HomeMy WebLinkAbout03-04-08 City Council Meeting MinutesThe Canton City Council met Tuesday, March 4, 2008 at 6:30 p.m. in the Council Chambers, 50 North 4th Avenue, Canton, Illinois for their regular meeting. The meeting began with the Pledge of Allegiance followed with prayer given by City Clerk Nancy Whites. Present -Mayor Rodney W. Heinze, City Clerk Nancy Whites, City Treasurer Kathy Luker, City Attorney Chrissie Peterson, Police Chief Jeffrey Fritz, Fire Chief Bonnie Cremer, Public Works Director Cliff O'Brien, Wastewater Treatment Plant Supt. Joe Carruthers, Water Treatment Plant Supt. Greg Pollitt, Street Supt. George Spahn, Zoning Officer Keith Plavec from Maurer Stutz Inc., SRPED Economic Development Director Mark Rothert, and Video Services by Joe Ginger. In the audience was News Media of Daily Ledger -John Froehling, WBYS -Mark Bixler, The Democrat -Denise Bankes. Also Attorney Nancy Shell, Warren Skinner, Dick VanRossem, City Employee Marshall Black and Kevin Latimer. Mayor Rodney W. Heinze called the meeting to order at 6:30 p.m. Aldermen answering roll call -Eric Schenck, Craig West, David Nidiffer, Kevin Meade, Jason Strandberg, Sonya Lewis. Absent - Aldermen Joe Berardi, Larry Sarff. MINUTES -COUNCIL MEETING FEBRUARY 19, 2008. Alderman West made the motion the minutes be approved as presented and placed on file. It was duly seconded by Alderman Strandberg. The motion carried by voice vote, and was unanimous. MINUTES -MECHANICAL COMMITTEE FEBRUARY 26, 2008. Alderman Schenck made the motion that the minutes of February 26, 2008 Mechanical Committee be approved as presented and placed on file. It was duly seconded by Alderman Lewis. The motion carried by voice vote, and was unanimous. COMMITTEE REPORTS: Public Safety & Traffic. Council Action None. Streets & Garbage. Council Action None. Lake, Buildings & Grounds. Council Action None. Informational: The Canton Lake Master Plan Committee is going to have their first meeting this Thursday March 6th at 6:30 p.m. at the Historic Dept. Public Works, Water & Sewer. Council Action Alderman Strandberg made the motion to purchase a sign for Canton Industrial Park from Ricky Signs at the cost of $14,960.00 as recommended by Economic Development Director Mark Rothert, and paid from Canton Industrial Park TIF fund. It was duly seconded by Alderman Schenck.. Discussion. Mark Rothert recommended Ricky Signs as their sign is simple but modern. The other one submitting the quote was BT Interiors at the cost of $10,100. Roll call. Aldermen Lewis, Strandberg, Meade, Nidiffer, West, Schenck. NAYS -None. 6 AYES, 0 NAYS, 2 ABSENT. Motion carried. COMMUNICATIONS FROM MAYOR HEINZE - Mayor Heinze mentioned that Alderman Meade wants to talk about next week's meeting. Alderman Meade ask for each of the Aldermen to review the Budgets that will be passed out at the end of the meeting. We need to look at what cuts can be made. In meetings earlier City Treasurer Kathy Luker, Mayor Heinze and myself made some revisions. During this week review spending of tax payers money wisely. Mayor Heinze said if each Aldermen could cut $75,000 that is $600,000. OLD BUSINESS: ORDINANCE - DELECTING 8-15-2 (OBSTRUCTING STREETS) OF CHAPTER 15 (RAILROADS). Second reading, read by title. Alderman Meade made the motion the ordinance be placed on its passage. It was duly seconded by Alderman Strandberg. Roll call. AYES -Aldermen Schenck, West, Nidiffer, Meade, Strandberg, Lewis. NAYS -None. 6 AYES, 0 NAYS, 2 ABSENT. Motion carried.. Ordinance being # 1922. ORDINANCE - CREATING CHAPTER 4 (DEMOLITION) OF TITLE 4 (BUILDINGS). Second reading, read by title. Alderman West made the motion the ordinance be placed on its passage. It was duly seconded by Alderman Strandberg. Roll call. AYES -Aldermen Lewis, Strandberg, Meade, Nidiffer, West, Schenck. Motion carried. Ordinance being # 1923 . NEW BUSINESS: ORDINANCE - RE-ZONING PROPERTY OF KEVIN AND DEBORAH LATIMER, FROM R-2 TO B-2. First reading, read by title. ORDINANCE -AMENDING ORDINANCE NO. 1917 AS ADOPTED BY THE CANTON CITY COUNCIL ON DECEMBER 18, 2007. (APPROVING THE IMPLEMENTATION PLAN FOR GOLF VIEW VILLAS PLANNED UNIT DEVELOPMENT.) Attorney