DATED AT CANTON, ILLINOIS, THIS DAY UARY 2022 Diana Pavley-Rock, Mme, City Clerk Seal City of Canton, Illinois ORDINANCE NO. 4279 AN ORDINANCE AMENDING TITLE 8, CHAPTER 8, SECTION 4 (THE RULES,REGULATIONS AND DEFINITIONS OF CEMETERY) OF THE CANTON MUNICIPAL CODE WHEREAS, the City of Canton, Fulton County, Illinois (the "City") is an Illinois non- home rule municipal corporation, established in accordance with the constitution of the State of Illinois of 1970; WHEREAS, Title 8, Chapter 8, Section 4 of the Canton Municipal Code (the "Code") contains provisions related to the rules, regulations and certain definitions related to cemeteries; WHEREAS, the City Council of the City of Canton has determined that it is necessary and in the best interest of the City to amend and update Title 8, Chapter 8, Section 4 of the Code to improve certain rules and regulations contained therein. NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF CANTON, FULTON COUNTY, ILLINOIS AS FOLLOWS: Section 1. That the City hereby finds as fact the recitals set forth above and incorporates said recitals herein as though fully set forth. Section 2. That Section 8-8-4(E)(5), concerning foundations, of the Canton Municipal Code is hereby amended to state as follows: 5. Foundations: All monuments must be set on a concrete foundation of no less than thirty six inches (36") deep. All excavations shall be inspected and approved by management before concrete is to be poured. Foundations shall be poured at time of excavation. Grass marker excavations must takelace da of grass marker P Y installation. The cemetery reserves the right to enforce a six(6)month grave settling time before foundation excavation and installation. For purposes of foundation flanges,polished granite shall be the only permissible material for foundation flanges, and the installation of concrete foundation flanges is prohibited. Section 3. That Section 8-8-4(F)(2), concerning decoration cleanup, of the Canton Municipal Code is hereby amended to state as follows: 2. Cleanup: A minimum of two (2)times a year the cemetery shall have a cemetery cleanup when decorations will be removed according to the following dates and guidelines. Decorations to be retained should be removed prior to and during these seven(7) day periods. The scheduled general cleanup dates and specifications are: 1 April 1 s'—April 7th: All decorations will be removed from the grave site. This includes flowers in vases and saddles. All shepherds' hooks will also be removed. July 15th—July 21 st: Ground level decorations will be removed. The cemetery shall not condone or allow the removal of memorial decorations from graves by persons other than the family of the deceased, with exception being the employees of the cemetery in the operation of their duties. Section 4. That all ordinances or parts thereof in conflict with this Ordinance are hereby expressly repealed. Section 5. If any part or parts of this Ordinance shall be held to be unconstitutional or otherwise invalid, such unconstitutionality or invalidity shall not affect the validity of the remaining provisions of this Ordinance. Section 6. That this Ordinance shall be in full force and effect from and after its passage and approval as provided by law. PASSED THIS 15th day of February, 2022.
