HomeMy WebLinkAbout09-23-08 Mechanical Committee Meeting Minutes The Canton City Council Mechanical Committee was held on September 23, 2008 th in Council Chambers, at the Historic Depot, 50 North 4 Avenue, Canton, Illinois. Mayor Kevin Meade called the meeting to order at 6:30 p.m. Those in attendance – Aldermen Eric Schenck, Joe Berardi, Craig West, Pam Ihnes, Sonya Lewis. Absent – Aldermen Larry Sarff, David Nidiffer, Jason Strandberg. Also attending - Mayor Kevin R. Meade, City Clerk Nancy Whites, City Attorney Chrissie Peterson, Interim City Treasurer Julie Smick, Police Chief W. Dan Taylor, Fire Chief Bonnie Cremer, Public Works Director Clif O’Brien, Wastewater Treatment Supt. Joe Carruthers, Water Treatment Supt. Greg Pollitt, System Maintenance Supt. Bill Terry, Joe Ginger video services. In the audience was Rachel Rose, Brenda Rothert, Jason Myetich representing Maurer-Stutz Inc., Steve Reed, News media of Daily Ledger – John Froehling, WBYS – Mark Bixler, The Democrat – Wendy Martin. PUBLIC SAFETY & TRAFFIC ALDERMAN JOE BERARDI, CHAIRMAN Police Report. Police Chief W. Dan Taylor highlighted his report to say, they made an important arrest as the gentleman was wanted for murder out of Missouri. A lot of team work was involved when he was on the run. During the month of August the Special Operations concluded an investigation on a local man who had been dealing 1 to 2 pounds of cannabis per week in Canton. The arrest of this person also netted the suspect’s vehicle of a 1993 Chevy Caprice and cash. Several students reported that over $500 was taken during band practice. We made the arrest and recovery of $541 was received. Article 13 is having to do with seizures. We do drug and narcotics seizures. Article 36 is a civil process. If the person has had several criminal offenses we can 1 seize the car. Alcohol and no insurance, can seize the car. Burglary can seize the car. We have seize two cars in a week. In the future at the next Legal & Ordinance Committee, would like to have an resolution to add line item to the Budget under the Gaming Fund. We have lost and found property dating back to 1980 that has never been addressed. Detective Grant is working on getting a list for the paper, and if we don’t get rightful owners we can sell the items. Want to put those funds toward Article 36 as I don’t want to use tax payers money. Fire Report. Fire Chief Bonnie Cremer highlighted her report. Fire located at 45 East Vine Street, on the roof and the back porch. An estimated $2,000 in damage occurred. The cause was determined to be caused by a stray spark from a neighboring brush fire landing on the roof. The second fire at 815 Anderson Place, caused an estimated $4,000 in damage and is under investigation. Vehicle fire located at 840 West Locust Street, had been extinguished by the owner prior to fire personnel’s arrival. There were 19 simultaneous alarms during the month of August. Lance Lusk attended an EMS Lead Instructor Class, August 1, 2 & 3 at Elmhurst, Illinois. Lance is a very knowledgeable Emergency Medical Technician Paramedic and is willing to devote the time commitment to become a Lead Instructor for the department. Fire Chief attended the Fire and Rescue International Conference in Denver, thth Colorado, August 12 through the 16. The class room sessions provided an excellent selection of topics and speakers. The sessions dealt with topics of firefighter deaths and injuries, the changing culture in the fire service and near miss incidents. Retired Coast Guard Captain Larry Brudnicki was the keynote speaker Thursday morning and he related his approach to decision making to the Fire and Rescue 2 International attendees. He was captain of the ship involved in rescues relayed in the book and movie, “The Perfect Storm.” th On August 6 the Canton’s Dive Team members were called to assist with a victim search following a boating accident at the Conservation Area located near Bryant. The victim’s body was recovered about three hours later. The 5 inch supply line and adapters arrived were placed in service. Two of our three apparatus now carry the 5 inch supply hose. Animal Control Ordinance. Police Chief W. Dan Taylor said he wants to go out for bids locally on one new truck and one new vehicle. A total of three vehicles are in the Budget. Will give the 1997 animal control vehicle to Public Works department. Alderman Berardi made the motion to allow the bids for a used or