Nancy Shell mentioned the Country Club had received copies of the Ordinance from City Attorney Chrissie Petersonl that is being proposed. I understand the City didn't realize and certainly the Country Club did not realize that in 1972 who ever was working for the City at that time, an proposed the easement. They did not extend the easement to the road way right-of--way. Obviously the best alternate would be the cheaper alternate to run the water line behind the lots. In the event we would do that, there would be additional cost of $12,900 according to Cliff O'Brien and Keith Plavec calculations. The Country Club real estate LLC would ask council if they would split that cost with us since neither of us knew about this additional cost. Would appreciate any help we could get. Mayor Heinze read from the ordinance the three options. They are as follows: The City of Canton to install the necessary materials and equipment to provide water and sewer to Lots 1 through 24 at the cost of $57,672.00. Said cost estimate was premised on the City purchasing the necessary materials and installing water service from the existing water main located on the L.D. Barnard property to the Golf View Villas property line and included the City retaining and paying a local contractor for sewer excavation and purchasing necessary materials to install sewer service. It was determined that an additional water line easement of approximately eight (8) feet was necessary to complete the water service Water Service Material Cost = $ 7,000 Labor Cost = $ 6,900 Total = $13,900 Sewer Service Material Cost = $23,772 Local Contractor = $20,000 Total = $43,772 TOTAL = $57,672 The cost of the proposed easement would increase the total original project of $57,672.00 to $127,672.00. Broken down as follows: Water Service Material Cost = $ 7,000 Labor Cost = $ 6,900 Additional Easement = $70, 000 Total = $83,900 Sewer Service Material Cost = $23,772 Local Contractor = $20,000 Total = $43,772 TOTAL = $127,672 The City has proposed that, as an alternative, a six inch (6") water main could be installed along the south side of the Golf View Villas property lines in an existing ten foot (10") utility easement for a cost of $26,800, broken down as follows: Water Service Material Cost = $18,900 Labor Cost = $ 6,900 Engineering (EPA permitting) _ $ 1,000 Total = $26,800 Sewer Service Material Cost = $23,772 Local Contractor = $20,000 Total = $43,772 TOTAL = $70,572 Mayor Heinze mentioned the additional cost of $12,900 is figured in the $70,572 figure. Discussion. Alderman Schenck mentioned that we should stick with the $57,672 commitment we made previously. We've made a generous offer to the Country Club Corporation to the liability in doing that. Should have ask for more, still believe that. Alderman Strandberg said he agreed with Alderman Schenck to the figure of $57,672 is a very generous offer. It is a good number for the City to invest in this. Alderman Schenck moved to adopt option number 1 of this ordinance being in the amount of $57,672.00. It was duly seconded by Alderman Strandberg. Discussion. Alderman Meade asked to be excused from voting as he sits on the Country Club Board of Directors. Alderman Strandberg made the motion to excuse Alderman Meade from voting. It was duly seconded by Alderman Lewis. The motion carried by voice vote. Discussion. City Attorney Chrissie Peterson mentioned, if Council would like to consider or amend the ordinance sitting in front of you, with the proposal just made by the LLC, we would need to make that amendment to incur additional cost of $6,450.00. The Canton Country Club Real Estate, LLC would have to let the City know within 10 days after the ordinance is passed of which option they would select. Roll call. AYES -Aldermen Schenck, West, Nidiffer, Strandberg, Lewis, and Mayor Heinze. NAYS -None. 6 AYES, 0 NAYS, 2 ABSENT, 1 ABSTAINED and MAYOR HEINZE VOTING AYE AS REQUIRES 6 VOTES FOR PASSAGE OF THE ORDINANCE. Motion carried. ADJOURN There being no further business Alderman West, made the motion to adjourn. It was duly seconded by Alderman Lewis. The motion carried by voice vote, and was unanimous.
