A regular meeting of the Canton City Council was held on February 3, 2004, in the
Council Chambers at the Historic Depot at 50 North Depot Road, Canton, Illinois.
PLEDGE OF ALLEGIANCE OPENED THE MEETING, FOLLOWED BY THE
INVOCATION GIVEN BY NANCY WHITES, CITY CLERK.
Mayor Bohler asked for roll call at 6:30 p.m. Present -Aldermen Jim Hartford, Craig
West, Larry Sarff, Elny Harn, Les Carl, Mary Fillingham, Rick Reed. Absent -
Alderman Bob Molleck.
MINUTES OF JANUARY 20TH, 2004 MEETING. Motion and second by Aldermen
Hartford/Reed, the minutes of January 20th, 2004 meeting be approved and placed on file.
Voice vote, motion carried unanimously.
COMMITTEE REPORTS:
Public Safety & Traffic.
Council Action
Motion and second by Aldermen Hartford/West, the annual ladder testing from
American Test Center in the amount of $1,420.00 for all aerial and ground ladders for the
Fire Department be approved. Roll call. AYES -Aldermen Reed, Fillingham, Carl,
Harn, Sarff, West, Hartford. NAYS -None. 7AYES, 0 NAYS, 1 ABSENT. Motion
carried.

Lake, Buildings & Grounds.
Council Action
Motion and second by Aldermen Reed/Carl, to send the Proposed Changes to the City
Ordinances to provide authority for Firemen, Lake Patrol and Zoning Enforcement
Officer to the Committee meeting of Legal & Ordinance. Voice vote, motion carried
unanimously.

COMMUNICATIONS FROM MAYOR BOHLER. Mayor Bohler welcomed Boy
Scout Troop 124 Todd Jarnigan Scout Leader. Todd said they are sponsored by the
Trinity Lutheran Church, and then he introduced each of the scouts attending the
meeting, they were Michael Ellis -Assistant Patrol Leader of Silver Falcon Patrol, Joel
Polk -Patrol Leader Silver Arrow Patrol, Christopher Cook -Troop Guide, Dave Schoon

ORDINANCE -GRANTING A HOME OCCUPATION PERMIT FOR 764
SOUTH 1sT AVENUE, CANTON, ILLINOIS FOR GREENHOUSE/NURSERY
FOR BENJAMIN & DEBRA BEAIRD. First reading, read by title. Debra Beaird
spoke to the council members about her going to the Planning & Zoning Commission
hearing (Oct 03) to pursue her career goal of a nursery and greenhouse. The only one
against this is the City Attorney Ron Weber. My building will not block anyone's view,
I'm right on Linn Street. I hope the City Council can help me find an avenue to do this.
City Attorney Ron Weber said he was sorry that Debra Beaird feels I'm opposing her
business. The business is a limited use in a residential area. I've been reviewing it, and
this is more of a commercial structure of business, as the Home Occupation was
considered as a start up, and Planning & Zoning approved the Home Occupation Permit
request. Ron said, that what she wants is more than that. Ron recommended to send this
to the Legal & Ordinance Committee to review further, and council can review the
ordinance on Home Occupations. Ron further stated that her attorney Walt Barra said
she was considering with drawing the Home Occupation request.
Debra Beaird, said that Planning & Zoning give her this Home Occupation for 2 years to
see if the business would fly, why stop me now on the pretense of going commercial?
The original plan fit the Planning & Zoning Commission of buying plants.
Mayor Bohler told Debra Beaird that all the Aldermen would have a copy of the Home
Occupation Ordinance for review at that meeting.
Motion and second by Aldermen CarVReed, to send the Ordinance to the Legal &
Ordinance Committee for review on February 10`t', and to invite Debra Beaird to the
meeting. Voice vote, motion carried unanimously.
RESOLUTION - APPROVING A PRE-ANNEXATION AGREEMENT
BETWEEN THE CITY OF CANTON AND ALEX GONZALEZ. First reading,
read by title. Motion and second by Aldermen West/Hartford, the resolution be adopted.
Discussion. Alderman Carl ask Clif O'Brien how close is the property to the city limits?
Clif said a couple thousand feet. Roll call. AYES -Aldermen Hartford, West, Sarff,
Harn, Carl, Fillingham, Reed. NAYS -None. 7 AYES, 0 NAYS, 1 ABSENT. Motion
carried. Resolution being #3680.
RESOLUTION -APPROVING SPECIFIC SALARIES FOR THE VARIOUS
DEPARTMENT HEADS, SUPERINTENDENTS, FULL-TIME APPOINTIVE
EMPLOYEES, AND PART-TIME APPOINTIVE EMPLOYEES OF THE CITY
OF CANTON. First reading, read by title. Motion and second by Aldermen
Fillingham/Carl, the resolution be adopted. Roll call. AYES -Aldermen Reed,
Fillingham, Carl, Harn, Sarff, West, Hartford. NAYS -None. 7 AYES, 0 NAYS, 1
ABSENT. Motion carried. Resolution being #3681.
EXECUTIVE SESSION -PURPOSE OF NEGOTIATIONS, GRIEVANCE &
PERSONNEL; PERSONNEL. Motion and second by Aldermen West/Reed, to go
into executive session to discuss Negotiations, Grievance & Personnel; and Personnel.
Roll call. AYES -Aldermen Hartford, West, Sarff, Harn, Carl, Fillingham, Reed.
NAYS -None. 7 AYES, 0 NAYS, 1 ABSENT. Motion carried.
