HomeMy WebLinkAbout05-06-08 Canton City Council Meeting _2nd Mtg_ The Canton City Council met Tuesday, May 6, 2008 at 7:11 p.m. in the Council th Chambers, 50 North 4 Avenue, Canton, Illinois for their regular (second) Council meeting. City Clerk Nancy Whites distributed the conditional resignation letter of Mayor Rodney W. Heinze and it became effective at the end of old business. Answering Roll call – Aldermen Eric Schenck, Joe Berardi, Larry Sarff, Craig West, David Nidiffer, Kevin Meade, Jason Strandberg, Sonya Lewis. Absent – None. City Clerk Nancy Whites then read the Statutory Information for the purposes to inform, pursuant to 65ILCS 5/3.1-10-50 A. The vacancy in the office of mayor must be filled by the city council electing one of their members as acting mayor. A simple majority vote is all that is needed to select the acting mayor. The acting mayor will serve until the expiration of the term, April 30, 2009. B.The election of an acting mayor does NOT create a vacancy in the original office of the alderman unless the alderman resigns from the original office following election as acting mayor. C.If the alderman elected an acting mayor and does not resign from their original office following election as acting mayor, then the acting mayor shall exercise the powers of the mayor, but shall only be entitled to vote as a member of the council and shall NOT have the power to veto. D.If the alderman elected as acting mayor does not resign their original office following election as acting mayor, and if that alderman’s original term of office has not expired when a mayor qualifies for office, then the acting mayor shall return to the original office for the remainder of their term. As the City Clerk I am now calling for nominations from the floor. Alderman Sarff nominated Alderman Kevin Meade. City Clerk Nancy Whites asked two more times if there were any other nominations? There were none, so City Clerk Nancy Whites closed the nominations. 1 City Clerk Nancy Whites ask Alderman Kevin Meade if he was willing to accept the position of Acting Mayor. Kevin Meade answered, yes he is! Roll call. AYES – Aldermen Lewis, Meade, Nidiffer, West, Sarff, Schenck. NAYS – Aldermen Strandberg, Berardi. 6 AYES, 2 NAYS, 0 ABSENT. Motion carried. City Clerk Nancy Whites then gave the OATH OF OFFICE TO ACTING MAYOR KEVIN MEADE. City Clerk Nancy Whites then ask Acting Mayor Kevin Meade if he is resigning his office of Alderman? Acting Mayor Kevin Meade said he was. City Clerk Nancy Whites then determine that a vacancy occurs in the office of Alderman of Ward Three. City Clerk Nancy Whites then ask Acting Mayor Kevin Meade if he was prepared to appoint an alderman of ward three. Acting Mayor Kevin Meade said he was not ready yet to make that appointment. City Clerk Nancy Whites then told Acting Mayor Kevin Meade the appointment must be done within 60 days. Mayor Kevin Meade then submitted to City Clerk Nancy Whites the following announcement – having been elected to serve out the remainder of the term of mayor for the City of Canton, I hereby resign my position of Alderman in Ward 3, effective immediately. Kevin R. Meade, Alderman Ward 3. APPOINTMENTS OF COMMITTEES/CHAIR. Alderman Nidiffer made the motion to hold over the appointments for 30 days. Was duly seconded by Alderman Strandberg. Voice vote, motion carried unanimously. ADOPTION OF ROBERTS RULES OF ORDER. Alderman West made the motion to adopt the Roberts Rules of Order. Was duly seconded by Alderman Lewis. Voice vote, motion carried unanimously. RE-APPOINTMENT OF MAURER-STUTZ CONTRACT FOR ZONING OFFICER. Alderman Sarff made the motion to re-appoint Maurer-Stutz contract for zoning officer of the City. Was duly seconded by Alderman Berardi. Discussion. Alderman Sarff said by his experience everything is positive. Roll call. AYES – 2 Aldermen Schenck, Berardi, Sarff, West, Nidiffer, Meade, Strandberg, Lewis. NAYS – None. 8 AYES, 0 NAYS, 0 ABSENT. Motion carried. APPOINTMENTS FOR DEPARTMENT HEADS, COMMITTEES AND COMMISSIONS. Alderman Strandberg made the motion to hold over the appointments for 30 days. Was duly seconded by Alderman Berardi. The motion carried by voice vote, and was unanimous. Alderman Berardi wants to have discussion next week for Personnel under executive session. Alderman Sarff also wants executive session for Public Works Contract and Fire Contract next week’s committee agenda. COMMUNICATIONS FROM MAYOR MEADE. SRPED Executive Director Mark Rothert passed out a drawing of proposed building of Spoon River College in Canton. The college board has made no specific decision on any site in Canton at this time. Mayor Meade then gave a plaque to the former Mayor Rodney W. Heinze for his service to the City of Canton. Rod said this was a total surprise. NEW BUSINESS: ORDINANCE – RE-ZONING 128 EAST LINN STREET FROM R-2 TO B-2 FOR WILLIAM WHITEMAN. Read by title. The Lawyer for Donald Lowe who circulated the petition in opposition of using the property for U-Haul trailer, stated they do not have a drive through access, they have to pull off the street. The lot can’t handle the volume. This is a residential neighborhood, and the substance is an over burden of the property. William Whiteman said he recently came back to Canton and had a garage business at the property. I applied for re-zoning recently and was passed by the Planning & Zoning Commission. Have seen a demand for U-Hauls, and the business down the street was re-zoned for business. The son of Mr. Whiteman said they have taken some of the trailers and are putting them on a lot that Rick Lillie owns, to not over burden the lot, then they would only have between 4 or 5 U-Hauls on the lot at one time. Mayor Meade mentioned that Planning & Zoning Commission had recommended the re-zoning. 3 Alderman Nidiffer asked if they would limit to 4 or 5 U-Hauls on the lot. The Whiteman’s said they would. The attorney for the petitioner said they have increased well beyond the business before them. Alderman Berardi ask if it’s the lot and the house? William Whiteman answered just the lot. Alderman Strandberg said at the Planning & Zoning the detailing work was not the problem, it was the trucks. Alderman Sarff wanted to know what the zoning was before? City Attorney Chrissie Peterson stated it was R-2 residential. The address has always had something as far as a business. Should have been zoned a long time ago. The property cannot have a Special Use Permit as council would have very little authority of that property. Alderman Schenck made the motion to send to the Legal & Ordinance Committee next week. Was duly seconded by Alderman Berardi. Voice vote, motion carried unanimously. APPROVAL OF FINAL PLAT FOR HEYEN SUBDIVISION OF ENTERPRISE INDUSTRIAL DISTRICT. Joe Davis said he had no plans to change any buildings on the property. Alderman Berardi made the motion to approve the final plat for Heyen Subdivision of the Enterprise Industrial District. Was duly seconded by Alderman Sarff. Roll call. AYES – Aldermen Lewis, Strandberg, Nidiffer, West, Sarff, Berardi, Schenck. NAYS – None. 8 AYES, 0 NAYS, 0 ABSENT. Motion carried. ADJOURN There is no further business Alderman Strandberg made the motion to adjourn. Was duly seconded by Alderman West. The motion carried by voice vote, and was unanimous.