new truck for the animal control officer. Was duly seconded by Alderman West. Discussion. Alderman Berardi wants all the city’s vehicles to be one color. The motion carried by voice vote, and was unanimous. Alderman Berardi made the motion to go out for bids for a detective car. Was duly seconded by Alderman Schenck. Discussion. Police Chief W. Dan Taylor said he would be coming back to the committee later for a Fleet Plan. The motion carried by voice vote, and was unanimous. Enforcement of Vicious Dog Ordinance. Alderman Schenck said he had a pit bull attack his dog and had to use a baseball bat to end the attack. Pit bulls by definition I want them to be require a muzzle. Police Chief W. Dan Taylor said this is not strictly on vicious dogs. Talked with animal control officer Dustin Pollitt of how many times issues citation. Zero times. Under the former chief and himself, we were singled out as being unconstitutional against one dog. Talked to City Attorney Chrissie Peterson, and she feels the same way. Will start to enforce that, as it has not been in the past. Alderman Schenck asked if can amend the ordinance as ours does not have an appeal process and also does not have amount of the fine. It is well designed for property owners and dog owners with safe guards. 3 Public Comments. Alderman Berardi said he was wrong last week on how long a person can participate, or, can speak at our meetings. I found out it was 5 minutes. Use of City meeting rooms. Mayor Kevin Meade said that our Board room is being used for a meeting with registered sex offenders. They meet currently on Thursday nights. While they are there the different logistic has given the police department problems. The sex offenders check in on a weekly bases. This is private meting, as Mr. Sherar is paid by them. The Firehouse was suggested, and I questioned the appropriateness. They meet from 5:00 p.m. to 7:00 p.m. Alderman Berardi said they can get their own place. Want to defer who schedules what property. Alderman Berardi made the motion having the Police Chief designates who comes or goes in the Police Building, and the Fire Chief designates who comes and goes in the Fire Department, and refer to council. The motion carried by voice vote, and was unanimous. Mayor Kevin Meade said we already have a policy on the fees for the use of the Depot. Purchase of Ballistics Vests. Police Chief W. Dan Taylor stated that two new Police Officers will be starting work on 9/02/08 and a third Police Officer is currently in the final stages of testing. All three of these officers will be in need of a ballistic vest. One of these vests is budgeted and the other two are not. Dan is requesting to purchase three Armor Express Halo Level IIIA vests from the Ray O’Herron Company for the quoted price of $775.00 per vest. A total of $1,050.44 of these vests will be covered with the Department of Justice Grant. The cost breakdown for these vests is as follows: Armor Express Halo Level IIIA vest – 3 @ $775.00 each $2,325.00 Less Grant Funding ($1,050.44) Total cost to Department $1,274.56 4 They have to pay the full amount of $2,325.00 up front and then submit for reimbursement from the Department of Justice. Alderman Berardi made the motion to accept the request of three Armor Express Halo Level 111A vests from Ray O’Herron Company in the amount of $$2,325.00, and refer to council. Was duly seconded by Alderman Lewis. Discussion. Police Chief W. Dan Taylor said you cannot hand the vest down. They are made for each person. The motion carried by voice vote, and was unanimous. Police Department Vehicle Fleet of one new truck and one new car. Police Chief W. Dan Taylor submitted a 5-year Fleet Plan that has been successful in the past as far as enhancing safety, improving the value of the fleet, reducing gasoline consumption, reducing maintenance costs and re-investing local tax dollars into the economy. Requesting to replace the Animal Control/Code Enforcement Officer truck which is a 1997 Ford Ranger with a topper. This vehicle has approximately 112,000 miles on it and currently gets approximately 13 MPG with a V-6 engine. Requesting to replace this truck with a full sized extended cab pickup truck. The extended cab portion of the truck would enable the Officer to keep his catch pole, dart gun, files and other equipment in that portion of the truck. The reason for a full size vehicle versus a small truck and the full size truck would