A regulaz meeting of the Canton City Council was held on July 1, 2003 in the Council
Chambers at the Historic Depot, 50 North 4`~ Avenue, Canton, Illinois.
PLEDGE OF ALLEGIANCE OPENED THE MEETING, FOLLOWED BY THE
INVOCATION GIVEN BY CITY CLERK NANCY WHITES.
Mayor Bohler asked for roll call at 6:30 p.m. Present -Aldermen Jim Hartford, Craig
West, Larry Sazff, Elny Harn, Mary Fillingham & Rick Reed. Absent - Aldermen Bob
-~ Molleck, Les Cazl, both are on vacation.
~,) MINUTES OF June 17, 2003 MEETING. Motion and second by Aldermen
HartfordlWest, the minutes of June 17, 2003 be accepted and placed on file. Voice vote,
motion carried unanimously.
COMMITTEE REPORTS:
Public Safety & Traffic.
Council Action
City Attorney Ron Weber gave an update on Romine Disposal. Ron said that Clif
O'Brien, Clark Wilson, Ron Weber, Rex Still and Sue England attended the court hearing
this morning with Romine Disposal before Judge Gene Taylor. The hearing was to
determine if Romine Disposal had complied with the court order of removal gazbage and
the dumpsters to remove the threat of a mosquito problem. Gordon Romine told the court
today he could do more. So Judge Taylor gave him 24 hours, which is till Thursday
morning. Rex Still will decide if he has eliminated the health threat on Grant Place. If
not, the City takes over and removes the gazbage and will have to have assistance from
other entities to handle the roll offs. The City will then have liens on the dumpsters, and
some others have liens as well on the roll offs. But the Judge has assured that the City
takes them over.
Streets & Garbage.
Council Action
Motion and second by Aldermen Hartford/Harn, to accept the low bid from McCann
Industries, Inc for one 580 Case Super M 203 Model Backhoe, at a unit price of
$65,632.48, and Clif O'Brien's recommendation on payment. Discussion. Clif O'Brien
said he had recommended at the committee meeting last week to enter into a 5 year lease
program, then after the five yeazs to pay off the balance with reimbursement funds from
MFT. Clif is now recommending to pay out of the Gazbage Depreciation Account or
Working Capitol funds $30,000 now, and $30,000 next yeaz. Roll call. AYES -
Aldermen Reed, Fillingham, Harn, Sarff, West, Hartford. NAYS -None. 6 AYES, 0
NAYS, 2 ABSENT. Motion carried.
Motion and second by Aldermen HartfordlReed, to accept the low bid of United Pavin~
for the LAPP Project FY04 on work on East Chestnut Street from 11th Avenue to 20
Avenue in the amount of $297,986.39. Roll call. AYES -Aldermen Hartford, West,
Sazff, Hare, Fillingham, Reed. NAYS - None. 6 AYES, 0 NAYS, 2 ABSENT. Motion
carried.

