PLEDGE OF ALLEGIANCE OPENED THE MEETING FOLLOWED BY THE INVOCATION GIVEN BY NANCY WHITES, CITY CLERK. Mayor Boher asked for roll call at 6:30 p.m. Present -Aldermen Jim Hartford, Bob Molleck, Larry Sarff, Elny Harn, Les Carl, Mary Fillingham, Rick Reed. Absent. - Alderman Craig West. MINUTES OF June 3, 2003 MEETING. Motion and second by Aldermen Hartford/West, the minutes of June 17, 2003 be accepted and placed on file. Voice vote, motion carried unanimously. COMMITTEE REPORTS: Public Safety & Traffic. Council Approval Motion and second by Aldermen CarUHarn, to approve the final pay request of A.E.H. Construction for the Main & Elm Street realinement, for a total of $32,765.50, and with retainage of 5% $1,724.50. Roll call. AYES -Aldermen Hartford, Molleck, Sarff, Harn, Carl, Fillingham, & Reed. NAYS -None. 7AYES, 0 NAYS, 1 ABSENT. Motion carried. Motion and second by Aldermen CarUReed, to accept the Change in Plans from A.E.H. Construction for the Main & Elm Street realinement, with a net deduction of $3,241.34, addition of $756.28, and addition of $315.42, for a total deduction of $2,169.64. Roll call. Motion and second by Aldermen Carl/Hartford, to approve of obtaining IDOT's permission to expend the MFT funds for FY 2004, in the amount of $78,000 for the A.E. H. Motion and second by Aldermen Carl/Reed, to approve of the final pay request for River City Demolition on the Drow Building in the amount of $$2,932.06 for retainage, and current work in the amount of $987.23. Motion and second by Aldermen CarUFillingham, the approval to seek bids for aback- hoe with the option of lease. Voice vote, motion carried unanimously. Motion carried. 298 City Council meeting 6-17, 2003 Motion and second by Aldermen Fillingham/Hartford, to waive the Building Permit Fee to the Canton Park District in the amount of $9,183.00. Negotiations, Grievance & Personnel. Council Action Motion and second by Aldermen Sarff/Molleck, to approve of the hiring of a Temporary Firefighter. Discussion. Fire Chief John Stanko mentioned that one of the fireman is on anon related duty illness, and will be out for a period of time. Roll call. AYES - Hartford, Molleck, Sarff, Harn, Carl, Fillingham, Reed. NAYS -None. 7 AYES, 0 NAYS, 1 ABSENT. Motion carried. COMMUNICATIONS FROM MAYOR BOHLER. Motion and second by Aldermen Fillingham/Reed, to approve the Beer Garden License of Players Lounge for June 28. Discussion. Mayor Bohler mentioned this was approved by the Liquor Commission. Voice vote, motion carried unanimously. Mayor Bohler asked the committee members of the Clerical Committee to allow on the Agenda the Beer Garden License for White Oaks. Motion and second by Aldermen Molleck/Hartford, to allow White Oaks request for Beer Garden License as a fund raiser for Youth Acres on June 28th. Discussion. Alderman Hartford mentioned this is a very worth while project. Voice vote, motion carried unanimously. Permission to go forward with a TIF District. Dave Byerly the Economic Development Director explained that he has good news and an action plan to move forward on the former IH property. This is to create an action plan and funding. Have been working diligently on the concept of a TIF District being created in the neighborhood of the IH site. There is a TIF District there now, and has 6 years left. Later on will be asking for the old TIF District to be dissolved. Alderman Les Carl asked Dave if there was a geographic map showing the boundaries of the new TIF District? Dave said this is what we are asking you to let us do. Alderman Fillingham asked Dave if he had talked with the School District? Dave said he had, as the Mayor wants as many to be in favor of this, and the School Board was very positive. Alderman Sarff asked about the $400,000 Grant that is to be awarded to the City, what happens? Dave said he received a letter on this grant funding and we should have a letter by the first of July. This TIF District is not consistent on receiving those funds. Motion and second by Aldermen Molleck/Hartford, permission granted for David Byerly to move forward on creating a new TIF District in the area of the former IH plant. Roll call. Motion carried. 299 City Council meeting 6-17-2003 the project we don't advertise in the paper, as this is the correct way to receive quotes from Professional Consultants. Motion and second by Aldermen Molleck/Fillingham, in support of the process Dave Byerly described in solicited proposals from the various companies. Voice vote, motion carried unanimously. ~,,,,, Motion and second by Aldermen Molleck/Haztford, to accept the low quote from Vandewalle & Associates in the amount of $30,000. Discussion. Alderman Molleck commented, Vandewalle & Associates aze the lowest quote and the most familiaz with the IH area. Discussion. Alderman Cazl asked about the funds to pay for this project? Motion carried. Update on the Romine Disposal. City Attorney Ron Weber said, Bill Loeffel the Assistant District Attorney filed an action preliminazy injunction for the Fulton County Health Department that was