HomeMy WebLinkAbout04-15-03 Canton City Council280 A regular meeting of the Canton City Council was held on April 15, 2003 in the Council Chambers at the Historic Depot, 50 North 5th Avenue, Canton, Illinois. PLEDGE OF ALLEGIANCE OPENED THE MEETING FOLLOWED BY THE INVOCATION GIVEN BY NANCY WHITES, CITY CLERK. Mayor Bohler asked for roll call at 6:30 p.m. Present -Aldermen Bob Molleck, Jim Hartford, Larry Sarff, Craig West, Les Carl, Kevin Meade, Jo Anne Shores, & Mary Fillingham. Absent -None. MINUTES OF APRIL 2, 2003 MEETING. Motion and second by Aldermen Molleck/Sarff, the minutes of Apri12, 2003 be accepted and placed on file. Voice vote, motion carried unanimously. BILLS FOR MARCH. Motion and second by Aldermen Hartford/Sarff, all bills properly approved be paid. Roll call. AYES -Aldermen Fillingham, Shores, Meade, Carl, West, Sarff, Hartford, Molleck. NAYS -None. 8 AYES, 0 NAYS, 0 ABSENT. Motion carried. ABSTRACT OF VOTES APRIL 1, 2003 CONSOLIDATED GENERAL ELECTION. Nancy Whites, City Clerk gave the report of the canvassing board. A total of 3290 voters requested and received ballots. And the following are the results. Ward 1 James Hartford 427* Lloyd A. Williams 373 Ward 2 Dale Bishop 353 Larry A. The canvass of the votes by Mayor Jerry M. Bohler, City Attorney Ron Weber & City Clerk Nancy Whites was prepared on Apri13, 2003. COMMITTEE REPORTS: Finance. Council Action Motion and second by Aldermen Hartford/Molleck, to approve the renewal of the membership in Fulton County Tourism in the amount of $300. Roll call. AYES - Aldermen Molleck, Hartford, Sarff, West, Carl, Meade, Shores, Fillingham. NAYS - None. 8 AYES, 0 NAYS, 0 ABSENT. Motion carried. i 281 City Council meeting 4-15-03 lien affidavit. They have been contacted about that and told to provide it. I see this as a ministerial act, and once we receive it, the pay request can be paid. Roll call. AYES - Aldermen Fillingham, Shores, Meade, Carl, West, Sarff, Hartford, Molleck. NAYS - None. 8 AYES, 0 NAYS, 0 ABSENT. Motion carried. Treasurer's Report. City Treasurer Patty Beaird Franzoni gave out her report. Her i report shows May 1, 2002 General Fund Balance $819,001.00. With a Fund Balance of year-to-date of $575,898.00. (Not taking into consideration of Work Comp/Audit of $134,931.00.) Alderman Hartford said he had just received the report and asked the council if there were any questions? The council members did not ask any questions. Legal & Ordinance. Council Action Motion and second by Aldermen Shores/Fillingham, to allow city attorney Ron Weber more time to review the Agreement presented by HCH. Discussion. Ron Weber stated that HCH presented to us that Alderman Sarff had asked to check on whether there was a differential in cost if we went to a 15/12 rather that a 24/12. According to City Treasurer Patty Beaird Franzoni, the insurance committee tells us there isn't any difference. In reviewing the agreement, the prior two agreements had been annual. This new agreement is a three year agreement with a provision that allows us to terminate the agreement on 120 days notice. But it also includes some provisions for additional cost to us if we terminate the agreement early. I have just been reviewing the agreement, it would be my preference to refer back to committee for a fmal review of additional cost. They gave us a 3% savings if we agree to a 3 year contract in the first year. But if for some reason we are looking to change it, I'm concern at the penalties provision that exceeds the savings. Voice vote, motion carried. Community & Industrial Development. Council Action None. Negotiations, Grievance & Personnel. Council Action None. Informational. The Negotiations Committee will meet on April 22, 2003 for discussion of Police Contract. COMMUNICATIONS FROM MAYOR BOHLER. Mayor Bohler thanked everyone who showed up last Saturday at the Lake to Clean Up day. Alderman Carl will give a report at the committee meeting next week. I had one descending vote, as one of the commissioner's had some concerns on activities due to the number of calls to Police. Plus someone got arrested for serving to under age drinker. This issue has not gone to court as of this time. The Liquor Commission and the Police Chief had said there is not enough to disapprove of a Beer Garden license. Voice vote, motion carried. Motion and second Sarff/Hartford, the appointment of a sub committee to review city fees, permits, licenses and fines to increase City revenues. Voice vote, motion carried unanimously. Mayor Bohler said, normally I don't respond to items, articles or news put in newspapers. But due to the seriousness especially this council, being accused of violating the Open Meetings Act at the last Council meeting, and since all of you were here at the April 2 meeting. I liked to ask you since we were accused that after the Council meeting a vote was taken over issuing the liquor license to D & D Drive Thru? If this happened I'd like to hear about it. I don't think any of you were polled, I know that no one was polled. I realize the person who reports these meetings, my understanding, makes money out of selling these reports to the Peoria Journal Star. And, sometimes I guess to make the report seem interesting enough to buy we become a target and accused of something we did not do. We have never done, and never will do, I have a lot of faith in this council and we will continue to do things the right way. But, I think that was unfair, and was not investigated very far. If they had, they would have found out there was no violation of any Open Meetings Act or any law broken. OLD BUSINESS: ORDINANCE -ESTABLISHING `NO PARKING' IN THE 400 BLOCK OF EAST BIRCH STREET, IN THE CITY OF CANTON, ILLINOIS. Second reading, read by title. Motion and second by Aldermen Hartford/West, the ordinance be placed on its passage. Roll call. AYES -Aldermen Molleck, Hartford, Sarff, West, Carl, Meade, Shores, Fillingham. NAYS -None. 8 AYES, 0 NAYS, 0 ABSENT. Motion carried. Ordinance being #1751. NEW BUSINESS: ORDINANCE -ESTABLISHING `NO PARKING' ON MARKET COURT. First reading, read by title. ADJOURNMENT. Motion and second by Aldermen Molleck/Hartford, to adjourn. Voice vote, motion carried unanimously.
