A regular meeting of the Canton City Council was held on November 18, 2003 in the
Council Chambers at the Historic Depot, 50 North 4th Avenue, Canton, Illinois.
PLEDGE OF ALLEGIANCE OPENED THE MEETING FOLLOWED BY THE
INVOCATION GIVEN BY NANCY WHITES, CITY CLERK.
Mayor Bohler asked for roll call at 6:30 p.m. Present -Aldermen Jim Hartford, Bob
Molleck, Craig West, Larry Sarff, Elny Harn, Mary Fillingham, Rick Reed. Absent -
Alderman Les Carl was ill.
MINUTES OF NOVEMBER 4, 2003 MEETING. Motion and second by Aldermen
Molleck/Hartford, the minutes of November 4, 2003 be accepted and placed on file.
Voice vote, motion carried unanimously.
BILLS FOR OCTOBER. Motion and second by Aldermen Sarff/Fillmgham, all bills
properly approved be paid. Roll call. AYES -Aldermen Reed. Fillingham, Harn, Sarff,
West, Molleck, Hartford. NAYS -None. 7 AYES, 0 NAYS, 1 ABSENT. Motion
carried.
COMMITTEE REPORTS:

Council Action
Motion and second by Aldermen Sarff/West, to pay the United Paving for MFT for 2003
Maintenance Overlay Contract in the amount of $241,075.05. Roll call. AYES -
Aldermen Hartford, Molleck, West, Sarff, Harn, Fillingham, Reed. NAYS -None. 7
AYES, 0 NAYS, 1 ABSENT. Motion carried.
Motion and second by Aldermen Sarff/Fillingham, to allow the purchase of 5 Mobile
Data Computer Replacements, plus two (2) docking stations for the patrol vehicles in the
amount of $34,275.00 from CDS Office Technologies. Discussion. Police Chief Don
Edwards suggested paying from the 911 emergency board of $8,638.02, Fulton County
Chief's Association grant funds of $3,528.28, and from DUI $8,855.00, Gaming Fund
$13,506.00. Don said changing the computers is not as simple as was anticipated. (After
adding up the figures with the $4,200 included in the total was $38,727.30. When I
contacted Police Chief Don Edwards he had me take out from the Budgeted amount of
$4,200.) Roll call. AYES -Aldermen Reed, Fillingham, Harn, Sarff, West, Molleck,
Hartford. NAYS -None. 7 AYES, 0 NAYS, 1 ABSENT. Motion carried.
Motion and second by Aldermen Sarff/Molleck, the approval for the Police Department
to purchase a magnetic combination lock for $1,750.00 for parts and labor from S & S
Builders Hardware Company of Peoria. Roll call. AYES -Aldermen Hartford, Molleck,
West, Sarff, Harn, Fillingham, Reed. NAYS -None. 7 AYES, 0 NAYS, 1 ABSENT.

COMMUNICATIONS FROM MAYOR BOHLER. Oath of Office to Firefighter
Mark Hanlin. Mark was given the Oath by Nancy Whites, City Clerk.
Tax Levy. Budget Director Julie Smick gave a brief report. Overall on the Tax Levy
~r.. there is $70,000 increase or a percentage of 4.81 %. The fire pension increased by
$31,000 ,which is set by an actuary. Also an increase in the Illinois Municipal
Retirement Fund over all of 5%. There are a couple of items that have decreased, the
Police Pension, and we have lower premiums on the Workman's Comp by $25,000. The
City won't need a "Truth & Taxation" because the increase is not more than 5%. The
City is making a good effort of sales tax increase, as it is a more fair tax.
Mayor Bohler mentioned as an informational item, the Telecommunication Tax was sent
out again and they did receive it and funding will be July 1, 2004.
Council members are to clean off the top of their desk as a wedding will take place next
week.

