A regular meeting of the Canton City Council was held on May 20, 2003 in the Council
Chambers at the Historic Depot, 50 North 5`h Avenue, Canton, Illinois.
PLEDGE OF ALLEGIANCE OPENED THE MEETING, FOLLOWED BY THE
INVOCATION GIVEN BY NANCY WHITES CITY CLERK.
Mayor Bohler asked roll call at 6:30 p.m. Present -Aldermen Jim Hartford, Bob
Molleck, Craig West, Larry Sarff, Elny Scott Harn, Les Carl, Mary Fillingham, and Rick
Reed. Absent -None.
MINUTES OF MAY 6, 2003 MEETING. Motion and second by Aldermen
Molleck/Hartford, the minutes of May 6, 2003 be accepted and placed on file. Voice
vote, motion carried unanimously.
BILLS FOR APRIL. Motion and second by Aldermen Sarff/Reed, all bills be approved
for payment and the added bills from last meeting also. Roll call. AYES -Aldermen
Reed, Fillingham, Carl, Harn, Sarff, West, Molleck, Hartford. NAYS -None. 8 AYES,
0 NAYS, 0 ABSENT. Motion carried.
COMMITTEE REPORTS:
Finance
Council Action
Motion and second by Aldermen CarUWest, to approve the Budget for 2003 -2004.
Discussion. Alderman Carl stated he had talked with City Treasurer Patty Beaird
Franzoni, and former city treasurer Pat Wright. The City will have emergencies
throughout the year.. Cuts may not be the best things for us to do if the Budgets are held
over.
Alderman Sarff said he had about $5,000 worth of unanswered questions to discuss at the
next Finance Committee with possible cuts.
Alderman Carl felt this is the right course of action and withdrew his motion and
Alderman West withdrew his second.
City Attorney Ron Weber asked them to remember about the time frame for passage of
the Budget, an the Appropriation Ordinance will be coming before the City Council
before too long. Ron suggested having a Finance Committee meeting after the
Mechanical Committee meeting next Tuesday.
Motion and second by Aldermen CarUSarff, to have a Finance Committee meeting next
week on May 27`" immediately following the Mechanical meeting to discuss the Budgets
2003-2004 Fiscal year. Voice vote, motion carried unanimously.
Motion and second by Aldermen CarUSarff, to approve the HCH 3 year renewal for
Administrative Services. Discussion. City Attorney Ron Weber said he was asked by
Alderman Sarff, what the difference in cost was? The difference between entering into a
3 year renewal and a one year roll over, there was a 3% increase in cost to HCH if we let
it roll over for additional year. That 3% is basically $900. And we're already on that
roll over. They would extend to us the opportunity to do the 3 year renewal with no
increase, but the only savings to us actually is converting from 1 year to 3 years is
$900.00. Ron said his recommendation is to let it automatically renew and pay the
$900.00 increase fee and retain the option to act on this at a shorter period of time.
Alderman Sarff asked, wouldn't we have a 2% savings? Ron Weber, all there is, is a

Motion and second by Aldermen CarUFillingham, to allow the repair of the D-Range
John Deere Tractor from Stevens Implement for the wastewater treatment Plant in the
amount of $4,418.99. Roll call. AYES -Aldermen Hartford, Molleck, West, Sarff,
Harn, Carl, Fillingham, Reed. NAYS -None. 8 AYES, 0 NAYS, 0 ABSENT. Motion
carried.

Council Action
Motion and second by Aldermen West/Molleck, to accept the bid from Gary/Heidi
Leese of the Palm Cafe located in the Bruketta Building, of Lot 6 Jones Addition for 4
spaces in the city parking on South 1st Avenue in the amount of $1.00. Discussion.
David Byerly spoke about the bid after he was asked to review the bid and bring the
recommendation. David said that all issues are still relevant that was presented to you
before. David recommended to the council to allow this project to move forward so
construction/remodeling can begin. Roll call. AYES -Aldermen Reed, Fillingham,
Carl, Harn, Sarff, West, Molleck, Hartford. NAYS -None. 8 AYES, 0 NAYS, 0
ABSENT. Motion carried.
Negotiations, Grievance & Personnel.
Council Action
Motion and second by Aldermen Sarff/Reed, to discuss the Temporary Firefighter
appointment at the Finance Committee meeting next week. Voice vote, motion carried
unanimously.
COMMUNICATIONS FROM MAYOR BOHLER. Mayor Bohler stated this is an
application for approval of the Carl Subdivision plat on Grant Place -Les Carl, owner.
This has been approved by the Planning & Zoning Commission. City Attorney Ron
Weber explained, where this is a subdivision of a property, this is just the division, not
the creation of new houses. The plat is just showing the boundaries. And that is still
required by the City Council. The property is on Grant Place and just short of 8`n Avenue.
No improvements are required and no streets or utilities.
Attorney John McCarthy mentioned there is one advantage to the City, we found that 7cn
Avenue along Grant Place has never been dedicated to the City. So if this is approved
that section would be dedicated as part of the approval of the subdivision.
Motion and second by Aldermen Sarff/Molleck, that Alderman Les Carl be excused
from voting on this issue. Voice vote, motion carried unanimously.
Motion and second by Aldermen Sarff/Fillingham, to accept the plat of Carl Subdivision
on Grant Place. Roll call. AYES -Aldermen Hartford, Molleck, West, Sarff, Harn,
Carl, Fillingham, Reed. NAYS -None. 8 AYES, 0 NAYS, 0 ABSENT. Motion carried.

