A regular meeting of the Canton City Council was held on March 19th, 2002 in council
chambers at the Historic Depot 50 North 4t" Avenue, Canton, Illinois.
PLEDGE OF ALLEGIANCE OPENED THE MEETING FOLLOWED BY THE
INVOCATION GIVEN BY CITY CLERK NANCY WHITES.
Mayor Jerry Bohler asked for roll call at 6:30 p.m. Present -Aldermen Bob Molleck,
Jim Hartford, Larry Sarff, Craig West, Kevin Meade, JoAnne Shores, Mary Fillingham.
Absent -Alderman David Nidiffer.
MINUTES -MARCH 5TH, 2002 COUNCIL MEETING. Motion and second by
Aldermen Molleck/Hartford, the minutes of March Ste, 2002 be accepted and placed
on file. Voice vote, motion carried unanimously.
COMMITTEE REPORTS.
Finance.
Council Action
Motion and second by Aldermen Hartford/Sarff, bills be approved for payment.
Roll call. Aldermen Fillingham, Shores, Meade, West, Sarff, Hartford, Molleck. NAYS
-None. 7 AYES, 0 NAYS, 1 ABSENT. Motion carried.
Motion and second by Aldermen Hartford/West, to add on to the additional bills of
...Maurer Stutz, Inc. for professional services in the amount of $5,158.50, $721.00
and $170.00, and paid from the Water Project Special Account. Roll call. AYES -
Aldermen Molleck, Hartford, Sarff, West, Meade, Shores, Fillingham. NAYS -None. 7
AYES, 0 NAYS, 1 ABSENT. Motion carried.
Motion and second by Aldermen Hartford/Sarff, to renew the City of Canton's
annual membership in the Fulton County Tourism Council in the amount of
~ $300.00. Roll call. AYES -Aldermen Fillingham, Shores, Meade, West, Sarff,
Hartford, Molleck. NAYS -None. 7 AYES, 0 NAYS, 1 ABSENT. Motion carried.
Motion and second by Aldermen Hartford/Sarff, to approve the repair of a storm
pump motor at the Wastewater Treatment Plant due to a emergency situation from
Linden & Company for parts in the amount of $1,756.00; and Melton Electric for a
motor rewind in the amount of $2,150 for the Wastewater Treatment Plant. Roll
call. AYES -Aldermen Molleck, Hartford, Sarff, West, Meade, Shores, Fillingham.
NAYS -None. 7 AYES, 0 NAYS, 1 ABSENT. Motion carried.
Motion and second by Aldermen Hartford/Molleck, to waive the bidding for a
Digital Camera and ID system for the Police Department. Roll call. AYES -
Aldermen Fillingham, Shores, Meade, West, Sarff, Hartford, Molleck. NAYS -None. 7
AYES, 0 NAYS, 1 ABSENT. Motion carried.
Motion and second by Aldermen Hartford/Molleck, to approve a digital mug shot
system from Total Solutions, Inc. in the amount of $3,450, plus approximately $200
for a color printer; and a new ID system in the amount of $2,790.00, (The total
amount is $6,440.00.) and paid from the gaming funds of the Police Department.

Motion and second by Aldermen Hartford/Meade, to approve the repairs for a air
compressor from Combined Fluid Products in the amount of $679.46; and up to
$350.00 to Manufacturing Services for the water treatment plant. Roll call. AYES
- Aldermen Molleck, Hartford, Sarff, West, Meade, Shores, Fillingham. NAYS -None.