allow for more cage room to handle more dogs. Another advantage to the full size truck is that when the Officer picks up found bicycles he has to unload the dog cage and equipment in order to make room for bicycles. The 1997 Ford Ranger has a Kelly Blue Book Value of approximately $1,800. Public Works Director Clif O’Brien has expressed an interest in the 1997 Ford Ranger and would purchase a topper for the new truck out of his budget and the Ford Ranger would remain in the City Fleet under Public Works. The State Bid on a 2009 Ford F-150 extended cab pickup with all the necessary options is approximately $17,500 without a topper or trade. I am requesting to go out for bids locally for a new or used truck. In closing the Police Department Budget calls for the replacement of one Animal Control/Code Enforcement vehicle for $20,000 and two Administrative/Detective vehicles for $35,000 all to come from the Depreciation Fund I would like to research and come up with a viable Fleet Plan for your Police Department. 5 County & City ESDA. Mayor Kevin Meade said he brought this to committee to see if we would want to share services with the county and talk to them about it. We have to decide what is feasible and make senses. Need to explore if duplication. Alderman Berardi said we need to know what county does on zoning. Refer to council. The Public Safety & Traffic Committee adjourned at 7:45 p.m. STREETS & GARBAGE ALDERMAN CRAIG WEST, CHAIRMAN Pre-Annexation Agreements – Property now Contiguous. City Attorney Chrissie Peterson mentioned that there was an ordinance about Pre-Annexation Agreement that was passed in 1989. Last year Maurer Stutz Inc. – Keith Plavec and myself started putting a map together of the Pre-Annexation Agreements and to date, with 100. Some of those have now become contagious to the City of Canton and want to start to pursue the staff to be given careful consideration of those maps. This is not a dead issue it is still a work in progress. Streets & Garbage Committee adjourned at 7:45 p.m. LAKE, BUILDINGS & GROUNDS ALDERMAN SONYA LEWIS, CHAIRMAN Old Boat Dock Improvements by Rachel Rose. Rachel Rose gave a report of about the Canton Lake Park Shelter. Based on the 2006 Maurer Stutz Inc, plan Included in the plan: Morton Building Boat Ramp-removal of old and installation of new concrete Estimates: Pavement $ 6,900.00 6 Prime Coat $ 431.00 Concrete for boat ramp $ 8,250.00 Removal of Concrete at boat ramp $ 2,200.00 Picnic Shelter earthwork $ 2,000.00 Concrete for picnic shelter $ 3,600.00 Misc. aggregate $ 6,680.00 24’X30’ Morton Building $10,324.00 Total Estimated Cost $40,385.00 Estimates by Morton Buildings, Inc. and Maurer Stutz, Inc Estimates held firm until 6-22-07 Not included: building permit, site engineering or testing, site preparation, Concrete work, electrical, roof panels, steel ceiling, gutters and downspouts Utility hook-ups, paving, landscaping or finish grading, temporary electrical, Dumpster. Sub Council supports the implementation of this plan with a few additions: Creation of parking area Creation of fishing pier Fishing pier would be located on the opposite side of the boat ramp. This pier would aid children, the elderly, and the disabled access of fishing of Canton Lake. The pier would also increase the use of the picnic shelter. Benefits of the Canton Lake picnic shelter Only public picnic shelter locate the lake Increases recreational activities Builds a family atmosphere Alderman Lewis said they want to be able to seek bids to accomplish this. 7 Alderman Berardi commented that you have no bathrooms, and, you did not mentioned of handicapped accessible. Alderman Schenck wants to see site plans with general description of what is to be built. Find out if Maurer Stutz Inc. can work with you on this and see if they can work up a site plan. Then when we seek the bids will have a quality project. Alderman Berardi wants to go to Phillips & Associates for the site plan. Alderman Schenck said let’s get estimate from Maurer Stutz Inc first, then will have a project well defined and instruct Maurer Stutz Inc and other outside firms for set of plans. Alderman Lewis said she would be talking with Maurer Stutz Inc. Platting of Lake Lots. Steve Reed who owns lots 5 & 6 at the Canton Lake wanted to have a survey done on his property. Was not able to have this done because the property has never been platted. Talked to city attorney and was told this is a