HomeMy WebLinkAboutResolution #5385 - authorizing and directing the mayor to sign a tax compliance certificate and agreement in relation to the public water supply loan program (PWSLP) RESOLUTION NO A RESOLUTION AUTHORIZING AND DIRECTING THE MAYOR TO SIGN A TAX COMPLIANCE CERTIFICATE AND AGREEMENT IN RELATION TO THE PUBLIC WATER SUPPLY LOAN PROGRAM (PWSLP) WHEREAS, the City of Canton, Illinois (the "City") intends on applying to the Illinois Environmental Protection Agency for a loan with the Illinois Public Water Supply Loan Program (PWSLP); WHEREAS, on July 19, 2022, the City passed Ordinance No. ; 4 2: authorizing the City to apply for said loan program; WHEREAS, as part of the loan application process, it is necessary for the City to submit a Tax Compliance Certificate and Agreement; WHEREAS, the Mayor and City Council have determined that it is necessary and in the best interests of the City of Canton for the Mayor to execute and deliver the Tax Compliance Certificate and Agreement,attached hereto as"Exhibit A",pursuant to the loan application process for the PWSLP. NOW,THEREFORE,BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF CANTON,ILLINOIS,AS FOLLOWS: 1. That the Recitals set forth above, and all facts and statements contained therein, are found to be true and correct and are hereby incorporated and adopted as part of this Resolution; 2. That the Tax Compliance Certificate and Agreement attached hereto and incorporated herein as Exhibit "A" is hereby approved. 3. That the Mayor of the City of Canton, Illinois is hereby authorized and directed to execute said Agreement on behalf of the City of Canton. 5. That this Resolution shall be in full force and effect immediately upon its passage by the City Council of the City of Canton, Illinois and approval by the Mayor thereof. I do further certify that Ordinance Number ° 2.9 , being the Ordinance entitled:An ordinance authorizing the City of Canton,Fulton County Illinois to borrow funds from the public water supply loan program was presented to and passed by the Mayor and City Council of the City of Canton at its legally convened meeting held on the 19th day of July,2022,and signed by the Mayor of the City of Canton on said day. I do further certify that the Ordinance was duly and properly published in the Canton Daily Ledger, a newspaper published and of general circulation within the City of Canton, on the 2 -if+ib day of July, 2022, being a date within ten days from the date of passage of the Ordinance. I do further certify that publication of the Ordinance was accompanied by a separate publication of notice of(1) the specific number of voters required to sign the petition requesting the question of constructing improvements to the public water supply system as provided in the Ordinance; (2) the time in which such petition must have been filed; and (3) the date of the prospective referendum. I do further certify that I did make available and provide to any individual so requesting a petition form,which petition form provided for submission to the electors of the City of Canton of the question as set forth therein. OWNER and CONTRACTOR entered into an Agreement on February 1,2022 for Work generally described as City of Canton Water Treatment Plant—2019 Improvements. The February 1, 2022 Agreement references in the Contract Document the use of Davis-Bacon Wages and the construction type of Heavy Construction Projects and Highway Construction Projects. Upon further review of the U.S. Department of Labor website, OWNER and CONTRACTOR agree to change the Davis-Bacon Wage construction type from Heavy Construction Projects and Highway Construction Projects to Building Construction for all Work.
