HomeMy WebLinkAbout09-07-04 Canton City Council395 A regular meeting of the Canton City Council was held on September 7, 2004 in the council Chambers at the Historic Depot, 50 North 4th Avenue, Canton, Illinois. PLEDGE OF ALLEGIANCE OPENED THE MEETING FOLLOWED BY THE INVOCATION GIVEN BY NANCY WHITES, CITY CLERK. Mayor Bohler asked for roll call at 6:38 p.m. Present -Aldermen Larry Sarff, Mary Fillingham, Bob Molleck, Elny Harn, Les Carl, Jim Hartford, Rick Reed, & Craig West. Absent -None. MINUTES OF AUGUST 18, 2004 COUNCIL MEETING. Motion and second by ~ Aldermen Molleck/Harn, the minutes of August 18, 2004 be accepted as printed and placed on file. Voice vote, motion carried unanimously. COMMITTEE REPORTS: Public Safety & Traffic. Council Action Motion and second by Aldermen Molleck/Harn, to accept the low bid from Riverland FS Inc. for Gasoline at $1.51, and Diesel Fuel at $1.55. Roll call. AYES -Aldermen West, Reed, Hartford, Carl, Harn, Molleck, Fillingham, Sarff. NAYS -None. 8 AYES, 0 NAYS, 0 ABSENT. Motion carried. Streets & Garbage. Council Action Motion and second by Aldermen Carl/Hartford, to approve of entering into an agreement with IDOT to include the existing deteriorated sidewalk in this contract, and agreement would be written accordingly with the City's cost of $141,450. (The City would pay ~„ 50% for replacement of deteriorated sidewalk along IL Route 78 (Main Street) from just south of the Big Creek Park entrance to north of Alder Street. Tentatively scheduled for January 19, 2007 letting.). Roll call. AYES -Aldermen Sarff, Fillingham, Molleck, Harn, Carl, Hartford, Reed, West. NAYS -None. 8 AYES, 0 NAYS, 0 ABSENT. Motion carried. Lake, Buildings & Grounds. Council Action Motion and second by Aldermen Reed/Harn, to send the Vandewalle & Associates Master Plan 1, to the Planning & Zoning Commission. Voice vote, motion carried unanimously. Informational. 4B TIF Expenditures at IH. City Attorney Ron Weber explained that results are not complete and wants to hold off until the information is available. This will either be on the Legal & Ordinance agenda or the Council meeting of September 21~t. Public Works, Water & Sewer. .. . 396 Council meeting September 7, 2004 COMMUNICATIONS FROM MAYOR BOHLER. Keith Plavec of Maurer Stutz Inc. was asked by the mayor to give an update on the Water Study they are conducting. Keith said they are currently working on what is remaining on the draft and tying up loose ends. Will be meeting with the committee tomorrow. Should have a rough draft in two weeks. After that, in two weeks should have a fmal draft. Keith mentioned using reverse osmosis with water coming from the Illinois River in the Banner area, or the wells already in the City of Canton. Mayor Bohler mentioned that the city's past study was expounded on to save time and money. OLD BUSINESS: None. NEW BUSINESS: RESOLUTION - COMMITTING LOCAL FUNDS FOR PLANNING ASSISTANCE APPLICATION. First reading, read by title. Motion and second by Aldermen Molleck/Reed, the resolution be adopted. Roll call. AYES -Aldermen West, Reed, Hartford, Carl, Harn, Molleck, Fillingham, Sarff. NAYS -None. 8 AYES, O NAYS, O ABSENT. Motion carried. Resolution being #3705. RESOLUTION -SUPPORT OF ASSISTANCE PROGRAM GRANT. First reading, read by title. Motion and second by Aldermen Reed/Hartford, the resolution be adopted. Roll call. AYES -Aldermen Sarff, Fillingham, Molleck, Harn, Carl, Hartford, Reed, West. NAYS -None. 8 AYES, 0 NAYS, 0 ABSENT. Motion carried. Resolution being #3706. RESOLUTION - APPROVING A "COOPERATION AGREEMENT" BETWEEN THE CTY OF CANTON AND THE COUNTY OF FULTON, ILLINOIS. (Supporting and maintaining the economic benefits of the Canton/Fulton County Enterprise Zone by the State of Illinois.) First reading, read by title. Motion and second by Aldermen West/Carl, the resolution be adopted. Discussion. Ron Weber