municipality passed and approved Ordinance #4255 entitled:

ORDINANCE NO. 4255
AN ORDINANCE AUTHORIZING AND DIRECTING THE
SALE OF CERTAIN PERSONAL PROPERTY OWNED BY
THE CITY OF CANTON AND
NO LONGER NEEDED OR USEFUL FOR CITY PURPOSES
WHEREAS, the Illinois Municipal Code, provides in part: "Whenever a city or village
incorporated under any general or special law, other than a city or village of 500,000 or more
population, owns any personal property which in the opinion of a simple majority of the corporate
authorities then holding office, is no longer necessary or useful to, or for the best interests of the
city or village, such a majority of the corporate authorities then holding office, at any regular
meeting or at any special meeting called for that purpose, (1) by ordinance may authorize the sale
of that personal property in such manner as they may designate, with or without advertising the
sale . . . ." 65 ILCS 5/11-76-4.
WHEREAS,the corporate authorities have determined that the City of Canton presently
owns certain items of personal property, set forth in "Exhibit A," which are no longer necessary
or useful to, or for the best interest of the City (hereinafter collectively the "Personal Property").
NOW, THEREFORE,BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY
OF CANTON, Fulton County, Illinois as follows:
1. The Personal Property is hereby approved for sale and shall be sold to David Kitchen.
2. No further advertisement of the above-described sale is necessary.
3. The Mayor, or his designee, may arrange for the sale of the Personal Property as set forth
above.
4. Ordinance No. 4247 is hereby repealed and replaced in its entirety by this Ordinance.
5. That this Ordinance shall be effective immediately upon its passage by the City Council
of the City of Canton, Illinois, by at least a majority vote of the Corporate Authorities and
approval of the Mayor thereof.
PASSED by the City Council of the City of Canton, Fulton Count Illinois on the 7th day of
September, 2021.