City Council meeting July 1, 2003
Motion and second by Aldermen Reed/Fillingham, to approve of using Hot Sand Seal in
the amount of $14,775.00 to repair the Campground road, and paid from the Lake
Development account. Roll call. AYES -Aldermen Reed, Fillingham, Harn, Sarff,
West, Hartford. NAYS -None. 6 AYES, 0 NAYS, 2 ABSENT. Motion carried.
Public Works, Water & Sewer.
Council Action
Motion and second by Aldermen Harn/Hartford, to approve the low quote from Water
Products Co. for a reduced pressure principal backflow preventer, (RPZ) in the amount of
$1,225.00 plus shipping for the Water Department. Roll call. AYES -Aldermen
Hartford, West, Sarff, Harn, Fillingham, Reed. NAYS -None. 6 AYES, 0 NAYS, 2
ABSENT. Motion carried unanimously.
Motion and second by Aldermen Harn. West, to approve of the pay request #2 from
Seward Construction for Phase 1 Storm Building, in the amount of $118,944.77, and the
retainage of $31,532.68, and has been recommended by Maurer Stutz Inc. Roll call.
AYES -Aldermen Reed, Fillingham, Harn, Sarff, West, Hartford. NAYS -None. 6
AYES, 0 NAYS, 2 ABSENT. Motion carried.
COMMUNICATIONS FROM MAYOR BOHLER. Mayor Bohler said that
RailAmerica is the agent for Toledo, Peoria & Western Railway Corp. They sent a letter
to the City Treasurer on June 16, 2003 referring to Lease/License Number TPW 173829
("Agreement"), dated June 1, 1965, between Toledo, Peoria & Western Railway Corp.
and the City, covering the use of land located at or near Canton, Illinois, for 1,800X 8"
force sewer main to oxidation pond between SS# 7277+00 and 7259+00 with crossing @
SS#727=00 and a 60" sewer main crossing @SS# 7406+15. The letter continues...our
current annual payment is $556,97 per annum with a CPI escalation. TP&W is offering
the ability to "buy our" our Agreement, for aone-time fee of $3,500.00 to end all future
annual rental payments. This buy out would effectively change the terms of the
agreement to preclude any future rental increases or bill by TP&W. There are five other
Agreements in the amounts of $640.34 for 1,303'X 8" PVC forced sewer main
encroachment, $392.53 for 8" Water main pipe line crossing, $515.00 fora (1) 8"Water
main & (1) 10" Sanitary sewer pipe line crossing, $328.88 fora 4" Water pipe line
crossing, & $442.90 fora 6" Water main pipe line crossing, that are the same terms as the
first one.
Alderman Reed asked if this is a one time offer? Ron Weber said it is according to the
letter. The deadline for this was July 1 ~`, but the City did get an extension until July 15"'.
Alderman Sarff said we should take advantage of this, but because of our shortfall in the
Budget we don't have the funds. Alderman Sarff asked if they would take '/2 payment
this year, and '/2 next year? Ron Weber said he would ask.
Clif O'Brien said they could be paid from the Water & Sewer fund.
Motion and second by Aldermen Sarff/West, to accept the TP&W offer of one-time buy
out fee of $3,500 to end all future annual rental payments. Roll call. AYES -Aldermen
Hartford, West, Sarf, Harn, Fillingham, Reed. NAYS -None. 6 AYES, 0 NAYS, 2
ABSENT. Motion carried.
Mayor Bohler said he was contacted by Tom Hines of the Spoon River College

City Council meeting July 1, 2003
Clif O'Brien mentioned that spraying will be done on Wednesday July 2"d and Thursday
July 3rd in the Myrtle Street area as a precautionary because of the 4th of July celebration.
Mayor Bohler reminded the Aldermen if you want to be in the 4th July parade be at Alice
Ingersoll Gym by 6:15 p.m. Will ride in the 40&8.
OLD BUSINESS:
ORDINANCE -REPLACING TITLE 3, CHAPTER 8, SECTION 3 OF THE
MUNICIPAL CODE, FOR THE CITY'S APPLICATION PROVISIONS AND
POWERS OF DUTIES. Second reading, read by title. Motion and second by
Aldermen Harn/Hartford, to place the ordinance on its passage. Discussion. Mayor
Bohler said this does not allow the mayor sole authority to issue liquor license, that still
comes from the Liquor Commissioners. Roll call. AYES -Aldermen Reed, Fillingham,
Harn, West, Hartford. NAYS -Alderman Sarff. 5 AYES, 1 NAY, 2 ABSENT. Motion
carried. Ordinance being #1759.
ORDINANCE -AMENDING TITLE 3, CHAPTER 8, SECTION 11 OF THE
MUNICIPAL CODE OF THE CITY OF CANTON, LICENSE RESTRICTIONS
ADDING AN ADDITIONAL PARAGRAPH FOR ALL RESTAURANTS AND
SUPPER CLUB LICENSE HOLDERS. Second reading, read by title. Motion and
second by Aldermen Hartford/Harn, the ordinance be placed on its passage. Roll call.

RESOLUTION -FOR APPROPRIATING $287,000 FOR MOTOR FUEL TAX
FUNDS. First reading, read by title. Motion and second by Aldermen Hartford/Reed,