civil issue. I want to get this issue resolved by you folks. Alderman Lewis told Steve that she would get back with him. Alderman Schenck mentioned that this general item came up before and there are a lot of different options of the perimeters of the area. Where is that now? Mayor Kevin Meade said we got an estimate one time. City Attorney Chrissie Peterson mentioned she wants to clarify that Mr. Reed is leasing the land, not the home he buys. Maurer Stutz Inc was to get an estimate of a general survey. I do not know about platting. We have had lots of owners that have called and complained, and have concerns. Alderman Schenck said we need this reviewed and to give a professional opinion. We need a professional engineer. Alderman Berardi asked, if you own or lease, does this not make any difference? Alderman Berardi made the motion to see what cost would be to plat the lots. Was duly seconded by Alderman West. Discussion. Alderman Schenck wants to 8 send to council to act on for our engineering firm to have information. Go through our deed descriptions and have a close review of all property out there to know the boundaries. Mayor Kevin Meade said some day we might want to sale those lake lots. This is the appropriate steps to take. Voice vote, motion carried. The Lake, Buildings & Grounds Committee adjourned at 7:00 p.m. PUBLIC WORKS, WATER & SEWER ALDERMAN ERIC SCHENCK, CHAIRMAN Alderman Schenck said that Keith Plavec emailed his monthly report. This is excellent, as it keeps us up to speed and see the progress on the ground. WWTP Clarifier Application for payment #1. Alderman Schenck made the motion to accept payment #1 from Leander Construction, Inc. in the amount of $9,934.65 for the Secondary Clarifier No 1 Rehabilitation – Waste Water Treatment Facility, and refer to council. Was duly seconded by Alderman Lewis. (To be paid from the Water & Sewer Bond funds.) The motion carried by voice vote, and was unanimous. WTP Clearwell Application for payment #8 from Leander Construction Inc. Alderman Schenck made the motion to accept payment #8 from Leander Construction Inc. for the Water Treatment Plant Improvements – Finished Water Storage Facility, and refer to council. Was duly seconded by Alderman West. (To be paid from the Water & Sewer Bond fund.) The motion carried by voice vote, and was unanimous. Raw Water Transmission Main Application from Reynolds Inc. Alderman Schenck made the motion to accept payment #3 from Reynolds, Inc, for proposed 24” Raw Water Transmission Main in the amount of $580,503.78, and refer to council. Was duly seconded by Alderman Lewis. (To be paid from the Water & Sewer Bond fund.) The motion carried by voice vote, and was unanimous. Digester Cover Re-Bid results. 9 Jason Myetich from Maurer Stutz Inc. mentioned that bids were opened this morning. Two bids were received. Bidders are – Laverdiere Construction $57,300.00; Environetics Inc. $52,440.00. The engineer’s estimate was $60,000.00. Jason recommended the low bid of Environetics Inc. from Lockport, Illinois. Alderman Schenck made the motion to accept the low bid from Environetics Inc. for Digester Cover in the amount of $52,440.00, and refer to council. Was duly seconded by Alderman. West. (To be paid from Water & Sewer Bond fund.) The motion carried by voice vote, and was unanimous. Ash Street Application from Stark Excavating. Alderman Schenck made the motion to accept the payment request from Stark Excavating for the Ash Street Project in the amount of $52,155.90, and refer to council. Was duly seconded by Alderman Lewis. (To be paid from Motor Fuel Tax funds.) The motion carried by voice vote, and was unanimous. Sewer Repair at 547 E. Maple Street. This is being postponed as the individual could not make the meeting. Petitions for lowering the water rates. Alderman Schenck mentioned that the individual circulating the petitions had around 1700 signatures from Canton, Cuba, Bryant. I like to have cheaper gas and cheaper Ameren CIPS. We have a responsibility for the rate fee for the Bond issue. Water & Sewer is a very important project for quantity and quality drinking water, and we have to stay in compliance with state laws. When we approach next year’s budgets we look at issues of the Water & Sewer rates. Our rate structure pays back the bonds and for maintaining equipment and for up-grades. Change Water Billing to Monthly. Mayor Kevin Meade said he wants the feeling of the committee to