AN ORDINANCE SUSPENDING SECTION 1-9-27 OF THE CANTON MUNICIPAL
CODE AND AUTHORIZING CLIFTON LARSON ALLEN TO PROVIDE PAYROLL
SERVICES TO THE CITY OF CANTON
WHEREAS, the City of Canton, Fulton County, Illinois (the "City") is an Illinois non-
home rule municipal corporation, established in accordance with the constitution of the State of
Illinois of 1970;
WHEREAS, the City Clerk, Diana Pavley-Rock, has tendered her resignation and
retirement letter to the City, effective August 4, 2022;
WHEREAS, pursuant to the Canton Municipal Code (the "Code"), the City Clerk is
required to complete payroll,receiving training on the City's payroll system, and maintain records
detailing wages and accurate deductions for employees;
WHEREAS, Section 1-9-27 of the Code contains provisions related to the performance of
payroll by the City Clerk and states as follows:
1-9-27: PAYROLL:
Upon receipt of a written record of each employee's time at work, the city clerk shall
complete payroll for each employee certifying their weekly time, amount of wages and
accurate deductions. The city clerk shall routinely receive training on any payroll system
the city uses and shall at all times maintain records detailing wages and accurate
deductions. (Ord. 1201-A, 2-2-2010)
WHEREAS,the Mayor is in the process of selecting an appointee to fill the vacancy to be
caused by the City Clerk's resignation;
WHEREAS, in order to ensure that payroll is timely-completed and to maintain a
continuity in City operations, the City Council believes it is necessary and in the best interests of
the City to suspend Section 1-9-27 of the Code until an Acting City Clerk is duly appointed;
NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY
OF CANTON, FULTON COUNTY, ILLINOIS AS FOLLOWS:
Section 1. That the City hereby finds as fact the recitals set forth above and incorporates
said recitals herein as though fully set forth.
Section 2. Effective at 5:00 p.m. on August 4, 2022, Section 1-9-27 of the Code is hereby
suspended until the appointment of an Acting City Clerk by the Mayor and consent of the
appointment by the City Council (collectively the "Appointment").
Section 3. Effective upon the passage of this Ordinance, the Mayor is authorized to
designate and order City staff, employees, and officials to complete payroll for the City's
employees and to maintain records detailing wages and accurate deductions.

Section 4. Effective upon the passage of this Ordinance, in order to assist the City with
completing its payroll and maintaining records, the Mayor is authorized to utilize the services of
Clifton Larson Allen until the Appointment is complete, and thereafter, if necessary to train the
incoming Acting City Clerk and his or her staff;
Section 5. That all ordinances or parts thereof in conflict with this Ordinance are hereby
expressly repealed.
Section 6. If any part or parts of this Ordinance shall be held to be unconstitutional or
otherwise invalid, such unconstitutionality or invalidity shall not affect the validity of the
remaining provisions of this Ordinance.
Section 7. Except as otherwise provided herein, this Ordinance shall be in full force and
effect from and after its passage and approval as provided by law.