Motion and second by Aldermen Sarff/Molleck, to approve of a Beer Garden License to
Official Time Out for June 14, as fundraiser for Freshmen Sports. Roll call. AYES -
Aldermen Hartford, Molleck, West, Sarff, Harn, Carl, Fillingham, Reed. NAYS -None.
8 AYES, 0 NAYS, 0 ABSENT. Motion carried.
Mayor Bohler welcomed Dr. Gary Hieser, Chiropractor to the community.
Flyers have been passed out about information on West Nile Virus. Clif O'Brien said
they had already begun by laying out bait, and took care of some low lying water. Been
into IH property sprayed and larvae. Cleaned up all storm sewers and catch basins.
Mayor Bohler asked Greg Pollitt Supt of Water Treatment Plant how low the lake is?
Greg mentioned 29 '/z inches down with some water still coming in from recent rain.
OLD BUSINESS:
ORDINANCE -AMENDING THE MUNICIPAL CODE OF THE CITY OF
CANTON, BY THE ADDITION OF ARTICLE 3, CHAPTER 23, IMPOSING A
SIMPLIFIED MUNICIPAL TELECOMMUNICATIONS TAX. Second reading,
read by title. Motion and second by Aldermen Fillingham/Carl, the ordinance be placed
on its passage. Discussion. Alderman Sarff ask Ron Weber, with the information you
gave from the Illinois Municipal League, did you tie that into this at all? Ron Weber said
as I mentioned some 2 weeks ago, the Illinois Municipal League keeps putting out on
their web-site how the estimated state's share of income tax is down 9%. The State's Use
Tax is declining at 14%. The Photo Processing Tax has been removed from
municipalties. The Corporate Property Tax has fallen 18%. Alderman Sarff ask Ron,
with he decrease her per captia bases, do you have an estimate of what that means to the
City of Canton? Ron said it appears to be substantial. Ron said there is none of us who
want to add this tax on, but when you see your revenues decrease, you have to do
something. This will not take affect until January of 2004. And if we find there is a
better alternative, than this tax can be amended is appropriate. Alderman Carl mentioned
if we want to save jobs we're going to have to pass this ordinance. Mayor Bohler
commented that to recoup this kind of money someone's property tax would increase
20%. Property owners are hit up continuously over someone's budget and it's not fair to
them. Roll call. AYES -Aldermen Reed, Fillingham, Carl, Harn, Sarff, West, Molleck.
NAYS -Hartford. 7 AYES, 1 NAYS, 0 ABSENT. Motion carried. Ordinance being

NEW BUSINESS:
ORDINANCE -FOR THE SALE & LEASE BACK AND ACCESS EASEMENT
BETWEEN THE CITY OF CANTON AN CENTRAL ILLINOIS PUBLIC
SERVICE COMPANY dba/AMEREN LIPS, FOR A PORTION OF CITY
STORAGE AREA AT THE CITY GARAGE. First reading, read by title. Mayor
Bohler announced that representatives were here from Amern/Cips if there is any
questions. Ron Weber, city attorney mentioned that it is a concern to Cips that we
understand what is going on here. Again as mentioned before we have a site some years
ago that had environmental problems. It is necessary for them and beneficial, and
perhaps a protection for the City, as will be leasing the property in case of future

ORDINANCE -FOR RE-ZONING FROM R-2, TO R-3, LOCATED AT 816
NORTH 7TH AVENUE, IN THE CITY OF CANTON. (Marilyn Taylor.) First
reading, read by title.
ORDINANCE -ESTABLISHING "NO PARKING" ON BANYON DRIVE IN THE
CITY OF CANTON, ILLINOIS. First reading, read by title.
RESOLUTION -APPROVING SPECIFIC SALARIES FOR THE VARIOUS
DEPARTMENT HEADS, SUPERINTENDENTS, FULL TIME APPOINTIVE
EMPLOYEES AND PART TIME APPOINTIVE EMPLOYEES OF THE CITY
OF CANTON. First reading, read by title. Motion and second by Aldermen
SarfflMolleck, to send the resolution to the Finance Committee next week. Voice
voate,motion carried unanimously.
RESOLUTION - APPROVING AN OPTIONAL PLAN ON HEALTH
INSURANCE OFFERING CASH PAYMENT IN LIEU OF INSURANCE
COVERAGE FOR ELECTED AND APPOINTED EMPLOYEES COVERED BY
OTHER INSURANCE. First reading, read by title. Motion and second by Aldermen
CarUReed, the resolution be taken off the agenda. Discussion. Alderman Carl said as
Finance Chairman he investigated this further and feels there would be very little savings
to the City of Canton, Mayor Bohler said that because of the further investigation on this,
he felt this would not be that much savings, and we were out to save the City some
money. Voice vote, motion carried unanimously.

vote, motion carried unanimously. The regular scheduled meeting adjourned at 7:05 p.m.