have Greg Pollitt, the Supt of Water Treatment Plant come back with options. I am approaching this because of budgeting. Alderman Lewis was glad to hear that we are looking into this. Alderman West agreed, but we would have double posting. Alderman Berardi suggested paying bills on line. 10 Mayor Kevin Meade said to have a recommendation back from the Supt. City Treasurer Julie Smick said you also now pay a fee of $600.00 for two months billing. Anderson grain elevator. City Attorney Chrissie Peterson mentioned that Anderson Grain elevator is now the company that is leasing the grain elevator that sits on the property owned by Greenlion Bio Fuel. And initially when the water line was put in to the Central Illinois Energy Ethanol Plant, that was one water line that should service all parts of the Ethanol Plant. Now that has come to light, there are going to be many different entities sitting on property that everyone thought was owned by CIE and those entities all sit on property not owned by Central Illinois Energy. Basically the Ethanol Plant made some revisions to their line, all within the contract we have with them. Where they will have a new meter and if not today, then by the end of the week. They will be going off that new meter. That does leave a line to the Greenlion property that the city has to deal with. Anderson grain elevator company called last week and said when the Ethanol Plant and Riverland Green lion Bio Fuels will be left without water? After checking around nobody had any intent to turn their water off. But we do have to certainly discuss what their rate is going to be. They don’t use water for the grain handling facility. The water would be minimal, it’s an office building with a couple of bathrooms, and water fountain. The city does have an ordinance on the books about Pre-Annexation Agreements and about double rates. When the contract with the Ethanol Plant was negotiated, different rate structure were put in place by the contract. We need some guidance on how to deal with Anderson Grain Elevator, and how to set up their water account. If we are going to require a Pre-Annexation Agreement or if they need to approach the City to negotiate a contract? Alderman Berardi stated his suggestion was to negotiate a contract for 5 to 10 years. Alderman Schenck stated we use contracts to sell water to other communities. Seems like overkill for one user basically using water for a sink and toilet. We just dealt with an issue for West Gate Subdivision folks, and they would be exempt from Pre-Annexation Agreements. This could be the case of a similar ordinance. Charging double rates include that in that ordinance, and add on as a customer. 11 City Attorney Chrissie Peterson mentioned that was her opinion also. Alderman Schenck made the motion for the City Attorney to draft an ordinance for this property owner, requiring double water rates, and preempt them from a Pre-Annexation Agreement, and bring the ordinance to the next council meeting for first reading. Was duly seconded by Alderman West. Discussion. Alderman Berardi ask how does this different for the Ethanol Plant for fire protection without an ordinance or resolution? City Attorney Chrissie Peterson said we can ask the City Clerk, as this was passed some time ago? And the document passed by resolution was with Riverland Bio Fuels. Alderman Berardi said this is not the same document, as it is not the same mayor. City Attorney Chrissie Peterson said we can bring back a different resolution. Mayor Kevin Meade said, we can do this. Alderman Schenck ask if in the agreement with Riverland Bio Fuels that prevents them from selling that water? City Attorney Chrissie Peterson mentioned, that water is just for them. The fire fighting agreement was passed sometime ago, that is why you seen a new one a few weeks ago. Mayor Kevin Meade mentioned that Jolena Trone, the former janitor, has taken a position in the water department as water clerk, and we need janitorial services for the city buildings. Also, had discussion with Public Works Director Clif O’Brien about his budget, as we need a maintenance position. Will talk about this when the Personnel Committee meets and combing both positions. The Public Works, Water & Sewer Committee adjourned at 8:12 p.m. EXECUTIVE SESSION – TO DISCUSS – PERSONNEL. Alderman Schenck made the motion to go into executive session to discuss Personnel. Was duly seconded by Alderman Berardi.