Legal & Ordinance.
Council Action
Motion and second by Aldermen Fillingham/Sarff, to allow Brew-N-Cue of 113 East
Elm Street a temporary Beer Garden license on April 20th of a fund raiser for
ABATE from 12 noon to 11:00 p.m. Voice vote, motion carried unanimously.
Motion and second by Aldermen Molleck/Hartford, to accept a petition circulated
by Kay Bitner asking the elected officials to reconsider their vote to give Rick Lillie
a balloon loan. Discussion. Mayor Bohler read the heading on the petition and stated
the City has not granted a loan to Rick Lillie so we should not have to reconsider. Voice
vote, motion carried unanimously.
Mayor Bohler mentioned that he had received a letter from Jim Elson Sr., requesting to
postpone discussion on the Drow Hardware Building until next week. Mayor Bohler said
he spoke to the owner Rick Lillie and Rick had stated that he will offer this building free
and clear.
Motion and second by Aldermen Molleck/Hartford, to approve postponing any
discussion of the Drow Hardware Building until contacted by Jim Elson. Voice vote,
motion carried unanimously.

COMMUNICATIONS FROM MAYOR JERRY BOHLER. Motion and second by
Aldermen Sarff/Hartford, the appointment of Aldermen Craig West to the Fulton
County Tourism Council be confirmed. Voice vote, motion carried unanimously.
Motion and second by Aldermen Molleck/West, at the recommendation of Police
Chief Mike Elam, the appointment of Joey Boggs as Auxiliary Police officer be

Mayor Bohler mentioned that Alderman David Nidiffer's replacement will be announced
at the Apri12 council meeting.
OLD BUSINESS
ORDINANCE -AMENDING 7-3-2 AND 7-3-3 OF TITLE 7, AND AMENDING 8-
18-1, 8-14-4 AND 8-18-6 OF TITLE 8, OF THE CANTON MUNICIPAL CODE,
RELATING TO GARBAGE DISPOSAL SYSTEM. Second reading, read by title.
Motion and second by Aldermen Molleck/Fillingham, to place the ordinance on its
passage. Roll call. AYES -Aldermen Fillingham, Shores, Meade, West, Sarff,
Hartford, Molleck. NAYS- None. 7 AYES, 0 NAYS, 1 ABSENT. Motion carried.

NEW BUSINESS
ORDINANCE - AMENDING ORDINANCE NO. 959, ENTITLED "AN
ORDINANCE INTIATING COOPERATIVELY DESIGNATED AN
ENTERPRISE ZONE". First reading, read by title. City Attorney Ron Weber
explained about the enterprise zone, which originally was all of the IHC site. Then the
city enacted an additional from IHC area down the railroad tracks that ran along the
highway to Spoon River College road, and to the prison site and the Industrial Park. (The
Industrial Park is not part of the Enterprise Zone that is TIF funds.) Continue down Stn
Avenue the state highway, to skyrocket junction, then, to the east road south of White
Chapel Cemetery, where 80 acres are on the north and the purpose ethanol plant is on the
south. The property is currently owned by Freeman Mine. The Fulton County Board has
not held a public hearing due to reasons beyond their control. Alderman Hartford wanted
to know what was different about this ordinance to the one already passed? Ron
f explained, we thought everything was set from the county level, and found out it is not
and we have to adopt an ordinance and resolution. The city acted before they should
~ have. Motion and second by Aldermen Sarff/Molleck, to table this ordinance and
the following resolution. Voice vote, motion carried unanimously.
RESOLUTION - APPROVING A COOPERATION AGREEMENT BETWEEN
THE CITY OF CANTON, FULTON COUNTY ILLINOIS. ~'~(Tlie resolution agrees
to support the efforts of the City of Canton, Illinois in maintaining and supporting
the Canton/Fulton County Enterprise Zone designation from the Illinois
Department of Commerce and Community Affairs, located in both the City and
County.)
EXECUTIVE SESSION - NEGOTIATIONS FOR THE FIRE UNION
CONTRACT. (The Pending/Threatened Litigation regarding the Drow Hardware
Building that was on the agenda will be tabled until Jim Elson contacts the Mayor.)
Motion and second by Aldermen Hartford/Sarff, to go into executive session for fire
negotiations. Roll call. AYES -Aldermen Molleck, Hartford, Sarff, West, Meade,
Shores, Fillingham. NAYS -None. 7 AYES, 0 NAYS, 1 ABSENT. Motion carried.