heard this morning in the Fulton County Court House. The City of Canton joined the county in this matter. Bill Loeffel reported that the county has been working with Gordon Romine on dumpsters stored at several sites around the county that have presented a problem. As gazbage is still in them, and water could accumulate in them for breeding of mosquitoes. Rex Still of the Fulton County Health Department met with Bill Loeffel this past week. Rex showed his fiustration as Gordon Romine has not appeared at any of the court meetings. The dumpsters he stores at 855 Grant Place have become an imminent health hazazd. There aze some 78 dumpsters out there and many if not most, have accumulation of various degrees of stagnant water. There were many larvae population swarming in that water. The Fulton County Health Department has been spraying out there, but they are making the situation just bazely manageable. On June 13 filed a complaint for an injunction. We're doing that in cooperation with the City of Canton. We're seeking to enforce the county health ordinance, and the solid waste ordinance. The City of Canton today filed their complaint to enforce various city ordinances. But the goal that we are both hoping to accomplish is the same. We need to have those dumpsters dumped and removed. We did have a hearing this morning in court and Gordon Romine failed to report. Presenting the testimony was Rex Still and also Clif O'Brien from the City who laid the situation before Judge Taylor that has developed, and after testimony was presented, the honorable Judge Taylor entered an order enjoying code violations of the solid waste ordinance by Gordon Romine. Honorable Judge Taylor ordering -dump the dumpsters on the Grant Place property and remove all gazbage from the Grant Place property within 7 days. And then to secure those dumpsters by tipping them/turning over and ensuring drain holes aze open. And the numerous tires on the property to be the same, turn over. Gordon Romine cannot contract or accept more gazbage. Further proceedings in this county case and also the city's case are set for June 24 at 10:30 a.m. City Attorney Ron Weber said, the county has the authority to seek a preliminary injunction and obtain orders for Mr. Romine to do these activities. So they're leading off. If he does not move forwazd with these actions, and we don't fmd a way to enforce that, requiring him to take those actions, the City under its nuisance ordinance does have the authority to abate this situation and move forward against Mr. Romine to empty those 1__.__._ _i _ ___ _ __ / _ _ 11 _ M. 1 t t • t n ~ ~ r 300 City Council meeting 6-17-2003 Mayor Bohler thanked the three individuals who planted flowers in Jones Park from the Leadership Academy. And also city employees who painted the Gazebo. And Dan Walters for the donation of flowers. Mayor Bohler welcomed the new business of TDS Technologies Inc. of 1319 S. 5`h Avenue. OLD BUSINESS: ORDINANCE - ESTABLISHING "NO PARKING" ON THE NORTH SIDE OF ELM STREET BETWEEN WHITE COURT AND MAIN STREET. Second reading, read by title. NEW BUSINESS: ORDINANCE -REPLACING TITLE 3, CHAPTER 8, SECTION 3, OF THE CANTON MUNICIPAL CODE, FOR THE CITY'S APPLICATION PROVISIONS AND POWERS OF DUTIES. First reading, read by title. Alderman Sarff asked where the ordinance originated from? Mayor Bohler said from the Liquor Commission. Ron Weber stated, this ordinance tells how the liquor ordinance should operate. The council chooses the number of license that will be available, and the Liquor Commission does the actual process. This is not only controlled by the City, but also the State of Illinois Liquor Control Commission. Mayor Bohler said, the ordinance does not change the authority of the Liquor Commission, only clarifies the duties and responsibilities. ORDINANCE -AMENDING TITLE 3, CHAPTER 8, SECTION 11, OF THE CANTON MUNICIPAL CODE OF THE CITY OF CANTON, LICENSE RESTRICTIONS, ADDING AN ADDITIONAL PARAGRAPH FOR ALL RESTAURANTS AND SUPPER CLUB LICENSE HOLDERS. First reading, read by title. ORDINANCE - GRANTING A SPECIAL USE/HOME OCCUPATION PERMIT FOR THE OPERATION OF A BEAUTY SHOP AT 1025 EAST OLIVE STREET, TO IRENE WOODS. First reading, read by title. RESOLUTION -CANTON PARK DISTRICT TRIATHLON FOR AUGUST 2, 2003. First reading, read by title. Motion and second by Aldermen Molleck/Carl, the resolution be adopted. Roll call. Discussion. Mayor Bohler commented that the City of Canton is not buying a new fire truck, just refinancing the existing fire truck. Roll call. The Public Hearing was held in the Historic Depot , 50 North 4`h Avenue, Canton, Illinois just before the regular scheduled Council meeting. Mayor Bohler opened the meeting at 6:30 p.m. and asked the audience three times if anyone wanted to make comments about the Appropriation Ordinance? No response was given by the public. Mayor Bohler then asked the Council members if they had any comments, and no response was given. Mayor Bohler closed the Public Hearing for the Proposed Appropriation Ordinance at 6:30 p.m. L
