A regular meeting of the Canton City Council was held on April 6, 2004, in the Council
Chambers at the Historic Depot, 50 North 4`" Avenue, Canton, Illinois.
PLEDGE OF ALLEGIANCE OPENED THE MEETING FOLLOWED BY THE
INVOCATION GIVEN BY NANCY WHITES, CITY CLERK.
Mayor Bohler asked for roll call at 6:30 p.m. Present -Aldermen Craig West, Larry
Sarff, Elny Harn, Les Carl, Mary Fillingham, Rick Reed. Absent -Jim Hartford, Bob
Molleck. Jim was on vacation and Bob had a death in the family.
MINUTES OF MARCH 16, 2004 COUNCIL MEETING. Motion and second by
Aldermen West/Fillingham, the minutes of March 16, 2004 be accepted and placed on
file. Voice vote, motion carried unanimously.
COMMITTEE REPORTS:
Public Safety & Traffic.
Council Action
Motion and second by Aldermen Carl/Reed, to approve participation in the formation of
a regional Technical Rescue Team for the Fire Department. Discussion. Alderman
Fillingham asked, down the road what the cost would be? Fire Chief John Stanko said,
there would be periodically skill assessment training that would take part of a day. And
there could be some cost there, but not all five employees taking this training would have
to attend the skill training in the future. Voice vote, motion carried unanimously.

Public Works, Water & Sewer.
Council Action
Motion and second by Aldermen Harn/Sarff, to approve for the water department to seek
bids for their Chemicals needed at the Water Plant. Roll call. AYES -Aldermen Reed,
Fillingham, Carl, Harn, Sarff, West. NAYS -None. 6 AYES, 0 NAYS, 2 ABSENT.
Motion carried.
COMMUNICATIONS FROM MAYOR BOHLER. Motion and second by Aldermen
West/Fillingham, aClass BSupper Club License be granted to Harriett Williams of J & L
Vintage Cafe located at 1400 S. 5~' Avenue. Voice vote, motion carried unanimously.

Council meeting April 6, 2004
Authorization to file action for a new Election. City Attorney Ron Weber stated that a
draft of complaint was filed for a Court Ordered Special Election for the City of Canton's
'/2 % sales tax referendum. On review of the law with this matter, some of the ballots
were not issued with the question on the ballot, and ballots outside the city that were
given out did vote on this issue. This special election will be conducted by the County
Clerk's office. The Court will determine when the election will be held, and anything
else about this election. If the sales tax referendum would win the election the city could
start receiving the funds beginning January 1, 2005.
Alderman Harn mentioned that she has been an election judge and she wanted to know,
why some had the right ballot and others did not? Ron Weber said it was a situation that
occurred inside and outside the city. Alderman Harn wanted to know if this would be
Randy Rumler the County Clerk that the city is bringing the law suit against? Ron said,
just Randy as an election authority, not Randy personally. Mayor Bohler said this was
not an intentional mistake, these things happen. Roll call. AYES -Aldermen West,
Sarff, Carl, Fillingham, Reed. NAYS -Alderman Harn. 5 AYES, 1 NAY, 2 ABSENT.
Motion carried.

ORDINANCE - AMENDING 8-11-2 AND 8-11-2 (A) OF THE CANTON
MUNICIPAL CODE REGARDING BOATING LICENSE REQUIRED. First

ORDINANCE -FIXING JUNE 8, 2004 AS THE DATE OF THE PUBLIC
HEARING FOR THE CREATION OF A NEW TAX INCREMENT FINANCING
DISTRICT (TIF) IN THE CITY OF CANTON, ILLINOIS. First reading, read by
title.
ORDINANCE -PROHIBITING THE USE OF GROUNDWATER AS POTABLE
WATER SUPPLY BY THE INSTALLATION OF A POTABLE WATER SUPPLY
WELL OR BY OTHER MEANS. First reading, read by title.
RESOLUTION -APPROVING AN AGREEMENT BETWEEN THE CITY OF
CANTON AND THE CITY OF CANTON POLICE DEPARTMENT AND
AUTHORIZING AND DIRECTING THE MAYOR AND CITY CLERK TO
EXECUTE SAID AGREEMENT ON BEHALF OF THE CITY OF CANTON,
ILLINOIS. First reading, read by title. Motion and second by Aldermen Sarff/Carl, the
resolution be adopted. Roll call. AYES -Aldermen West, Sarff, Harn, Carl, Fillingham,
Reed. NAYS -None. 6 AYES, 0 NAYS, 2 ABSENT. Motion carried. Resolution

RESOLUTION -REIMBURSEMENT FOR DEMOLITON EXPENSES FOR THE
