A regular meeting of the Canton City Council was held on December 7,

2006 in Council Chambers, 50 North 4 Avenue, Canton, Illinois. (Meeting
was rescheduled due to the agenda not being published for 48 hours because
of a 14 inch snow storm.)
PLEDGE OF ALLEGIANCE OPENED THE MEETING, FOLLOWED BY
THE INVOCATION GIVEN BY CITY CLERK NANCY WHITES.
Mayor Rodney Heinze asked for roll call at 6:30 p.m. Present – Aldermen
Joe Berardi, Jim Hartford, Craig West, Larry Sarff, Kevin Meade, Les Carl,
Eric Schenck, Sonja Lewis. Absent – None.
MINUTES OF COUNCIL MEETING NOVEMBER 21, 2006. Motion
and second by Aldermen Sarff/Hartford, the minutes of November 21, 2006
be accepted and placed on file. The motion carried by voice vote, and was
unanimous.

to re-assign Officer Keith Grant from the West Central Illinois Task Force
back to the Canton Police Department effective January 1, 2007. Roll call.

COMMUNICATIONS FROM MAYOR HEINZE –
Mayoral Appointments. Motion
and second by Aldermen Sarff/West,
the appointments to the city’s Garbage Department of Eric Weaver and
Shiloh Vanmiddlesworth be confirmed. Roll call. AYES – Aldermen
Berardi, Hartford, West, Sarff, Meade, Carl, Schenck, Lewis. NAYS –
None. 8 AYES, 0 NAYS, 0 ABSENT. Motion carried.
Other.
Mayor Heinze commented on the snow removal and thanked the
city employees for all their hard work. Mayor Heinze mentioned that tickets
were not issued to those leaving their cars parked on the street during that
time. They will be ticketed now, as it makes it impossible for the city to
clean the streets of snow. Alderman Meade mentioned that the city has an
ordinance of a parking ban when 3 inches of snow fall, and cars parked on
the streets hamper the clean-up.

ORDINANCE – AUTHORIZING THE ISSUANCE OF NOT TO
EXCEED $16,500,000 AGGREGATE PRINCIPAL AMOUNT OF

ADJUSTABLE RATE DEMAND INDUSTRIAL REVENUE BONDS,
SERIES 2006 (GRAHAM HOSPITAL ASSOCIATION PROJECT)
(THE “BONDS”) OF THE CITY OF CANTON, FULTON COUNTY,
ILLINOIS, THE PROCEEDS OF WHICH SHALL BE LOANED TO
GRAHAM HOSPITAL ASSOCIATION (THE “BOROWER”), AND
ILLINOIS NOT-FOR-PROFIT CORPORATION, TO FINANCE THE
CONSTRUCTION AND EQUIPPING OF HEALTH CARE
FACILITIES LOCATED WITHIN THE CITY OF CANTON,
ILLINOIS; PROVIDING FOR THE PLEDGE AND ASSIGNMENT
OF REVENUES AND OTHER AVAILABLE FUNDS FOR THE
PAYMENT OF SAID BONDS; AUTHORIZING A TRUST
INDENTURE, LOAN AGREEMENT, TAX REGULATORY
AGREEMENT, BOND PURCHASE AGREEMENT; AUTHORIZING

RESOLUTION – APPROVING AN AGREEMENT FOR PIPELINE
CROSSING WITH KEOKUK JUNCTION RAILWAY COMPANY
AND APPROVING PAYMENT. Motion

and second by Aldermen Hartford/Schecnk, the resolution be adopted.
Discussion. Alderman Berardi wanted to know why the City of Canton has
to pay the railroad company a yearly fee for the Ethanol Water Line?

Alderman Berardi also mentioned he is not in favor of an open end contract.
Alderman Sarff said that Alderman Berardi has made a good point. If we
don’t pay what can they do? Alderman Sarff said he feels this is already a
commitment to supply the Ethanol Plant with water. City Attorney Chrissie
Peterson said that the agreement was made before she came to work for the
city and this is a maintenance cost for the railroad. Alderman Carl wants to
hold over the resolution. Alderman Schenck wants to send the resolution to
a committee. Alderman Meade felt would be a wiser move to send it back to
council. Alderman Berardi said his concern also was what if the Ethanol
Plant is no longer in business? That is why we need this in writing.
Aldermen Hartford/Schenck with drew their motion and second. The
resolution will be sent to the Public Works, Water & Sewer Committee

meeting for December 26.
EXECUTIVE SESSION - NEGOTIATIONS, GRIEVANCE &
PERSONNEL COMMITTEE – LABOR NEGOTIATIONS. Motion
and second by Aldermen Sarff/Hartford, to go into executive session to
discuss labor negotiations. Roll call. AYES – Aldermen Berardi, Hartford,
West, Sarff, Meade, Carl, Schenck, Lewis. NAYS – None. 8 AYES, 0
NAYS, 0 ABSENT. Motion carried.
The regular scheduled council meeting convened at 7:27 p.m. for executive
session.
The regular scheduled council meeting reconvened in open session at 8:03
p.m.
Motion
and second by Aldermen Hartford/Schenck, to reject the Police
Tentative Contract Agreement as being too costly for the City of Canton.
Roll call. AYES – Aldermen Berardi, Hartford, West, Sarff, Meade, Carl,
Schenck, Lewis. NAYS – None. 8 AYES, 0 NAYS, 0 ABSENT. Motion
carried.
