A regular meeting of the Canton City Council was held on February 15, 2022 (6:30pm) via zoom.

ADDITIONS OR CORRECTIONS TO THE AGENDA
Treasurer Wilkinson explained that the disbursement report was on the last meeting, so this
should be removed from the finance committee agenda.
Alderperson Justin Nelson said that he would like to strike the first item from the Negotiations,
Grievance and Personnel committee agenda. Alderperson Nelson also asked to move his
committee items to the beginning of the meeting so he could be excused immediately after.

DISCUSS, CONSIDER AND VOTE ON: A RESOLUTION APPROVING A COLLECTIVE BARGAINING
AGREEMENT AND RELATED AGREEMENTS BETWEEN THE CITY OF CANTON AND CANTON
FIREFIGHTERS, LOCAL 1897, I.A.F.F., A.F.F.I., AFL/CIO AND AUTHORIZING AND DIRECTING THE
MAYOR AND THE CITY CLERK TO EXECUTE SAID COLLECTIVE BARGAINING AGREEMENT

collective bargaining agreement and related agreements between the City of Canton and Canton

Discussion:
Attorney Jump suggested having the item on the bill list for case involving Taylor Long be paid
from a different fund, since this is a commercial property. The demolition fund is designed more
for the residential properties.

to approve the bill list with the changes.

DISCUSS,CONSIDER AND VOTE ON A RESOLUTION APPROVING AN AGREEMENT BETWEEN THE
CITY OF CANTON AND LOZIER OIL COMPANY FOR THE PURCHASE OF FUEL
Utility Director Joe Carruthers explained that this is the third year that the city has used their
customer fuel contract. This is a way for the city to lock in their fuel rates, which creates a
savings for the city.

DISCUSS CONSIDER,AND VOTE ON:AN ORDINANCE AMENDING TITLE 9, CHAPTER 10, SECTION
1 OF THE CITY CODE FOR PURPOSES OF STOP SIGNS LOCATED AT THE INTERSECTION OF
SYCAMORE STREET AND NORTH FIRST AVENUE (1ST READING).
Attorney Jump explained that discussion took place with the city engineer, police chief and the
school district regarding a stop sign that was located on school property. After looking further
into the ordinance, it was realized that there was a typo with Sycamore Street vs Sycamore
Terrace. Sycamore changes from Terrace to Street once you cross Main Street. One of the stop
signs may not have been included, so the proposed ordinance will make the update to reflect the
locations of the current stop signs at the Northwest and Southwest corners of 15t Avenue and
Sycamore Street.

DISCUSS CONSIDER,AND VOTE ON:AN ORDINANCE AMENDING TITLE 1, CHAPTER 13, SECTION
1 OF THE CITY CODE FOR PURPOSES OF DESIGNATING CITY DEPOSITORIES (1sT READING).
Treasurer Crystal Wilkinson explained that the current code needed to be updated to reflect
current banks that are being used. The proposed ordinance updates the proper names of
financial institutions used for various accounts.

DISCUSS, CONSIDER, AND VOTE ON: A RESOLUTION APPROVING CHANGES TO EXISTING
CHECKING ACCOUNTS AT MIDAMERICA NATIONAL BANK FOR THE WATER/SEWER GENERAL
FUND.
Treasurer Crystal Wilkinson explained that the water and sewer general fund has a sweep
account attached to it,which draws interest for the city after a specific trigger amount is reached.
Once the limit is reached, the funds are swept into a higher interest- bearing account. The new
account will increase from .006% to .02%. The city will transfer from the former sweep account
to the newly established sweep account with the higher interest rate at Midamerica National
Bank.

DISCUSS, CONSIDER, AND VOTE ON: AN ORDINANCE AMENDING TITLE 8, CHAPTER 8, SECTION
4 (THE RULES, REGULATIONS AND DEFINITIONS OF CEMETERY) OF THE CANTON MUNICIPAL
CODE (1ST READING).
Attorney Jump explained that two sections of the code are being amended as it relates to the
foundations. Language was added for the purpose of foundation flanges, polished granite shall
be the only permissible material for foundation flanges. The installation of concrete foundations
is prohibited.
The other change was in relation to decoration cleanup. Rather than being three times per year,
it will now be two times per year that the cemetery shall have when the decorations will be
removed. Decorations to be retained shall be removed prior to the 7-day period, rather than 15
days. Language was also changed to reflect the dates that all decorations be removed from the
grave site-which is from April 1-April 7. The second date is from July 15-July 21that ground level
decorations will be removed.

DISCUSS, CONSIDER AND VOTE ON PROPOSING TO THE JOINT PLANNING AND ZONING
COMMISSION: AN ORDINANCE AMENDING THE ZONING CODE TO REGULATE THE OPERATION
OF SHORT-TERM RENTALS WITHIN THE CITY.
Attorney Jump explained that the city has some individuals in town that would like to open some
Airbnb's in the city. Attorney Jump recommended having these request go before the zoning
commission. A license would need to be issued to open an Airbnb. Having any requests for an
Airbnb go before the commission would also create an opportunity for any objections from
neighbors that might be opposed to having an Airbnb next to them. Individuals opening an
Airbnb would also be required to pay hotel/motel taxes. Attorney Jump recommends sending
this item to the planning and zoning commission for their review and recommendation.

ordinance amending the zoning code to regulate the operation of short-term rentals within the
city to the joint planning and zoning commission.

DISCUSS, CONSIDER AND VOTE ON APPROVING A RESOLUTION APPROVING STIPULATIONS
AND OTHER AGREEMENTS WITH CANTON HARVESTER INN FOR PROPERTYTAXES IN RELATION
TO TAX YEARS 2020-2023 AND AUTHORIZING THE CITY ATTORNEY AND MAYOR TO EXECUTE
ALL NECESSARY DOCUMENTS TO ACCOMPLISH SAME.
Attorney Jump explained that there is a settlement agreement to go along with the resolution
that will need to be executed by the Fulton County Board of Review as well as the Canton
Harvester Inn. This would resolve the current pending property tax appeal case as well as the
appeal before the Fulton County Board of Review for 2021 taxes. The PTAB case is 2020, the
board of review case is 2021. It would also reach an agreement on the equalized assessed value
for tax years 2022 and 2023. Attorney Jump said he would like the approval prior to entering
into the settlement agreement.

MAYOR COMMUNICATION
Mayor McDowell thanked all city staff for their work in cleaning the city streets after the recent
snow storm.
Mayor McDowell reminded the public that the city is under another winter warning this coming
weekend and the parking ban will be in place. Vehicles should be removed from the street so
the street department can remove snow from the streets.
Beginning in March, the meetings will return to in person and will be held at the historic depot.
The mask ban will be removed at the end of February, but anyone that feels uncomfortable are
encouraged to wear a mask.

Attorney Jump said that he is working at revising some ordinances as it pertains to tobacco
violations. There has been a significant rise in the ordinance violations in relation to tobacco.
Vaping has become more popular along with the tobaccoless nicotine pouches. The ordinances
will need to be updated to reflect these items. Determination will need to be made on violations
for juveniles in working together with the school district on these violations. A draft ordinance
will be brought to council at a later meeting.
