White and the committee for their tireless
commitment and felt the time frame was shorter to him than anticipated, and I trust their
expertise in hiring of this individual. Alderman Molleck was in agreement also. Roll
call. AYES -Aldermen Fillingham, Shores, Meade, Carl, West, Sarff, Hartford,
Molleck. NAYS -None. 8 AYES, 0 NAYS, 0 ABSENT. Motion carried.
Mayor Bohler brought up about the common wall between the Drow Building and
Scrapebook Dreams who presently own the former Beckner Building. Alderman Bohler
said he had met with the owners Bob Beckner and Mr. & Mrs. Jeffrey Hauk, and they
agreed to sign an agreement that accepts the wall after the building is demolished and
brought up to specifications.
Motion and second by Aldermen Meade/Sarff, to accept the agreement of covenant
running with the land with Bob Beckner, and Jeffrey L. and Catherine L. L. Hauk. Roll

NEW BUSINESS:
ORDINANCE -AMENDING TITLE 5, CHAPTER 8, SECTION 3, OF THE
CANTON MUNICIPAL CODE, RELATING TO BURNING REGULATIONS.
First reading, read by title. City Attorney Ron Weber explained, this ordinance adds
recreational fires, this does not change any dates currently in the ordinance.
ORDINANCE -ESTABLISHING "NO PARKING" ON THE WESTSIDE OF
AVENUE B, FROM LOCUST STREET TO CHESTNUT STREET, IN THE CITY
OF CANTON. First reading, read by title.
ORDINANCE - LEVYING AND ASSESING TAXES FOR CORPORATE
PURPOSES OF THE CITY OF CANTON, ILLINOIS, FOR THE FISCAL YEAR
BEGINNING MAY 1, 2002, ENDING APRIL 30, 2003. First reading, read by title.
RESOLUTION -APPROVING ADDITIONAL STREET LIGHTING LOCATED
AT THE INTERSECTION OF SOUTH 2ND AVENUE, AND EAST WALNUT
STREET, CANTON, ILLINOIS. First reading, read by title. Motion by Aldermen
CarUFillingham, the resolution be adopted. Roll call. AYES -Aldermen Molleck,
Hartford, Sarff, West, Carl, Meade, Shores, Fillingham. NAYS -None. 8 AYES, 0
NAYS, 0 ABSENT. Motion carried. Resolution #3639.
Mayor Bohler thanked everyone for their hard work and support.
Footnote: An Ordinance Amending Section 1-8-7 of the Canton Municipal Code for the
position of Economic Director was listed on the Agenda, but was not presented. The
ordinance will not be forthcoming as council approved earlier on under the Mayor's
Communication, the Employment Contract and Memorandum of Understanding.
ADJOURNMENT. Motion by Aldermen Hartford/Molleck, to adjourn. Voice vote,
motion carried unanimously. The regular scheduled council meeting adjourned at 7:01

Motion and second by Aldermen CarUShores, to allow the former City Hall to be sold by
bids. Discussion. City Attorney Ron Weber commented that an ordinance would be
needed. Roll call. AYES -Aldermen Molleck, Hartford, Sarff, West, Carl, Shores,
Fillingham. NAYS -None. 7 AYES, 0 NAYS, 1 ABSENT. Motion carried.
Motion and second by Aldermen CarUSarff, to accept the change order on the Drow
Building of River City Demolition for contract times of adding 16 days to the original
contract. Discussion. Mayor Bohler stated the demolition will be moved back a week to
allow the Christmas Walk. River City Demolition will be working on 1st Avenue and
should not affect the square. Voice vote, motion carried unanimously.
