HomeMy WebLinkAboutOrdinance # 1909 ORDINANCE NO. 1909 An Ordinance re-zoning certain property of Canton Country Club, LLC to a Planned Unit Development ("PUD") zoning configuration. WHEREAS, the property described on Exhibit A, which is attached hereto and made a part hereof ("Country Club Property"), is located within the corporate limits of the City of Canton, Fulton County, Illinois; and WHEREAS, the Country Club Property is currently zoned AG- l ,Agricultural District, under the Canton City Code; and WHEREAS, Canton Country Club, LLC is the owner of the Country Club Property and has petitioned the City Council of the City of Canton, Illinois, that the property be re-zoned to a PUD zoning configuration in order to sell lots for residential homes, which is in conformity with other property near the Country Club Property; and WHEREAS, the surrounding neighborhood consists of agriculture, business and residential uses, and the re-zoning of the Country Club Property to PUD would be consistent with the current uses in the area; and WHEREAS, on August 13, 2007, the Planning and Zoning Commission of the City of Canton met, pursuant to notice as required by law, and held a public hearing concerning the Petitioner's request to re-zone the property to a PUD zoning configuration, and, at the meeting, no objectors were present and no objections to the Petitioner's request were voiced, and, after said hearing, the Planning and Zoning Commission unanimously recommended to the City Council of the City of Canton, Illinois, the re-zoning of the property to a PUD zoning configuration; NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF CANTON, ILLINOIS, A MUNICIPAL CORPORATION: Legal Description Part of the Southeast Quarter in Section 15, Township 7 North, Range 4 East of the Fourth Principal Meridian, Fulton County, Illinois, more particularly described as follows: Commencing at the Northwest Corner of said Southeast Quarter, thence North 89°-19'- 05" East (bearings assumed for description purposes only) along the north line of said Southeast Quarter 595.79 feet to a point, said point being the Point of Beginning of the Parcel to be described; From the Point of Beginning, thence North 89°-19'-05" East continuing along said north line 1928.09 feet to a point on the westerly right of way line of Fourth Avenue; thence South 0°-40'-55" East along said westerly right of way line 33.00 feet; thence South 43°- 48'-34" East continuing along said westerly right of way line 68.50 feet; thence South 0°- 40'-08" West continuing along said westerly right of way line 69.60 feet to a point on a line parallel with and 152.56 feet measured perpendicular south of said north line; thence South 89°-19'-05" West along said parallel line 230.46 feet; thence South 72°- 46'-18" West 47.16 feet to a point on a line parallel with and 166.00 feet measured perpendicular south of said north line; thence South 89°-19'-05" West along said parallel line 1135.81 feet; thence North 0°-40'-55" West 10.00 feet to a point on a line parallel with and 156.00 feet measured perpendicular south of said north line; thence South 89°- 19'-05" West along said parallel line 498.68 feet; thence along a curve to the left an arc distance of 438.74 feet, said curve being concentric with and 100.00 feet measured radial easterly of the easterly right of way line of Illinois Route 78, said curve also having a radius of 5533.62 feet and a chord bearing South 0°-05'-30" East 438.63 feet to a line parallel with and 100.00 feet measured perpendicular east of said easterly right of way line; thence South 2°-12'-31" East along said parallel line 327.34 feet; thence South 89°- 19'-05" West 100.04 feet to a point on said easterly right of way line; thence North 2°- 12'-31" West along said easterly right of way line 324.41 feet; thence along a curve to the right an arc distance of 528.10 feet along said easterly right of way line, said curve having a radius of 5633.62 feet and a chord bearing North 0°-19'-21 " East 527.91 feet; thence North 46°-03'-01 " East continuing along said easterly right of way line 44.09 feet; thence North 0°-40'-55" West continuing along said easterly right of way line 39.49 feet to the Point of Beginning. Said Parcel contains 9.094 acres, more or less. EXHIBIT A i 1. That the property described on Exhibit A and known as the Country Club Property shall be and the same hereby is re-zoned to a PUD zoning configuration. 2. That the corporate authorities of the City of Canton, Illinois, and their respective officers and agents shall be and they are hereby authorized to amend the applicable maps of the City of Canton, Illinois, to so reflect the re-zoning to a PUD zoning configuration. 3. That a copy of this Ordinance shall be filed with the appropriate authorities of the County of Fulton and State of Illinois, to reflect the re-zoning, all as made and provided for by law. 4. That the Mayor of the City of Canton, Illinois, shall be and he is hereby authorized to affix his signature as the Mayor of said City to this Ordinance and the City Clerk of the City of Canton, Illinois, shall be and she is hereby authorized to attest such signature thereto.
