A regular meeting of the Canton City Council was held on May 3, 2005 in the Council

OATH OF OFFICE –
City Clerk Nancy Whites gave the Oath of Office to Mayor
Rodney Heinze, City Treasurer Kathleen Luker, Aldermen Ward 1 - Joe Berardi, Ward 2
- Craig West, Ward 3 - Kevin Meade, and Ward 4 - Eric Schenck.
Mayor Heinze made introductory remarks then he introduced Staff Sergeant Mark
Sherbyn of the Army National Guard to lead us in the Pledge of Allegiance and Rev.
Kirk Clayton from the Grace Lutheran Church in Canton to give the Invocation.
PLEDGE OF ALLEGIANCE LED BY SSGT. MARK SHERBYN OPENED THE
MEETING FOLLOWED BY THE INVOCATION GIVEN BY REV KIRK CLAYTON.
Mayor Heinze asked for roll call at 7:05 p.m. Present – Aldermen Larry Sarff, Eric
Schenck, Joe Berardi, Kevin Meade, Les Carl, Jim Hartford, Rick Reed, Craig West.
Absent – None.
ADOPTION OF ROBERTS RULES OF ORDER. Motion
and second by Aldermen
Sarff/West, to adopt Roberts Rules of Order to conduct business. Roll call. AYES –
Aldermen West, Reed, Hartford, Carl, Meade, Berardi, Schenck, Sarff. NAYS – None.
8 AYES, 0 NAYS, 0 ABSENT. Motion carried unanimously.
APPOINTMENT OF CITY ATTORNEY. Motion
and second by Aldermen
Sarff/Meade, to hire the Elson Law firm for 6 months. Discussion. Mayor Heinze gave
the following salary he is recommending for the Elson Law firm. A $2500 month
retainer for creating ordinances, resolutions and agreements; $565 per month to
reimburse for his own health insurance; $90 hour for additional work. Mayor Heinze
said this is same salary we were paying Ron Weber the former city attorney. Alderman
Berardi asked if the appointment would be every 30 days? Mayor Heinze said this is for
the 6 months interim as the city will advertise for any firm wanting this position. Roll
call. AYES – Aldermen Sarff, Schenck, Berardi, Meade, Carl, Hartford, Reed, West.
NAYS – None. 8 AYES, 0 NAYS, 0 ABSENT. Motion carried.
COMMUNICATIONS FROM MAYOR HEINZE.
Mayor Heinze said he came
thorough this election having a better appreciation of those running for office. Eric
Schenck said he was glad to be here. Joe Berardi said it was one of the nicest election he
has ever been in, never heard a bad word from anybody. Alderman Meade said he was
looking forward to getting to work. Alderman Craig West said he was proud to be back,
and working to move the City forward. Alderman Reed congratulated the other city
officials and gave his thanks that he could be here. Alderman Carl congratulated the
mayor and others. Alderman Sarff congratulated and welcomed the new aldermen. The
work on the Budgets is just getting started. City Treasurer Kathy Luker offered her
thanks and appreciation. City Clerk Nancy Whites thanked the voters for giving her 8
elections, and offered her willingness to help everyone.
Motion
and second by Aldermen Meade/Hartford, the appointments of the City Council
Committees and Chairman be confirmed. Discussion. Mayor Heinze wants to have a
committee of Long Range Planning and Alderman Jim Hartford is willing to serve as
chairman of that committee. Streets & Garbage will be under Public Works, Water &
Sewer. Before the committee’s names can be changed an ordinance will be presented at
a future council meeting.

NEW BUSINESS:
RESOLUTION – PARADE BY THE CANTON CHAMBER OF COMMERCE &
COACHMEN MOTOR CLUB ON JUNE 18, 2005.
First reading, read by title.
Motion
and second by Aldermen Hartford/Reed, the resolution be adopted. Roll call.
AYES – Aldermen Sarff, Schenck, Berardi, Meade, Carl, Hartford, Reed, West. NAYS
– None. 8 AYES, 0 NAYS, 0 ABSENT. Motion carried. Resolution being #3728.
EXECUTIVE SESSION – THREATENED, PENDING LITIGATION; AND
PERSONNEL. Motion
and second by Aldermen Sarff/Schenck, to go into executive
session for the purpose of discussing litigation and personnel. Discussion. Mayor
Heinze announced those staying for the executive session will be the elected officials.
Roll call. Aldermen West, Reed,Hartford, Carl, Meade, Berardi, Schenck, Sarff.
NAYS – None. 8 AYES, 0 NAYS, 0 ABSENT. Motion carried.
The regular scheduled council meeting convened at 7:29 p.m. for an executive session.
The minutes of the executive session are on file in the office of the city clerk for review.
The regular scheduled council meeting reconvened in open session at 9:04 p.m.
Those attending the open session of the regular scheduled council meeting was all of the
elected officials, Brenda Bowen of the Journal Star, Bill Burnham photographer for the
Daily Ledger, and John Froehling of the Daily Ledger.

Council Meeting 5-03-05 (2 meeting)
Mayor Heinze then read the employment agreement with former City Treasurer Patty
Beaird Franzoni. Patty Beaird Franzoni shall train the new city treasurer, Kathleen A.
Luker, a maximum of 160 hours at a flat rate of $15.38 per hour for a maximum total of
$2,140.60 training pay. Patty’s current salary is $32,000 annually divided by 2080
hours annually, $15.38 per hour approximately. The training period hours will be
preformed between Wednesday, May 4, 2005 and Friday, June 10, 2005. Patty will keep
track of her hours and Kathleen will verify them. Patty will also receive May 2005 health
care benefits. Patty will not receive overtime pay, holiday pay, sick pay or vacation pay
for this time period.
If Patty Beaird Franzoni should quit for any reason before completing the 160 hours
training period, Patricia Wright, retired city treasurer, could be asked to finish the
completing training period at the above pay and hours. Patricia Wright would need to
complete her training period with the new city treasurer 60 days from the date that Patty
Beaird Franzoni terminated.

and second by Aldermen Sarff/Carl, to approve of the Conditional Training
Period Agreement. Roll call. AYES – Aldermen Sarff, Schenck, Berardi, Meade, Carl,
Hartford, Reed, West. NAYS – None. 8 AYES, 0 NAYS, 0 ABSENT. Motion
carried.
Adjournment. Motion
and second by Aldermen Hartford/Reed, to adjourn. Voice
vote, motion carried unanimously. The regular scheduled council meeting adjourned at
9:11 p.m.