explained this resolution pertains to the enterprise zone. Ron said the ordinance listed last on the agenda for Cooperatively Designating An Enterprise Zone has to be passed on first reading tonight. Motion and second withdrawn. Motion and second by Aldermen Hartford/Reed, to suspend the rules to pass the ordinance on first reading of Amending Ordinance Number 959 Entitled "An Ordinance Initiating and Cooperatively Designating an Enterprise Zone". Roll call. AYES - Aldermen West, Reed, Hartford, Carl, Harn, Molleck, Fillingham, Sarff. NAYS -None. 8 AYES, 0 NAYS, 0 ABSENT. Motion carried. Resolution being #3707. 397 Council meeting September 7, 2004 ORDINANCE - PROVIDING FOR A NON-HOME RULE MUNICIPAL RETAILERS' OCCUPATION TAX AND NON-HOME RULE MUNICIPAL SERVICE OCCUPATION TAX INCREASE. First reading, read by title. City Attorney Ron Weber mentioned the ordinance has to be passed tonight on first reading. The ordinance has to be sent to the State by October 1st, and this would give us some time if needed. Motion and second by Aldermen Molleck/Fillingham, to suspend the rules to place the ordinance on its passage at first reading. Roll call. AYES -Aldermen Sarff, Fillingham, Molleck, Harn, Carl, Hartford, Reed, West. NAYS -None. 8 AYES, 0 NAYS, 0 ABSENT. Motion carried. ORDINANCE -AMENDING ORDINANCE NUMBER 959 ENTITLED "AN ORDINANCE INITIATING AND COOPERATIVELY DESIGNATING AN ENTERPRISE ZONE". First reading, read by title. (Suspension of the rules to place the ordinance on its passage at first reading was voted on under resolution #3707 of this meeting.) Motion and second by Aldermen West/Carl, the ordinance be placed on its passage. Roll call. AYES -Aldermen West, Reed, Hartford, Carl, Harn, Molleck, Fillingham, Sarff. NAYS -None. 8 AYES, 0 NAYS, 0 ABSENT. Motion carried. Ordinance being #1812. Alderman Sarff mentioned that several questions have come up recently. The memo received from the mayor and addressed to all City Council members, Administrative Staff and Department Heads/Superintendents. Re: Request for Information. Date: August 20, 2004. The memorandum reads...All requests for information and/or copies of documents shall be processed in the following manner: 1. All requests shall be submitted in writing, outlining specific information requested; 2. The request shall be forwarded to the City Attorney for review, if applicable; and 3. A copy of the request shall be placed on file with my office. Should you have any questions concerning this procedure, please do not hesitate to contact my office. End of Memorandum Alderman Sarff said he did not understand the thought process behind this, what prompted this? City Attorney Ron Weber mentioned this is our way of implementation because we have been receiving numerous request. This will help us to broadly implement the Freedom Of Information Act. Alderman Sarff asked how that would impact council members? Mayor Bohler answered, our employees have the right to keep their stuff personal. I'm sure some of you do not know about what information that can be given out and it could harm a city employee. Alderman Sarff said this does not seem right to have to be looked over when you request something in writing, seems like over- kill. Alderman Sarff further stated that if he requests a copy of a bill, does he have to ask for it in writing? Mayor Bohler stated that not everything would go to the city attorney. -Cl 398 Council meeting September 7, 2004 asked when council gave that permission? Mayor Bohler told Alderman Sarff to look it up! Alderman Sarffthen asked the City Clerk to obtain a copy for him. Motion and second by Aldermen Sarff/Reed, an executive session to be held and meet with regular staff and labor attorney Bruce Beal for purpose of Personnel and Negotiations with Public Works, and the meeting to be held immediately following the council meeting September 21S`.
