DISCUSS, CONSIDER AND VOTE ON AN ORDINANCE ADOPTING THE BUDGET FOR ALL
CORPORATE PURPOSES OF THE CITY OF CANTON, FULTON COUNTY ILLINOIS IN LIEU OF AN
APPROPRIATION ORDINANCE FOR THE FISCAL YEAR BEGINNING MAY 1, 2022 AND ENDING

Motion and second were made by Alderperson Chamberlin/Nelson to approve the ordinance
adopting the budget for all corporate purposes of the City of Canton, Fulton County Illinois in lieu
of an appropriation ordinance for the fiscal year beginning May 1, 2022 and ending April 30, 2023.
Attorney Jump stated for the record that a budget hearing was held today at 6:00pm for the
budget, followed by a clerical committee meeting at 6:15pm. The committee recommended to
send the budget to council for approval. The proper notices for the budget were published in the
newspaper.

DISCUSS, CONSIDER AND VOTE ON THE PURCHASE OF NEW IN-CAR MOBILE DATA
COMPUTER/MOUNTING SYSTEM
Interim Chief Mike Eveland explained that the police department currently uses 8 Panasonic fully
rugged CF-31 touch book mobile data computers (in-car computers) in the police fleet. All of
them are refurbished computers, meaning they have all been sent back to the company for new
hard drives and replacement parts. The GPS monitoring systems in three of them do not work
and the touch screen functions in three of them do not work. The plan is to start replacing them
with new units as funds are available. This purchase will be from CDS Office Technologies based
off of their state of Illinois master contract prices. The unit being requested to purchase is the
Panasonic Toughbook semi-rugged FZ-55, which is the same model used by units of the Illinois
State Police. Purchasing this model will be a savings of approximately $1,000.00 per unit
compared to replacing with the current models (CF-31 fully rugged). The purchase includes a
five-year extended service plan.

DISCUSS AND CONSIDER AN ORDINANCE REGULATING FOOD TRUCKS AND FOOD VENDORS WITHIN THE
CITY OF CANTON.
Mayor McDowell explained that the city has been looking at ordinances from surrounding communities
pertaining to food trucks. A draft ordinance has been started, but the council will need to determine the
various regulations they would like to have included in the final ordinance. Some municipalities designate
specific areas for food trucks to be setup within the community. Prior discussion took place about allowing
food trucks at Canton Lake. The council would need to determine the areas of the lake that would allow
food trucks. Mayor McDowell stated that he believes the area around the square and Elm Street/White
Court would be prohibited from allowing food trucks except during special events. This area is where
many of the restaurants/business are located, and the city would not want to interfere with their
businesses. The city would need to determine if food trucks would be allowed in the former JC Penney’s
parking lot.
Attorney Jump said that the entire transient merchant section of the code could be updated. The city has
been using this section of the code for various food vendors and on-site vendors. It was determined that
the food trucks should be a separate section of the code, but also updating the transient merchant section
of the code.
City Clerk Diana Pavley Rock explained that food trucks have become very popular in many communities
and believes the city should have a section in the code specific to food truck regulations. Diana also
suggested looking at changing the current fee structure, which is based on a per day fee to an annual fee.
The city requires a certificate from the health department and a certificate of insurance prior to a license
being issued. Diana suggested looking at surrounding communities fee structure to determine the
appropriate amount to charge. The City should also include in the revised code a requirement of having
a signed authorization from a business owner to be on their private property prior to a license being issued
from the city.
Attorney Jump will prepare an ordinance to update the transient merchant section of the code and create
a section specific to food trucks. The ordinance will be brought back to council for consideration.

DISCUSS, CONSIDER AND VOTE ON A RESOLUTION WHETHER (1) THE NEED FOR
CONFIDENTIALITY STILL EXISTS AS TO ALL OR PART OF THE CLOSED MINUTES OR (2) THAT THE
CLOSED MEETING MINUTES OR PORTION THEREOF NO LONGER REQUIRE CONFIDENTIAL
TREATMENT AND ARE AVAILABLE FOR PUBLIC INSPECTION. RESOLUTION #5366
Attorney Jump explained that the city is required to review the closed meeting minutes every six months
and to determine if the need for confidentiality still exists or if the closed meeting minutes or a portion
no longer require confidential treatment.
Attorney Jump explained that he reviewed the minutes with City Clerk Diana Pavley Rock and he
believes that the need for confidentiality still exists.

Attorney Jump explained that there are two legal descriptions regarding Canton Park District and
one for Kevin Williams. To obtain the MFT dollars, the city must own the right of way.

DISCUSS, CONSIDER AND VOTE ON AN ORDINANCE AMENDING THE ZONING CODE TO
ST
REGULATE THE OPERATION OF SHORT-TERM RENTALS WITHIN THE CITY OF CANTON. (1
Reading) ORDINANCE #4288
The council previously proposed to have this discussed at the planning and zoning meeting. Two
meetings and public hearings have taken place with planning and zoning. The planning and
zoning committee approved the proposed ordinance with the understanding that Attorney Jump
may make a few additional changes based upon their discussion. The ordinance being presented
to council includes the revisions.
The ordinance regulates short term rentals and those commonly referred to as VRBO or Airbnb.
The ordinance would require them to go to the planning and zoning committee on each specific
request. The planning and zoning committee would then make their recommendations to the
council. If the location is in a residential neighborhood, the process would allow time for citizens
to express their concerns and to be heard. Those applying for short term rental would be subject
to hotel/motel tax and reporting requirements. The city would be allowed to inspect the
properties if needed. Applicants would need to renew annually after approved.

SRPED Cole McDaniel will have an update at the next council meeting. Alderperson John Lovell
announced that Casey’s should be breaking ground in the next 2-4 weeks. Arby’s is in the
process of building at their location on Main Street.

Mayor McDowell explained that inquires have been made regarding getting a camp site at Canton
Lake. There is a list at the campground for campers. Individual are consistently paying to reserve
campsites for the next year. The city is trying to find additional spaces for campers. The slips are
currently filled up at the lake. An additional 6 slips will be brought in to bring the total up to 18.
The kayak slips are built and repaired. The new boat dock is finished. The lake is well stocked
with fish. The electric was updated from 30 to 50 amps. New fixtures were placed in the
restrooms and painting will soon be taking place.
This week a pipe broke at the water treatment plant which caused a system wide boil order. The
city staff responded quickly and was able to get the situation under control in a very short amount
of time. The city performed testing prior to lifting the boil order. The city will be utilizing grant
funds to be able to upgrade the water treatment plant.
