DISCUSS, CONSIDER AND VOTE ON AN ORDINANCE APPROVING AND AUTHORIZING THE EXECUTION OF A PROFESSIONAL SERVICES AGREEMENT FOR THE ESTABLISHMENT AND ANNUAL ADMINISTRATION OF CANTON BUSINESS DEVELOPMENT NO 1 BY AND BETWEEN THE CITY OF CANTON, FULTON COUNTY ILLINOIS AND JACOB & KLEIN, LTD. AND THE ECONOMIC DEVELOPMENT GROUP, LTD (2nd READING) ORDINANCE#4272 Steve Klein explained that the proposed boundary is an exhibit in the agreement. Phase 1 includes the downtown,all of the old IH site,and will include both sides of the road on 5t"Avenue- from Locust down to the railroad. Mauer and Stutz will provide a map and legal description for the area by the end of this week so notice can be provided for the public hearing. DISCUSS, CONSIDER AND VOTE ON AN ORDINANCE APPROVING AND AUTHORIZING THE EXECUTION OF A TIF INTERGOVERNMENTAL AGREEMENT BY AND BETWEEN THE CITY OF CANTON, FULTON COUNTY, ILLINOIS AND THE CANTON UNION SCHOOL DISTRICT #66. 2nd READING) ORDINANCE#4273 Steve Klein explained that this is the same type of intergovernmental agreement that the city has with the school on TIF 2. It has the exact same terms, except that in this instance for TIF 3, the reimbursement calculation will exempt out the old IH site and a hand full of parcels that were originally in TIF District 1 and were subsequently included in the TIF District 3. The redevelopment agreement that the city has currently with Midamerica Bank already contemplates and anticipates that the city will enter into an intergovernmental agreement with the school district.The bank is included in TIF 3, and it would contribute TIF increment that would be included in the calculation for the annual surplus that the city would declare for TIF 3. The bank will be reimbursed on a pay as you go basis out of the net increment after the city has paid out a portion of the increment toward the surplus and the intergovernmental agreement. DISCUSS, CONSIDER AND VOTE ON A RESOLUTION APPROVING AN AGREEMENT TO PROVIDE FIRE PROTECTION AND EMS ASSISTANCE BY THE CITY OF CANTON TO ILLINOIS COMMUNITY COLLEGE DISTRICT#534, A/K/A SPOON RIVER COLLEGE. RESOLUTION #5354 Attorney Jump explained that he cleaned up some of the language in the proposed agreement. The rate is based on the prior contract, but will increase by $225.00. The previous agreement allowed for an automatic increase every year by $225.00. The auto increase was taken out of this agreement and the city will now reserve the right to increase by an amount that is up to $225.00 per year. This will allow the city to better assess the cost and make any increases based upon the cost. The agreement is for a 5- year period that will end September 30, 2026. The agreement will be retroactive to October 1, 2021. Motion and second were made by Alderpersons West/Nelson to approve the resolution and place it on file. DISCUSS, CONSIDER AND VOTE ON A RESOLUTION APPROVING A SETTLEMENT AGREEMENT FOR THE PURPOSE OF DEMOLISHING 124 MARTIN AVENUE, CANTON ILLINOIS. This will be discussed in executive session. DISCUSS, CONSIDER AND VOTE ON AN ORDINANCE APPROVING AND AUTHORIZING THE EXECUTION OF A TIF REDEVELOPMENT AGREEMENT BY AND BETWEEN THE CITY OF CANTON, FULTON COUNTY ILLINOIS AND MIDWEST CEDAR&TIMBER, LLC (1sT READING) ORDINANCE SRPED Cole McDaniel explained that Midwest Cedar&Timber is located on 5t"Avenue at the old Alexander Lumber site. They made several improvements to the property, but they have some warehouse improvements that they are planning on making. They would like to apply for TIF funds to allow for the improvements to the warehouse. The project will have several phases. The improvements would be made to the warehouse so it would be ready for production this spring. To date,they have hired 8 employees and they plan to expand and hire additional people. DISCUSS,CONSIDER AND VOTE ON A RESOLUTION APPROVING A LEASE WITH FULTON COUNTY PROBATION FOR CITY HALL OFFICE SPACE. RESOLUTION #5355 Attorney Jump explained that the new lease has very few changes from their current lease. The city currently has a lease for office space to Fulton County court services. Fulton County court services is actually an agency of the 91"judicial circuit. Attorney Jump further explained that he may need to make a few additional revisions. The rate was left the same in the new agreement. Under the current agreement, they were not allowed to use the office for a significant amount of time due to city hall being closed during the pandemic. The amount of $4,275.00 is for 9 months at a rate of$475.00. (June 1, 2021-February 2022) The amount would be due within 30 days of execution of the agreement. Beginning in March 2022, they would then begin paying $475.00 per month. The proposed agreement is for a one-year period. DISCUSS, CONSIDER AND VOTE ON AN ORDINANCE TO ESTABLISH A DATE FOR A PUBLIC HEARING REGARDING THE PROPOSAL TO CONSIDER AND APPROVE A BUSINESS DISTRICT DESIGNATION AND BUSINESS DISTRICT REDEVELOPMENT PLAN FOR THE PROPOSED CANTON BUSINESS DEVELOPMENT DISTRICT NO 1. ORDINANCE#4274 Steve Klein explained that the proposed ordinance would set a date for a public hearing for the proposed business district.The city would be on a short schedule because the Illinois Department of Revenue will only accept new business districts twice per year. The next cutoff date is April 1, 2022. The goal is to have everything completed by the middle of March, and then to be able to submit to the department of revenue. Maurer