AN ORDINANCE REZONING PROPERTY AT 980 SOUTH MAIN STREET, CANTON
ILLINOIS 61520 FROM AN R-3 TO AN R-4 ZONING CLASSIFICATION

AN ORDINANCE REZONING PROPERTY AT 980 SOUTH MAIN STREET, CANTON,
ILLINOIS 61520 FROM AN R-3 TO AN R-4 ZONING CLASSIFICATION
WHEREAS, Jed Rhoades &Max Kumer filed a petition with the Joint Planning &Zoning
Commission for the re-zoning of the real property described below, said property being within
the corporate limits of the City of Canton, Illinois; and
WHEREAS, Jed Rhoades &Max Kumer purchased the real property described below from The
Seventh Day Adventist Church on or about September 1, 2021; and
WHEREAS,the current zoning classification of the property is R-3 and it is the petitioner's
intent for the property to change to an R-4 zoning classification; and
WHEREAS, after proper notice, a public hearing on said Petition was conducted by the
Planning and Zoning Commission of the City of Canton on September 13, 2021
WHEREAS, on September 13, 2021, the Planning and Zoning Commission recommended to the
City Council that the real property described below be rezoned pursuant to 65 ILCS 5/11-13-1
et.seq.and
WHEREAS, it is in the best interest of the City of Canton, Illinois that said property be rezoned
within the City of Canton, to meet future business growth and fit within the City's
comprehensive plan.
NOW, THEREFORE,BE IT ORDAINED by the City Council of the City of Canton, Illinois
as follows:
1. That the Canton City Council hereby finds as facts the assertions set forth above.
2. That the described real property be and is hereby rezoned from R-3 to R-4 as follows:
BEGINNING AT AN IRON PIPE AT THE SOUTHWEST CORNER OF THE PSCHIRRER TRACT,
THE SAME BEING 700.4 FEET EAST AND 583.3 FEET SOUTH OF THE CENTER OF SECTION
34, TOWNSHIP 7 NORTH, RANGE 4 EAST OF THE FOURTH PRINCIPAL MERIDIAN,AND ON
THE EAST LINE OF GREENWOOD CEMETERY, THENCE EAST ALONG THE SOUTH LINE OF
THE PSCHIRRER TRACT 165.0 FEET TO AN IRON PIPE ON THE WEST LINE OF SOUTH MAIN
STREET AND BEING 579.5 FEET SOUTH OF THE QUARTER LINE OF SECTION 34; THENCE
SOUTH ALONG THE WEST LINE OF SOUTH MAIN STREET 256.6 FEE TO AN IRON PIPE,
THENCE WEST 155.0 FEET TO AN IRON PIPE ON THE EAST LINE OF ST. JOSEPH CEMETERY,
THENCE NORTH 252.7 FEET TO THE POINT OF BEGINNING
Sect: 34 TWP: 07 RANGE: 04 PT SE BEG 583 S 700 E CENTSEC 34 E 165 S 256.6 W 155.5
N 252.7 in the City of Canton, situated in the County of Fulton and State of Illinois.
3. That Jed Rhoades & Max Kumer will pay to the'City of Canton the fees required to file a
certified copy of this Ordinance with the Fulton County Clerk and Recorder of Deeds, no later
than ninety (90) days from the date of this Ordinance.
4. Upon proof of filing of a certified copy of this Ordinance,the Zoning Administrator is
directed to make the appropriate map amendments to the City of Canton to reflect said re-zoning.
5. That this Ordinance shall be in full force and effect upon its passage by the City Council of
the City of Canton and approval by its Mayor.
PASSED by the City Council of the City of Canton, Illinois and approved by the Mayor thereof
this 21 day of September 2021 upon a roll call vote as follows:
