A regular meeting of the Canton City Council was held on April 5, 2022 (6:30pm) via zoom.

ALDERPERSON ANDRA CHAMBERLIN, CHAIR
DISCUSS, CONSIDER AND VOTE ON AN ORDINANCE ADOPTING THE BUDGET FOR ALL
CORPORATE PURPOSES OF THE CITY OF CANTON, FULTON COUNTY ILLINOIS IN LIEU OF AN
APPROPRIATION ORDINANCE FOR THE FISCAL YEAR BEGINNING MAY 1, 2022 AND ENDING

DISCUSS, CONSIDER AND VOTE ON A RESOLUTION AUTHORIZING AN ASBESTOS INSPECTION
OF 360 E LINN STREET, CANTON IL 61520 RESOLUTION #5364
Attorney Jump explained that the city obtained an order authorizing the city to continue with the
demolition of the property at 360 East Linn Street. The city will proceed with the next steps in
the demolition process- which includes an asbestos inspection. The asbestos inspection will need
to take place prior to placing bids for contractors on the demolition. The asbestos report would
be provided to Engineer Keith Plavec to be used during the bidding process for the demolition.
The city has been authorized by the courts to remove items from the building and to proceed
with demolition. The city will need to track the expenses that are incurred on behalf of the city.
Once the process is completed, the city will record a lien against the property and determine how
to move forward.
Motion and second were made by Alderpersons Chamberlin/Lingenfelter to authorize an
asbestos inspection at 360 E Linn Street, Canton IL 61520.
DISCUSSION:
Attorney Jump explained that when the city initiated the lawsuit, Darrel Benedict was the owner
of the property. After he was served papers, Darrel transferred the property to a person named
Bill West. The city was not able to find Bill West. The city tried to serve him at the addresses
provided which further delayed the process. There was a default judgement against him. There
was one to the defendant- Charles Belamy trust that bought the taxes. They ended up filing for
sale and error, so they were eventually dismissed from the case. The city added the Fulton
County Trustee for taxing districts, because they hold the last few years of taxes because of the
sale and error. As a result, the Fulton County Treasurer was included. The Fulton County
Treasurer was represented by the Fulton County State’s Attorney. The State’s attorney
consented. He came and was present at the hearing of the summary of judgement last week.
The Fulton County as trustee for the taxing district used an attorney in Southern Illinois, and also
consented to the demolition. Attorney Jump said that since Darrel Benedict was the original
owner there was a judgement placed against him.
Attorney Jump explained that the city would need to keep track of all expenses, so once the
demolition is completed, the city would then have a timeline to record a lien against the property
and decide if the city wanted to foreclose on the lien. The city can include attorney fees n the
expenses that are being tracked.

DISCUSS, CONSIDER AND VOTE ON THE PURCHASE OF TWO SETS OF FIREFIGHTER TURNOUT
GEAR FROM MES
Interim Fire Chief Tony Plumer explained that the prior public safety director was handling this
item, but there was no record of this being approved by council. The purchase of the two sets of
firefighter turnout gear is to replace two sets that reached the end of their lifespan.
Motion and second were made by Alderperson Chamberlin/Lovell to approve the purchase of
the two sets of firefighter turnout gear from MES.

LEGAL AND ORDINANCE

DISCUSS AND CONSIDER AN ORDINANCE REGULATING FOOD TRUCKS AND FOOD VENDORS
WITHIN THE CITY OF CANTON
Mayor McDowell said that he wanted to bring this item to the Council for consideration and
discussion. Currently the city does not have an ordinance specific to food trucks and food
vendors. The city is having individuals come in wanting to operate food trucks. Alderperson
Lovell explained that he was approached by an individual that wanted to setup a food truck at
Canton Lake. Alderperson Lovell said he wanted to find out if they could have a permit at Canton
Lake, and if so where they could setup.
Mayor McDowell said that the city has received requests for food trucks and food vendors at
other locations within the city and wanted to have a specific ordinance pertaining directly to food
trucks and food vendors. City Clerk Diana Pavley Rock explained that she reached out to a few
other municipalities to get copies of their ordinance specific to food trucks and food vendors as
a template which could then be modified based upon the recommendation from council. It
would need to be determined if certain areas would be prohibited and what guidelines should
be included in the ordinance.
Attorney Jump will draft an ordinance and bring it back to the next council meeting for
consideration.
Utility Director Joe Carruthers suggested allowing the food trucks at the pavilion at Canton Lake
and at the campground area. The kayak area should be an area that food trucks would not be
allowed.

Attorney Jump explained that this ordinance is for the other refuse body truck. The city will be
purchasing this separately and the following ordinance will be for one of the actual trucks and
chassis that would be needed. Attorney Jump explained that the city thought they could order
the same exact truck that was previously ordered, but that fell through.