AND ROBERTA NELSON AT THE ADDRESS OF 855 EAST ELM STREET,
FOR AN ELECTRONIC SERVICE SHOP. (RENEWAL OF LICENSE.) Second
reading, read by title. Motion and second by Aldermen West/Fillingham, the ordinance
be placed on its passage. Roll call. AYES -Aldermen Reed, Fillingham, Harn, Sarff,

ORDINANCE -REZONING CERTAIN PROPERTY OF ARTIE ELLSWORTH
AT THE ADDRESS OF EAST LOCUST STREET, CANTON, ILLINOIS, FROM
R-3 TO AG-1. Second reading, read by title. Motion and second by Aldermen
ReedlHartford, the ordinance be placed on its passage as amended. (The ordinance should
list Walnut Street, not Locust.) Roll call. AYES -Aldermen Hartford, Molleck, West,

ORDINANCE - VACATING A PART OF AVENUE E. (LESTER & EVAMAE

ORDINANCE -REZONING CERTAIN PROPERTY OF KATHY S. SMITH AT
THE ADDRESS OF 533 EDGEWOOD PLACE FROM R-2 TO B-1 ZONING
CONFIGURATION. Second reading, read by title. Motion and second by Aldermen
Sarff/Harn, to send the ordinance back to the Planning & Zoning Commission.

RESOLUTION - APPROVING A PRE-ANNEXATION AGREEMENT
BETWEEN THE CITY OF CANTON AND ARNOLD AND GERALDINE
GROVES. First reading, read by title. Motion and second by Aldermen West/Hartford,
the resolution be adopted. Roll call. AYES -Aldermen Hartford, Molleck, West, Sarff,
Harn, Fillingham, Reed. NAYS -None. 7 AYES, 0 NAYS, 1 ABSENT. Motion
carried. Resolution being #3669.
RESOLUTION - INTERGOVERNMENTAL AGREEMENT FOR FIRE
FIGHTING AND EMS ASSISTANCE BETWEEN THE CITY OF CANTON AND
SPOON RIVER COLLEGE. Mayor Bohler said this would be presented at the next
council meeting.
RESOLUTION -INSTRUCTING THE CITY CLERK TO PROCESS ALL
OUTGOING MAIL FOR THE GENERAL ADMINISTRATION OF THE CITY
OF CANTON. Mayor Bohler said this would be presented at the next council meeting.
ORDINANCE -AMENDING TITLE 1, CHAPTER 11, OF THE CANTON
MUNICIPAL CODE REGARDING THE CITY TREASURER. First reading, read
by title.
ORDINANCE - PLACING A NON-HOME RULE MUNICIPAL RETAILERS
AND SERVICE OCCUPATIONAL TAX OF '/: OF 1% ON THE SALE OF
TANGIBLE PERSONAL PROPERTY OTHER THAN FOOD AND MEDICINE
PURCHASED AT RETAIL, AND SALE OF SERVICE FROM A RETAILER AS
DEFINED IN 65 ILLS 5/8-11-1.3 AND 11-1.4 WITHIN THE CITY OF CANTON,
ILLINOIS FOR EXPENDITURE ON PUBLIC INFRASTRUCTURE AND
PROPERTY TAX RELIEF, PROPOSITION TO BE SUBMITTED AT THE
ELECTION TO BE HELD MARCH 16, 2004. First reading, read by title.
ORDINANCE - OF THE CITY OF CANTON, CREATING THE POSITION OF
ADMINISTRATIVE ASSISTANT, MODIFYING CHAPTER 9, OF THE
CANTON MUNICIPAL CODE TO PRESCRIBE THE DUTY OF THE CITY
CLERK AND DESIGNATE THE MAYOR CUSTODIAN OF CERTAIN
MUNICIPAL RECORDS. First reading, read by title. Alderman Sarff asked if the
Clerk's duties are mandated by City and State? City Attorney Ron Weber answered both,
we are trying to define more clearly the duties both of the Clerk and the Mayor. And the
city has the right to act upon.