and Stutz will provide a map and legal description that will be needed for the notice of the public hearing for the newspaper. A draft of the business development plan will be available by February 18, 2022. Motion and second were made by Alderpersons West/Hale to approve the ordinance and place it on file. DISCUSS, CONSIDER AND VOTE ON AN ORDINANCE APPROVING A LOAN AGREEMENT WITH THE ILLINOIS ENVIRONMENTAL PROTECTION AGENCY. ORDINANCE#4275 Engineer Plavec explained that this is the first phase of the lead service line replacement in Canton. It will consist of 226 lead service lines that will be from the water line to the water meter in the house.The city had one contractor that bid on the project. The term of the loan will be for 20 years, with a rate of.63% in the amount of$1,727,567.12. In accordance with the procedures with the loan for the public water supply loan program, $1,727,567.12 of the loan amount will be forgiven by the State of Illinois. This project will be completely funded and paid through the EPA water loan program. Within 7 days of approval of the agreement the work would be sent to the contractor. Construction would be anticipated to begin this spring/summer. Phase two is currently being put together for another 375 services that have been identified. Draft copies are currently being submitted to EPA for any additional funds that could have debt forgiveness. DISCUSS, CONSIDER AND VOTE ON A RESOLUTION APPROVING A MEMORANDUM OF UNDERSTANDING WITH AFSCME COUNCIL 31/11LOCAL 1372. RESOLUTION #5356 Attorney Jump explained that the city has a newer employee that recently transferred to the water department. The employee would require some additional training, The agreement was reached with AFSCME to extend the probationary period for this employee. The city would allow the employee to receive the non-probationary pay since his anniversary is coming up relatively soon. DISCUSS, CONSIDER AND VOTE ON THE APPROVAL OF A CUSTODIAL POSITION FOR THE CITY OF CANTON. Utility Director Joe Carruthers explained that a position was posted to the union for the cleaning of city hall and other buildings. There was not an interest in the job from the union. The posting was then able to go out to the public. The position currently is not budgeted, but funds are in the budget. The city would like to hire someone for this position within the next month. A complete scope of work was put together for the position. The city would like to do this prior to the next fiscal year. Currently the city has been taking a person from different departments to perform the cleaning. COMMUNITY& INDUSTRIAL DEVELOPMENT ALDERPERSON JOHN LOVELL, CHAIR UPDATE FROM SRPED COLE MCDANIEL Cole McDaniel reported that within the last couple of weeks Vistra- who owns the Duck Creek power plant, has committed to a $30,000,000.00 investment that will include 20 megawatts of solar power generation and 3 megawatts of battery storage. Multiple parties are interested in the old Scrapbook Dreams building at 71 Eastside Square and the old East Side Antiques at 29 Eastside Square. These projects will hopefully be moving forward within the next 30 days. A few calls were received from some of the retail businesses that a gentleman in town was asking questions about foot traffic, the market and their business. Cole explained that he found this very interesting because he has received several inquiries about the formerJC Penney's building. Cole is not sure what type of department store they represent, but there has definitely been an increased interest in the property. ATrue Value district manager has been staying in contact with Cole about getting into the Canton market. Cole is hopeful that conversation will continue. The former Daily Ledger building that was purchased has renovation plans, and the intention is to put a business into the building. This will be a business looking to utilize business development funds for an extensive renovation. On February 8, 2022 the Fulton County board will vote to approve the Fulton County small business covid 19 relief program, which will be a grant program strictly for Fulton County businesses. If approved, it will provide $700,000.00 in grant funds to be used county wide. The application date would open on February 15, 2022. Arby's has finalized their building permit with the city. They are planning to have construction completed by June/July 2022. PUBLIC WORKS, WATER& SEWER ALDERPERSON ANGELA LINGENFELTER, CHAIR DISCUSS AND CONSIDER PORTABLE RESTROOMS FOR LOCAL PUBLIC EVENTS. Alderperson Lingenfelter explained that this was discussed in November to have bids submitted for portable restrooms for the various public events and the Canton lake area. Utility DirectorJoe Carruthers reported that he could put together a bid proposal for the portable restrooms at the Canton Lake area. The bid will go out during the month of March. PUBLIC SAFETY AND TRAFFIC ALDERPERSON ANGELA HALE, CHAIR STREETS AND GARBAGE ALDERPERSON JEFF FRITZ, CHAIR LAKE, BUILDINGS AND GROUNDS ALDERPERSON GREG GOSSETT, CHAIR MAYOR COMMUNICATION Mayor McDowell reported that a major snow storm will be heading toward Canton. The public is to adhere to the parking ban so plows will be able to clear the roadways. The ordinance violation docket that is usually set for the first Wednesday of each month has been moved to March 2, 2022. Anyone on a payment plan will still be required to make their payment.
