HomeMy WebLinkAboutOrdinance # 1905-AORDINANCE NO. 1905 ' /~ AN ORDINANCE PROHIBITING PARKING FOR NON-RESIDENTS ON LINDEN STREET BETWEEN MAIN STREET AND FIRST AVENUE, LAWRENCE DRIVE BETWEEN LINDEN STREET AND MA-GRA-BL STREET AND MA-GRA-BL STREET BETWEEN MAIN STREET AND LAWRENCE DRIVE IN THE CITY OF CANTON, FULTON COUNTY, ILLINOIS. WHEREAS, the Legal and Ordinance Committee of the City of Canton, Illinois has determined that it is necessary, desirable and in the best interest of the City of Canton, Illinois to prohibit parking for non-residents on the North side and South side of Linden Street between Main Street and First Avenue, on the East side and West side of Lawrence Drive between Linden Street and Ma-Gra-Bl Street and on the North side and South side of Ma-Gra-Bl Street between Main Street and Lawrence Drive, all in the City of Canton, Illinois, on Mondays through Fridays which are school days excluding holidays between the hours of 7:00 a.m. and 4:00 p.m.; and WHEREAS, the Legal and Ordinance Committee of the City of Canton, Illinois has further determined that it is necessary, desirable and in the best interest of the City of Canton, Illinois to allow residents of the area involved, that is, those persons residing on the North side and South side of Linden Street between Main Street and First Avenue, on the East side and West side of Lawrence Drive between Linden Street and Ma-Gra-Bl Street and on the North side and South side of Ma-Gra-Bl Street between Main Street and Lawrence Drive, all in the City of Canton, Illinois, to park their vehicles in said area provided their vehicles display the necessary residential decal or permit which decal or permit shall be issued by the Canton Police Department to the residents of the area involved; and WHEREAS, the City Council of the City of Canton, Illinois has made similar determinations. 1 NOW, THEREFORE, BE IT ORDAINED BY THE MAYOR AND CITY COUNCIL OF THE CITY OF CANTON, Fulton County, Illinois, as follows: 1. That no parking of any vehicle by non-residents of the area involved shall be permitted on the North side and South side of Linden Street between Main Street and First Avenue, on the East side and West side of Lawrence Drive between Linden Street and Ma-Gra- Bl Street and on the North side and South side of Ma-Gra-Bl Street between Main Street and Lawrence Drive, all in the City of Canton, Illinois on Mondays through Fridays which are school days excluding holidays between the hours of 7:00 a.m. and 4:00 p.m. and that every driver of a motor vehicle other than residents of the area involved shall refrain from parking any vehicle under his or her control on such streets during such times. 2. That residents of the area involved, that is, those persons residing on the North side and South side of Linden Street between Main Street and First Avenue, on the East side and West side of Lawrence Drive between Linden Street and Ma-Gra-Bl Street and on the North side and South side of Ma-Gra-Bl Street between Main Street and Lawrence Drive, shall be permitted to park their vehicles in said area during such times provided their vehicles display the necessary residential decal or permit which decal or permit shall be issued by the Canton Police Department to the residents of the area involved. 3. That, upon request, the Canton Police Department shall issue a maximum of three residential decals or permits per household to those residents abutting the areas designated in this Ordinance. 4. That the residents of the areas designated in this Ordinance shall display the residential decal or permit in each of their vehicles in order to park in the areas designated in this Ordinance. 2 5. That the Street Superintendent of the City of Canton, Illinois shall post appropriate signs informing the public of this Ordinance. 6. That any person who violates this Ordinance shall, upon conviction or plea, be subject to a fine of not less than five dollars ($5.00) and no more than twenty-five dollars ($25.00) for each such offense. 7. That this Ordinance shall be in full force and effect ten (10) days after its passage by the City Council of the City of Canton, Fulton County, Illinois, approval by the Mayor thereof, and publication in pamphlet form as provided by law. PASSED by the City Council of the City of Canton, Fulton County, Illinois, at a regular meeting this 15th day of May , 2007 upon a roll call vote as follows: AYES: A]-dexmen.
